Two Democratic Senate committee leaders asked the Justice Department to appoint a special counsel to investigate whether Supreme Court Justice Clarence Thomas broke federal tax and ethics laws, the senators said Tuesday. "The evidence assembled thus far plainly suggests that Justice Thomas has committed numerous willful violations of federal ethics and false-statement laws," the senators alleged in the letter. It also "raises significant questions about whether he and his wealthy benefactors have complied with their federal tax obligations," Wyden and Whitehouse wrote. That evidence, they wrote, suggests that Thomas "likely violated federal law by accepting lavish gifts from wealthy benefactors and failing to report them" in violation of the Ethics in Government Act.

I talked to Samuel Freedman, a Columbia Journalism School professor, about his recent book about Humphrey and the 1948 Democratic convention in Philadelphia. The book’s title, “Into the Bright Sunshine,” is taken from a line in Humphrey’s rousing speech on civil rights. In 1968, the Democratic Party was operating under old rules in which primary voters actually had relatively little direct effect on delegates. When Strom Thurmond and the Dixiecrats bolted from the Democratic Party in 1948, that’s the beginning of the vast majority of the White South becoming Republicans, stepping away from the Democratic Party. Show me a major Republican politician in the MAGA movement who is a fervent supporter of civil rights legislation.

The Supreme Court on Friday upheld a federal law that prohibits people subjected to domestic violence restraining orders from having firearms, taking a step back from its recent endorsement of a broad right to possess a gun. The court on an 8-1 vote ruled in favor of the Biden administration, which was defending the law — one of several federal gun restrictions currently facing legal challenges. He argued that he cannot be prosecuted under the federal gun possession restriction in light of what the Supreme Court concluded. But the case before the justices concerns his separate prosecution by the Justice Department for violating the federal gun possession law.

The Supreme Court on Thursday upheld a tax on foreign income that helped finance the tax cuts President Donald J. Trump imposed in 2017 in a case that many experts had cautioned could undercut the nation’s tax system. The vote was 7 to 2, with Justice Brett M. Kavanaugh writing the majority opinion. Justice Amy Coney Barrett wrote a concurring opinion, joined by Justice Samuel A. Alito Jr., and Justice Clarence Thomas dissented, joined by Justice Neil M. Gorsuch. The question before the justices appeared narrow at first glance: Is the tax in question allowed under the Constitution, which gives Congress limited powers of taxation? In the majority opinion, Justice Kavanaugh wrote that the tax fell within the authority of Congress under the Constitution.

Though Justice Clarence Thomas’ decision in a major trademark case last week was unanimous, it prompted a sharp debate led by Justice Amy Coney Barrett over the use of history to decide the case. “There definitely is the potential formation here of an alternative or several alternative approaches to history that ultimately draw a majority,” Wolf said. “What we could be seeing is a more nuanced approach to using that history,” said Elizabeth Wydra, president of the progressive Constitutional Accountability Center. Transgender swimmer Lia Thomas lost her challenge against the Court of Arbitration of Sport in Switzerland — the world’s top court in matters of sporting fairness — to overturn the rules of World Aquatics that prevent transgender women from competing in women’s divisions. The ruling excludes transgender women who underwent male puberty, like Thomas, from participating in women’s races. By 2021, Thomas met the NCAA hormone therapy requirements to swim on Penn’s women’s team and did so for the 2020-21 and 2021-22 seasons. Thomas called the CAS decision “deeply disappointing” in a statement from her legal team, according to Athlete Ally. And yet, these are the facts: He accepted lavish gifts from powerful friends and failed to report them. His wife was indisputably involved in an attempt to stop the peaceful transfer of power from one president to the duly elected new one. Which Justice Thomas plainly detests when applied to minorities, because (I guess) he believes that it belittles the accomplishments of those who receive a helping hand. I’ve doubted Justice Thomas’s judgment in the past; now I doubt his advocacy skills in general. Because his arguments are self-pitying and unpersuasive.

The New York state comptroller sent a letter to Best Buy last week questioning whether the company changed its commitment to inclusivity and supporting LGBTQ groups. The comptroller's office manages the state's $207 billion public pension fund, which has invested in Best Buy. He also denied that the NCPPR pressured Best Buy to stop supporting LGBTQ groups in general. "This contentious and vast disagreement between radical gender theory activists and the general public has nothing to do with Best Buy selling electronics." Peck did not ask Best Buy to stop its donations to the HRC, saying in the email, "We understand that it's unrealistic for Best Buy to leave HRC in the near future because of their political clout."

Andrew Cuomo, after being subpoenaed last month, has agreed to testify to Congress about his controversial nursing home advisory from the early days of the Covid-19 pandemic, Rep. Brad Wenstrup told CNN’s Jake Tapper on Friday. Cuomo has insisted that advisory was consistent with guidance from the Centers for Medicare and Medicaid Services and the Centers for Disease Control and Prevention. However, his upcoming appearance before lawmakers is a sign of continuing scrutiny over his handling of long-term care facilities during the pandemic. The voluntary agreement means that Cuomo will participate with a transcribed interview rather than a deposition. Wenstrup told Tapper on Friday that the panel will also hear from Cuomo’s former secretary Melissa DeRosa and former commissioner of the New York State Department of Health Dr. Howard Zucker.
