But holding the White House and Senate majority for another few weeks doesn’t guarantee Democrats will have an easy time processing the final batch of Biden appointees. “There is a push across the board from the White House and the Senate for Democrats to show up and do the job they were elected to do,” a senior White House official, asking for anonymity to speak candidly, told CNN. The White House official pointed to how Republican Texas Sen. John Cornyn on Saturday promised “no weekends, no breaks” to confirm Trump’s Cabinet once he took power, and the White House official encouraged Democrats to show that dedication to judges in Biden’s final stretch. “Regardless of party, the American people expect their leaders to prioritize the rule of law and ensuring the criminal justice system can function effectively in every stated,” said White House spokesperson Andrew Bates. There are around nine – depending on what the calendar will allow – other Biden nominees who could still come through committee.

Sen. Bernie Sanders, I-Vt., on Sunday defended keeping Justice Sonia Sotomayor on the Supreme Court, after some Democrats have reportedly considered pressuring her to step down while President Joe Biden is still in office. He added that he’s heard “a little bit” of talk from Democratic senators about asking Sotomayor, who is serving a lifetime appointment to the Supreme Court, to step aside. Sonia Sotomayor, who is 70, is serving a lifetime appointment to the Supreme Court. If Sotomayor were to die during Trump’s term, she would likely be replaced by a conservative justice, pushing the now 6-3 conservative court further to the right. She died in September 2020 and Trump, then serving his first term, appointed the conservative Justice Amy Coney Barrett to replace her, leading to the court’s current conservative makeup.

CNN —Supreme Court Justice Sonia Sotomayor has made clear she has no plans to step down, according to people close to her, despite calls from some on the left that President Joe Biden should try to name a successor before President-elect Donald Trump takes office. “She’s in great health, and the court needs her now more than ever,” said one person close to the justice. Some progressives have suggested Sotomayor, the most senior liberal on the conservative Supreme Court, should step down so that Biden could try to name a replacement in the short window before Trump takes office in January. Vermont Sen. Bernie Sanders said Sunday that he doesn’t think Sotomayor should step down from the court. In May, Sotomayor told an audience at Harvard University that she sometimes cries after the court hands down its decisions.

Republicans, including former President Donald Trump, framed the effort in Virginia as a commonsense way of ensuring noncitizens don’t vote. At issue are about 1,600 voter registrations that Virginia said came from self-identified noncitizens but that a US District Court said hadn’t been fully vetted for citizenship status. Noncitizens are not allowed to vote in federal elections; none of the lower court rulings had changed that fact. But documented cases of noncitizens voting are extremely rare. Those opposed to the program relied on a 1993 law, the National Voter Registration Act, which bars states from making “systematic” changes to voting rolls with 90 days of a federal election.

CNN —A Travis County judge granted a Texas House committee’s last-minute temporary restraining order request against the state just 90 minutes before Robert Roberson was scheduled to be executed Thursday. While authorities have not confirmed the execution is delayed, Roberson’s attorneys and the committee fighting for him told CNN they believe the execution is currently halted. “This is an injustice and his blood is on Abbott and Anderson County,” she told CNN. I did not hear his voice,” Brian Wharton, the former detective who oversaw the investigation into Nikki’s death, told state lawmakers Wednesday at a hearing featuring the case. I don’t want to be there, I don’t want to watch it happen,” Wharton told CNN.

The former star appellate lawyer who allies once cast as the smartest person in the room remains confounded by the realities of Donald Trump. Roberts was shaken by the adverse public reaction to his decision affording Trump substantial immunity from criminal prosecution. The Roberts Court has been in sync with the GOP political agenda largely because of decisions the chief justice has authored: For Trump and other Republicans. But the politically charged valence deepened in the justices’ resolution of the case against former President Trump on election-interference charges from 2020. Harvard Law School professor Richard Lazarus, a longtime friend of Roberts, spent time with him in July immediately after the Trump decision was issued.

WASHINGTON — During Donald Trump’s White House tenure, Republicans assembled the most conservative Supreme Court in a century. Now, they’re excited about the prospect of building on those efforts by confirming even more conservative justices, as well as lower-court judges, if he wins another four years. Two long-serving conservative justices will be on retirement watch in the coming years: Clarence Thomas, 76, and Samuel Alito, 74. It takes 51 votes to confirm a Supreme Court justice, so in that scenario Republicans would have the power to replace them without any input from Democrats. On the campaign trail, Harris hasn’t said much about the prospect of Supreme Court vacancies under the next president.

“The Supreme Court has a limited role to play death penalty cases,” said Paul Cassell, a University of Utah law professor who is representing a victim’s family in another death penalty case before the high court this year. Another involves an Alabama man who claims he is intellectually disabled and therefore ineligible for execution under Supreme Court precedent. The Supreme Court’s approach to death penalty appeals is “to correct severe misapplications of constitutional law by America’s state court systems,” said Seth Kretzer, a Texas attorney who has represented death row inmates at the Supreme Court. Alabama is appealing that decision to the Supreme Court and has been waiting more than year for an answer. Williams’ team filed a clemency petition to the US Supreme Court last week, noting Missouri’s previous governor had postponed Williams’ execution indefinitely amid questions about the integrity of Williams’ trial. Eric Greitens previously halted Williams’ execution and formed a board to investigate his case and determine whether he should be granted clemency. “The Board investigated Williams’ case for the next six years — until Governor Michael Parson abruptly terminated the process,” Williams’ attorneys wrote. “The Governor’s actions have violated Williams’ constitutional rights and created an exceptionally urgent need for the Court’s attention,” Williams’ attorneys said in court documents.

Judge James Robart told Business Insider a bank that managed his wife's individual retirement account purchased Boeing stock in April 2023. He said as soon as he learned about it, he had the stocks sold; his financial disclosures said the shares were sold on two dates in May and June. Based on the prices that Boeing shares traded at on the days her IRA bought and sold the shares, at least one of the two sales was a money-loser, while the second could have been profitable. He and his family disposed of their Boeing shares more than a year before that decision. The amount of Boeing stock traded isn't much compared with Robart's total wealth.

Behind the scenes, the conservative justice sought to put a thumb on the scale for states trying to restrict how social media companies filter content. The states enacted their laws in 2021 and, with variations, restricted the ability of social media platforms to filter third-party messages, videos and other content. Greg Abbott signed that state’s measure, he said, “there is a dangerous movement by social media companies to silence conservative viewpoints and ideas.” In Florida, Gov. Kagan added a footnote to her majority opinion buttressing that point and reinforcing Barrett’s view. But, despite Alito’s protest, Kagan had a majority signing her decision, which, at minimum, offers lower court judges a strong indication of the framework the high court majority would use in future online challenges.

A U.S. marshal on a Supreme Court security detail shot and wounded an armed man who tried to carjack him early Friday near Justice Sonia Sotomayor’s home in northwest Washington, according to court documents. The marshal was sitting in an unmarked federal vehicle when a silver Toyota minivan pulled over next to him, according to court documents. Flowers through the window four times, hitting him in the mouth, according to the court documents. A second U.S. marshal from another vehicle also responded and fired his weapon, according to the Metropolitan Police Department. Flowers was charged with armed carjacking, carrying a pistol without a license, and possession of a large-capacity ammunition-feeding device.

In case after case, it has rightly emphasized the importance of turning to historical understandings in deciding constitutional cases rather than imposing modern policy views.
