And the man responsible for it was the top lawman in the area — Barry County Sheriff Dar Leaf. Leaf fashions himself as a “constitutional sheriff.” Sheriffs like him see themselves as holding supreme authority in their counties, exceeding that of state and federal law enforcement officials.

The Trump campaign and surrogates began filing lawsuits the very same day, challenging the results on a variety of grounds well before the final votes were counted. In Wisconsin, Trump filed a lawsuit alleging widespread voter fraud and demanding a recount, which ultimately reaffirmed Joe Biden’s victory in the state. Giuliani has been disbarred in New York and D.C., indicted in Georgia and Arizona and has been ordered to turn over his Manhattan apartment and other property to two Georgia election workers he defamed. Those rules were designed to prevent a repeat of the abuses of Richard Nixon, who improperly used the Justice Department to punish his political enemies. A new president appoints roughly 300 senior Justice Department officials, including the U.S. attorneys who run offices across the country. The 2020 campaign may have also suffered from a lack of imagination about how big the turnout would be and what Democrats were doing in the courts to expand the vote, a Trump campaign adviser said. Other familiar names from 2020 election lawsuits have been spotted this year too. One is Karen DiSalvo, who after the 2020 election helped force an audit in Lycoming County, Pennsylvania. The RNC and Trump campaign have focused what they call their election integrity effort on 18 states including the key swing states. A settlement has been reached in a defamation lawsuit pitting an electronic voting machine manufacturer targeted by allies of former President Donald Trump against a conservative news outlet that aired accusations of vote manipulation in the 2020 election. The Delaware lawsuit, which takes issue with Newsmax reports over a five-week period in late 2020, is one of several stemming from reports by conservative news outlets following the election. Smartmatic also is suing Fox News for defamation in New York and recently settled a lawsuit in the District of Columbia against the One America News Network, another conservative outlet. Dominion Voting Systems similarly filed several defamation lawsuits against those who spread conspiracy theories blaming its election equipment for Trump's loss. Last year, in a case presided over by Davis, Fox News settled with Dominion for $787 million.

Washington CNN —Jury selection is set to begin Thursday in a closely watched defamation trial pitting voting technology company Smartmatic against the right-wing cable network Newsmax, in a high-stakes case over the airing of false 2020 election claims. The Newsmax case revolves around the same false claims, championed by former President Donald Trump and his Republican allies, that the 2020 election was rigged by Smartmatic software and others. The Florida-based company sued Newsmax and other right-wing outlets and figures in 2021, alleging that its reputation was destroyed by the lies. The Newsmax case will test the legal limits of publishing lies about the 2020 election, and the trial will play out during the final stretch of the 2024 campaign. ‘Dozens’ of defamatory reportsAfter mainstream news outlets – and even Fox News – projected that Democratic nominee Joe Biden would win the 2020 election, Trump and his surrogates falsely claimed that he won.

In reality, Smartmatic's technology was used in only one county during the 2020 election, Los Angeles. AdvertisementBut the indictment can still help Fox News, Newsmax, and other defendants in Smartmatic's many defamation lawsuits. Following the 2020 election, Smartmatic and Dominion both launched civil defamation lawsuits against Trump allies and right-wing media organizations that pushed false claims about the companies. But some of its defamation lawsuits have been snagged by claims of wrongdoing in the Philippines. New York CNN —LinkedIn co-founder Reid Hoffman is providing significant financial firepower to Smartmatic as the voting technology company fights Fox News and Newsmax over the right-wing networks’ repeated airing of 2020 election lies. A person with knowledge of the matter wouldn’t say exactly how much money Hoffman poured into Smartmatic but told CNN the eight-figure investment surpassed $10 million. Smartmatic is seeking billions of dollars in damages from Fox News, Newsmax and other right-wing figures that falsely accused the company of rigging the 2020 election. The voting technology company’s defamation lawsuit against Fox News is still in the fact-finding “discovery” phase and isn’t expected to go to trial until 2025. Smartmatic is also suing Trump 2020 campaign lawyer Sidney Powell and MyPillow CEO Mike Lindell – two of the most egregious peddlers of election disinformation.

CNN —Voting technology company Smartmatic and the far-right network One America News said Tuesday that they had settled a defamation lawsuit stemming from the outlet’s lies about the 2020 election. “The case has been resolved pursuant to a confidential agreement,” OAN attorney Chip Babcock told CNN. The case against OAN was one of a spate of lawsuits filed against right-wing outlets in the aftermath of the election. In the wake of the 2020 presidential contest, pro-Donald Trump outlets spread lies wrongfully suggesting President Joe Biden had not been legitimately elected president. OAN settled a defamation suit in September with former Dominion executive Eric Coomer, whose case revealed how the network worked with former Trump campaign lawyer Sidney Powell and others to lie about the election.

CNN —A pro-Trump lawyer who tried to overturn the 2020 election was arrested Monday after a court hearing about her recent leak of internal emails belonging to Dominion Voting Systems. In the last 24 hours, Leaf has posted more than 2,000 internal Dominion documents on his social media account. The marshals declined to say whether they arrested her, and she didn’t answer messages seeking comment after the hearing. During the at-times testy hearing Monday, Magistrate Judge Moxila Upadhyaya peppered Lambert with sharp questions about the disputed Dominion materials. Dominion wants Lambert removed from the case and suggested in court Monday that she might have committed a crime by disseminating the files to Leaf.

CNN —The Supreme Court on Tuesday declined to revisit sanctions levied against two pro-Trump attorneys who filed frivolous lawsuits challenging the outcome of the 2020 election in Michigan. Sidney Powell and Lin Wood filed separate appeals asking the justices to review sanctions imposed by a US district court in 2021. Though their cases involved several technical arguments, both claimed sanctions would make it less likely for lawyers to take “unpopular” cases to court. The Supreme Court denied both appeals without offering any comment on the case. The 6th US Circuit Court of Appeals largely upheld the sanctions.

Some might not reach trial this year, while one is set to begin in a matter of weeks. In all, Trump faces 40 felony charges in the classified documents case. U.S. District Judge Aileen Cannon set a trial date of May 20, 2024, though she has signaled that it may be pushed back. The Trump campaign called the charges “fake” and asked why it took two and a half years to bring them. That case is set to be first to proceed to trial, with a judge setting jury selection for March 25.

The revelation builds on CNN’s previous reporting that OAN President Charles Herring forwarded the purported Smartmatic passwords to ex-Trump campaign lawyer Sidney Powell within days and later passed it to Mike Lindell. OAN denies defaming Smartmatic or anyone else, and its lawyers say nobody at OAN broke the law in connection with the alleged passwords. In a recent court filing, Smartmatic publicly disclosed – for the first time – the original email that OAN received on January 5, 2021, containing the alleged passwords. If you come across any addition (sic) information, please pass along,” according to emails made public in court filings. CNN pieced together who was involved in the email exchanges by examining court records from three separate cases stemming from the 2020 election. Baseless 2020 smearsSmartmatic has sued OAN, Powell, and other Trump allies and right-wing outlets, seeking billions of dollars in damages for their 2020 election lies. It’s unclear if the spreadsheet has any connections to the breach in rural Coffee County - which used software from Dominion Voting Systems, and not Smartmatic, in the 2020 election. One of its correspondents, who is also an attorney, even worked with Trump’s legal team to subvert the 2020 election results. The network, the two Herrings, and some of their on-air personalities are also being sued for defamation by Dominion, which was the target of similar 2020 election lies.

Cohen already let the case proceed against Fox News — and on Wednesday, he rejected a request by Fox Corporation to throw out the claims against the parent company. The parent corporation had argued that it shouldn’t be involved in the defamation case because it only had general oversight of Fox News itself. The case is still in the discovery phase, with some major depositions taking place in the past month, including former Fox Corporation chairman Rupert Murdoch. The decision boosts Smartmatic’s case against the right-wing media behemoth. A similar 2020-related lawsuit by Dominion Voting Systems was also allowed to proceed against Fox and its parent company.

The accusations do not change the underlying facts in the Trump prosecution. A Georgia grand jury already brought racketeering indictments against Mr. Trump and 18 others over their roles in a plot to overturn the state’s 2020 election results. There are also calls for a new state board, created to oversee district attorneys, to review Ms. Willis’s conduct. Rupert Murdoch, chairman of News Corp and co-chairman of 21st Century Fox, arrives at the Sun Valley Resort of the annual Allen & Company Sun Valley Conference, July 10, 2018 in Sun Valley, Idaho. Rupert Murdoch is being deposed Tuesday as part of the $2.7 billion defamation lawsuit filed against Fox Corp. by the voting technology company Smartmatic, a source familiar with the matter told CNBC. It is the second time this year that Murdoch, 92, has been deposed in a high-stakes defamation lawsuit accusing Fox News of airing damaging lies about the 2020 U.S. presidential election. Fox paid $787.5 million to settle Dominion's lawsuit, nearly half of the $1.6 billion figure initially demanded by the voting company. CNN —The judge overseeing the Fulton County election racketeering case declined Tuesday to send one of Donald Trump’s co-defendants to jail over recent social media posts and other comments he made targeting witnesses. He does not get an ‘oh, I’m sorry,’ after I’ve already intimidated the witnesses in this case,” Willis said. The felonies Floyd faces in the case are largely tied to his role in an intimidation campaign targeting two Atlanta election workers in late 2020. The leader of Black Voices for Trump, Floyd was separately charged in May with simple assault of a federal officer who was delivering a subpoena to him to testify before a grand jury in Washington, DC. A prosecutor asked a judge to Friday to schedule the Georgia election interference criminal trial of former President Donald Trump and his co-defendants to begin on Aug. 5 — exactly three months before the 2024 presidential Election Day. "The State clearly retains the logistical and prosecutorial capabilities to try all of the remaining Defendants together," Willis said in her motion. Trump's campaign spokesman said, "Radical Democrat Fani Willis has again proven that her case is purely political, designed to interfere with President Trump's re-election by demanding a trial date in the most vital time in President Trump's winning campaign." "Crooked Joe Biden knows he can't beat President Trump and this corrupt step by Fani Willis is just further proof of that fact," the spokesman said. The Manhattan Supreme Court judge in that case has said he will willing to re-schedule it to avoid a conflict with Trump's trial earlier that same month in Washington.
