CNN —The Manhattan district attorney said Tuesday it would agree to postpone Donald Trump’s sentencing to give them time to litigate the president-elect’s expected motion to dismiss the hush money case. The developments cap an historic and unprecedented turnaround for Trump’s legal and political fate. One year ago, Trump was facing four separate indictments. In the letter to the judge, the Manhattan district attorney argued that the judge should not dismiss Trump’s conviction. In a statement, Trump spokesman Steven Cheung called the file “a total and definitive victory for President Trump.”This story has been updated with additional developments.

CNN —After the suicide of a nonbinary student last February spurred a monthslong federal investigation, the US Department of Education found Title IX violations in an Oklahoma public school district including multiple failures to respond to notices of sexual harassment. The DOE’s Office of Civil Rights announced a resolution Wednesday with the Owasso Public School District to remedy Title IX violations linked to sexual harassment in district schools. The OCR investigation began last March, weeks after the death of nonbinary teen, Nex Benedict. The investigation also identified several other instances in the last three years when district staff failed to properly respond to sexual harassment complaints. The agreement between the DOE and the school district requires the district to implement new policies and procedures and additional training for staff and students.

CNN —Donald Trump’s lawyers and the Manhattan district attorney’s office have agreed to delay activity in the hush money case until November 19 to give the president-elect’s lawyers time to make new arguments on how his election victory impacts the case. Judge Juan Merchan was expected to rule Tuesday on whether to overturn the business fraud conviction based on this summer’s Supreme Court ruling on presidential immunity. “The stay, and dismissal, are necessary to avoid unconstitutional impediments to President Trump’s ability to govern,” Bove wrote. The Supreme Court’s immunity decision also indefinitely tied up Trump’s federal election subversion case in Washington, DC. The jury should not have heard any testimony from Hope Hicks about events in 2018 when she was the White House Communications Director, Trump’s lawyers argued.

There should be no enduring mystery about what a Trump presidency means for Ukraine. Trump has said he would end the war “in 24 hours,” but not how. Trump may appoint a cabinet that mildly adjusts the pace or tone of his instincts, but in the end he wants out. It is an anathema to two of Trump’s first term dislikes: costly US military engagement abroad, and upsetting Russian President Vladimir Putin. Since it is a state case, Trump does not have the power to pardon himself next year after he is sworn into office. Federal cases in DC and FloridaTrump’s election victory is poised to have the greatest impact on the two federal criminal cases brought against him by Smith in Washington, DC, and Florida. Dismissing Smith would allow the Department of Justice and Trump’s attorney general to move to drop the charges against him and end the court cases. In the DC case, Smith charged Trump over his efforts to overturn his election loss in 2020. In September, state and federal appeals courts in New York heard arguments for two of Trump’s civil appeals.

You can’t look this up in a law book and find an answer to the query because it doesn’t exist.”Previously, prosecutors have not objected to Trump’s bids to delay his sentencing before the election, which Judge Juan Merchan noted in agreeing to postpone Trump’s sentencing until late November. If Trump loses on immunity, his lawyers are expected to ask Merchan to delay Trump’s sentencing so they can appeal. Trump’s attorneys attempted this in 2023, and District Judge Alvin Hellerstein denied it. But following the Supreme Court ruling, Trump’s attorneys made a second attempt this summer. That was denied when Merchan agreed to postpone Trump’s sentencing.

CNN —A Manhattan grand jury has indicted Harvey Weinstein on new sex crime charges, according to his attorney Arthur Aidala. “The grand jury has indicted Mr. Weinstein,” prosecutor Nicole Blumberg said during a court hearing on Thursday. It could include sexual assault allegations from three women, prosecutors said at a separate hearing last week. One alleged assault occurred at a residential building in lower Manhattan in the winter months between 2005 and 2006. A source with knowledge of the matter told CNN that alleged assault is said to have occurred during in 2006.

CNN —A New York appeals court has rejected Donald Trump’s attempt to lift a gag order that continues to restrict his public statements in the wake of his New York criminal conviction. As it stands, the gag order bars Trump from publicly discussing the prosecutors, court staff and their families. In the decision filed Thursday, a panel of judges from the Appellate Division First Department said Judge Juan Merchan can keep the gag order in place through Trump’s sentencing. “Contrary to petitioner’s contentions, the People’s evidentiary submissions in opposition to his motion in Supreme Court demonstrate that threats received by District Attorney staff after the jury verdict continued to pose a significant and imminent threat,” the appeals court ruled. Trump’s sentencing, which was originally scheduled for July, was delayed to mid-September while Merchan considers his motion to toss the conviction in the wake of the US Supreme Court’s presidential immunity decision.

CNN —New York’s attorney general urged the Supreme Court on Wednesday to stay out of Donald Trump’s hush money criminal case, arguing the nation’s highest court should not grant a novel request by Missouri to pause his sentencing hearing and lift the gag order imposed on the former president in the case. Earlier this month, Missouri Attorney General Andrew Bailey, a Republican, asked the Supreme Court for permission to file a complaint against New York to pause Trump’s September sentencing hearing and lift the restrictions on his speech – arguing in part that New York was infringing on the right of Missouri voters to hear from presidential candidates. “Allowing Missouri to file this suit for such relief against New York would permit an extraordinary and dangerous end-run around former President Trump’s ongoing state court proceedings and the statutory limitations on this Court’s jurisdiction to review state court decisions,” she wrote. For now, a limited gag order barring Trump from publicly speaking about prosecutors, court staff and their families remains in place at least until Trump is sentenced. “The award of $464 million in a case with no victims, no proven injuries, and no losses is not remotely defensible,” Trump’s lawyers wrote. According to Trump’s attorneys, Trump personally should have been dismissed as a defendant. The Trump attorneys accused Engoron of enacting a “punitive” penalty against the former president that was unconstitutional. Just like at trial, Trump’s lawyers in particular took issue with a reference in Engoron’s summary judgment opinion that Trump’s Mar-a-Lago resort was valued at $18 million. During the trial, Engoron said that he was not trying to assess the value of the property when he referenced the tax assessor value.

CNN —Donald Trump urged the judge in his New York hush money case to dismiss his conviction in light of the Supreme Court’s ruling on presidential immunity last month, according to a new court filing. “In order to vindicate the Presidential immunity doctrine, and protect the interests implicated by its underpinnings, the jury’s verdicts must be vacated and the Indictment dismissed,” Trump’s attorneys wrote to Judge Juan Merchan. “Much of the unconstitutional official-acts evidence concerned actions taken pursuant to ‘core’ Executive power for which ‘absolute’ immunity applies.”The district attorney’s office declined to comment for this story. The district attorney’s office will respond later this month, and Merchan said he will decide the matter in September, with a potential sentencing scheduled on September 18, if necessary. Trump’s sentencing would be postponed until September 18, Merchan wrote – “if such is still necessary.”The district attorney’s reply to Trump is due on July 24.

CNN —Donald Trump will not be sentenced on his business fraud conviction until September, a New York judge ruled Tuesday in the wake of Monday’s Supreme Court decision on presidential immunity. The ruling could impact the indictments of Trump in the classified documents and Georgia election interference cases as well. Trump’s legal team filed a letter Monday seeking to challenge the former president’s conviction after the Supreme Court ruled that presidents have an absolute immunity from prosecution for core official acts. Will Scharf, an attorney who represents Trump in the immunity case, told CNN Monday night the high court’s ruling “absolutely” impacts the hush money case. Trump, however, cannot discuss any prosecutor, court staffer or their family members, according to a court order on Tuesday from Judge Juan Merchan that rolls back parts of the gag order imposed before the trial began. That aspect of the gag order remains in effect at least until his sentencing, which is set for July 11. Trump spokesperson Steven Cheung said in a statement that Merchan’s order “leaves in place portions of the unconstitutional gag order” and that Trump plans to appeal the ruling. Trump repeatedly complained about the gag order throughout the seven-week trial, arguing that witnesses, including Cohen, were taking advantage of the gag order to attack him when he couldn’t respond. In the filing, the Manhattan district attorney’s office said it did not oppose lifting the portion of the gag order that blocked Trump from making statements about witnesses.

The indictment alleged that Trump was a part of an illegal conspiracy to undermine the integrity of the 2016 election. While hush money payments are not illegal in themselves, each charge was tied to a specific allegedly false entry among the financial records of the Trump Organization. Trump has argued that the payments to Michael Cohen, his former fixer who paid Daniels, were correctly labeled as legal expenses. Trump railed against the gag order every day during the trial and again on May 31 when he spoke at Trump Tower the day after the verdict. And the Georgia election interference case is in legal limbo while Trump and several of his co-defendants try to disqualify the Atlanta-area prosecutor who brought the charges.

Donald Trump departed Trump Tower moments ago and is en route to the downtown Manhattan courthouse, where a jury is set to continue a second day of deliberations to determine his legal fate in his historic criminal hush money trial. The 12 jurors— seven men and five women — will determine whether Trump is guilty of 34 felony criminal charges of falsifying business records in connection with allegedly concealing reimbursements to his then-lawyer for a purported hush money scheme to silence an adult film star about an affair shortly before the 2016 presidential election. Jurors will return to court at 9:30 a.m. Trump and the attorneys will remain in the courthouse while the jury deliberates. Trump’s team has a war room of sorts and will be in there at times during jury deliberation.

CNN —A Manhattan jury found Donald Trump guilty of all 34 charges of falsifying business records Thursday, an unprecedented and historic verdict that makes Trump the first former president in American history to be convicted of a felony. And if he defeats President Joe Biden in November, he will be the first sitting president in history to be a convicted felon. The verdict in the hush money trial was announced after jurors deliberated for nearly 12 hours over two days. Manhattan District Attorney Alvin Bragg speaks to the media after a jury found former President Donald Trump guilty on 34 felony counts of falsifying business records, on Thursday, May 30, in New York. “There’s only one way to keep Donald Trump out of the Oval Office: At the ballot box,” Biden wrote on X, linking to a fundraising page.

The judge left the courtroom, and Trump, his lawyers and the prosecutors remained behind to wait for the end of the day. But everything changed when the judge re-entered the courtroom at 4:36 p.m. with a stunning note: The jury had reached a verdict. The jury needed 30 minutes to fill out the forms, leaving Trump and the attorneys sitting in the courtroom until the judge and jury returned. When the judge returned to the bench, he warned the parties and the audience against “reactions” or “outbursts of any kind” before the jury entered. The jurors were polled one-by-one to confirm this was their verdict, and Trump turned and craned his neck to the right to look at the jurors.

Defense attorney Todd Blanche will present first Tuesday morning with closing arguments expected to take 2.5 to 3 hours, a person familiar tells CNN. Essentially, Trump’s lawyers do not want the lead prosecutor to have another crack at the jury before they retire to deliberate. What they are expected to say today: In their closing, Trump’s team will revisit many of the arguments they made at trial — that allegedly falsified documents were not falsified because Michael Cohen was working as a lawyer to President Trump in 2017, according to the person familiar. They will also argue that if documents were falsified, it was Cohen who falsified them by lying about how much he was owed, according to the source. The Trump team does not feel that Robert Costello’s disastrous appearance on the witness stand last week will ultimately hurt their case or their arguments about Cohen.
