CNN —Donald Trump’s legal troubles deepened earlier this week when he was informed by special counsel Jack Smith that he’s the target of the criminal investigation into the aftermath of the 2020 election – the clearest sign yet that the former president could soon face more criminal charges. But without more detail, it’s hard to know exactly what shape the charges will take or what Trump 2020 election-related conduct they are aimed at. Among the potential charges Trump has been warned about is one pertaining to witness tampering, according to the Wall Street Journal and other outlets. Trump’s alleged involvement in a criminal conspiracy has been invoked in the litigation around the House select committee that investigated January 6’s pursuit of Trump lawyer John Eastman’s emails. That ruling pointed both to the obstruction of an official proceeding statute and the general conspiracy statute.

WASHINGTON—The State Bar of California is seeking to revoke the law license of John Eastman , saying the one-time lawyer for former President Donald Trump is unfit to practice law in light of his efforts to overturn the 2020 presidential election. In a press release issued on Thursday, the state licensing body said it had launched a disciplinary proceeding against Mr. Eastman after determining that he violated an ethics rule prohibiting acts of “moral turpitude” and dishonesty.

John Eastman took the Fifth Amendment 100 times when he was before the House Jan. 6 committee, per a hearing this summer. Given Mr. Eastman’s reluctance to discuss his role in those events, his letter to the editor nearby adds to the public record, and it’s worth a final word. Mr. Eastman denies advising that Vice President Mike Pence could reject electoral votes on Jan. 6, 2021. Mr. Pence’s legal counsel, Greg Jacob , testified under oath that on Jan. 5 Mr. Eastman explicitly asked for the VP to do that. Mr. Eastman now says Mr. Jacob “either misconstrued something I said (in a meeting several hours long covering many complex issues) or bore false witness.”

In the lead-up to the Jan. 6 riot, John Eastman gave President Trump legal advice that was terrible, and now he’s trying to argue it was merely awful. In a letter to these pages on Nov. 14, Mr. Eastman, a former law professor of some distinction, denies he argued that Vice President Mike Pence “could unilaterally reject electoral votes and simply declare President Trump re-elected.”Mr. Eastman claims he made only a modest proposal, Swiftian allusion intended: “The advice I gave to then-Vice President Pence was that he accede to requests from hundreds of state lawmakers to delay proceedings for a short time so that they could assess the effect of illegalities on the conduct of the election.” Mr. Eastman specifically refers to a conversation during an Oval Office meeting on Jan. 4, 2021.
