New York prosecutors told the judge who presided over Donald Trump's hush money trial on Tuesday that his sentencing should be postponed while the president-elect's lawyers file further legal arguments asking the case be dismissed. The proposal Tuesday from Manhattan District Attorney Alvin Bragg's office would need to be signed off on by Judge Juan Merchan to become official. A ruling against Trump on the issue would have paved the way for the judge to proceed with his sentencing, which was tentatively scheduled for Nov. 26. That case has been paused while Trump and some of his co-defendants seek to have an appeals court remove Willis from the case for an alleged conflict of interest. Trump's lawyers have contended that even if she’s allowed to remain on the case, any Trump trial would have to wait until he’s out of office in 2029 because of constitutional issues.

CNN —The Supreme Court declined Tuesday to let Mark Meadows move his Georgia election subversion case to federal court, effectively barring the former chief of staff during Donald Trump’s first term from claiming immunity from those charges. Meadows wanted to have his case heard in federal – rather than state – court, where he would be able to raise immunity claims. The Atlanta-based 11th US Circuit Court of Appeals ruled last year that the Georgia prosecution against Meadows should continue in state court, concluding that former federal officials are not covered by that statute “removing” state cases against government officials to federal court. The Georgia case has been at a standstill while an appeals court considers ethics allegations against Fulton County District Attorney Fani Willis. Meadows has also sought to move his criminal case related to the 2020 election in Arizona to federal court but failed to convince a judge in September.

Being elected president will likely result in the federal criminal cases against him being dismissed, while his state criminal cases could at the least be frozen until after he leaves office. Trump’s legal team, meanwhile, is evaluating its next steps for how to get all four criminal cases resolved, and plan to argue soon that all of the cases “must stop immediately,” according to a source directly involved in the discussions. Here's a look at where the various legal cases against Trump stand — and how they could be affected by his victory. They argue that some of the evidence presented to the grand jury and at the criminal trial should not have been allowed in the wake of the high court's ruling. Trump's victory likely won't impact his pending appeals of the civil judgments against him that total more than $550 million.

With his comeback victory over Vice President Kamala Harris in the books, Trump can rest easy. But he has not yet escaped from liability in a handful of high-profile civil cases, where he has been ordered to pay combined penalties of over $570 million. "In theory, there should be no effect" from Trump's election on those civil matters, former federal prosecutor Neama Rahmani told CNBC. "It's well established that while a sitting president can't be prosecuted, he can face civil cases," Rahmani said. A state-level criminal case in Georgia, alleging Trump illegally meddled in that state's 2020 election, is also on ice.

Atlanta rap star Young Thug agreed to change his plea to guilty Thursday in Georgia’s longest-running criminal trial, a stunning turn that, if approved by the judge, would bring his high-profile case to a close. The agreement comes after three of Young Thug's co-defendants took plea deals this week following mounting speculation that Whitaker could order a mistrial. Fulton County District Attorney Fani Willis used Georgia's Racketeer Influenced and Corrupt Organizations, or RICO, statute to claim Young Thug and his associates are a street gang with ties to the national Bloods gang. Whitaker this week approved plea deals for three of them: Quamarvious Nichols, 29; Marquavius Huey, 28; and Rodalius Ryan, 18. Young Thug first gained mainstream success with his 2014 drug anthem "Stoner."

A co-defendant in the racketeering and gun conspiracy case against Atlanta rapper Young Thug accepted a plea deal Tuesday after days of speculation over whether Georgia's longest-running criminal trial may end in a mistrial. Young Thug and the others have been jailed since 2022 on charges of conspiracy and criminal street gang activity and additional firearm- and drug-related charges. The indictment accuses Young Thug, 32, of leading a street gang, Young Slime Life, or YSL, with members committing illegal and violent acts, including murder, armed robbery, drug dealing and carjacking. Opening statements finally began last November after several defendants had already taken plea deals while others chose to be tried separately from Young Thug. The defendants have denied they are part of a street gang and critics contend the RICO law is being unfairly used against Black hip-hop artists.

Fulton County prosecutors asked a Georgia appeals court this week to restore six charges against former President Donald Trump that were tossed in his indictment over attempts to overturn his 2020 election loss in the state. In a court filing, prosecutors from Fulton County District Attorney Fani Willis' office requested that the state's Court of Appeals reinstate six counts, including three against Trump, that she said Fulton County Superior Court Judge Scott McAfee wrongly discarded earlier this year. "The trial court erred by quashing six counts of the indictment in this case, each of which alleged the crime of Solicitation of Violation of Oath by Public Officer," they wrote. The three solicitation counts against Trump included accusations that he solicited Georgia House Speaker David Ralston and twice solicited Georgia Secretary of State Brad Raffensperger. Four of the original 19 co-defendants in the case have pleaded guilty, while Trump, Meadows, Giuliani and the others have pleaded not guilty.

CNN —Fulton County District Attorney Fani Willis has asked the state’s Court of Appeals to reinstate six counts in the election subversion case against Donald Trump and his co-defendants, including three specifically against the former president. The court filing brings the aftermath of the 2020 presidential election, and the effort to overturn Trump’s election defeat, back into the spotlight as early voting begins in Georgia in the 2024 election. The counts relate to Trump and his co-defendants’ alleged efforts to have state officials appoint a fake slate of electors for the state following his loss in the 2020 election. In his March decision, McAfee wrote that Willis failed to give the defendants “enough information” to prepare their defenses. “As written, these six counts contain all the essential elements of the crimes but fail to allege sufficient detail regarding the nature of their commission, i.e., the underlying felony solicited,” McAfee wrote at the time.

In his staunch denial of any wrongdoing, Adams is sounding eerily similar to another politician: former President Donald Trump. At a press conference in New York City on Thursday afternoon, Trump defended Adams and praised the mayor's immigration stance.

Jones had denied wrongdoing in the case and blasted Willis in a statement Friday. Burt Jones’ role as a fake elector after the 2020 election announced he will not move forward with criminal charges against the former state senator. “The evidence also indicates Senator Jones did not act with criminal intent, which is an essential element of committing any crime.”A Georgia judge blocked Willis from investigating Jones in July 2022. Jones was then a Republican state senator, and Willis was reprimanded by the judge for hosting a fundraiser for the Democratic candidate who was running against Jones to be Georgia’s next lieutenant governor. ATLANTA — The judge overseeing the election interference case against Donald Trump and several co-defendants in Georgia has thrown out three counts in the indictment — including two counts brought against the former president. “President Trump and his legal team in Georgia have prevailed once again,” he said in a statement. But a lawyer for Trump confirmed that McAfee’s decision would also apply to Trump. The case is currently on hold as Trump and other defendants appeal McAffee’s decision not to disqualify Fulton County District Attorney Fani Willis. CNN —A judge on Thursday threw out three charges in the sweeping Georgia election subversion case, including two charges that former President Donald Trump faces. In a separate ruling, Fulton County Judge Scott McAfee also upheld the marquee racketeering charge in the case, which Trump is also facing. In the ruling, McAfee also threw out a separate count of filing false documents, which Trump was charged with. Trump was only named in two of the three charges that McAfee threw out Thursday. CNN —Attorney General Merrick Garland slammed efforts to turn the Justice Department into a “political weapon” during a fiery speech Thursday to department staff and US attorneys from across the country amid attacks from former President Donald Trump and his allies. Trump and his associates have publicly discussed plans to dismantle the department and its law enforcement components like the FBI, or to prosecute his political enemies. Trump has repeatedly attacked the Justice Department under Biden, claiming without evidence that the president has used the department to criminally pursue him and his allies for political purposes. “They weaponized the Justice Department. Garland also thanked the prosecutors and Justice Department staff for refusing to “bend to politics” and “break under pressure.”“You deserve better,” he said.

A judge on Thursday dismissed two criminal counts against Donald Trump in his Georgia election interference case, but kept intact the top racketeering charge and other counts against the former president and other defendants. Fulton County Superior Judge Scott McAfee also tossed out a third count that had been lodged against a number of Trump allies. The third count the judge tossed — numbered as Count 14 in the indictment — was criminal attempt to commit filing false documents. In March, judge tossed out three counts of solicitation of violation of oath by a public officer that had been lodged against Trump.
