Rep. Jim Jordan, R-Ohio, the chair of the House Judiciary Committee, on Sunday said that he and his House Republican colleagues are “not taking anything off the table” related to investigating special counsel Jack Smith. But all we’re saying is, ‘preserve everything,’ so we, the Congress, who have a constitutional duty to do oversight, can see everything,” Jordan added. She was fired by the evangelical Christian school after disclosing her identity as a transgender woman. Judge Vyskocil ruled the woman has to file the lawsuit under her name by November 13 or the lawsuit will be dismissed. CNN —Former President Donald Trump is again claiming that special counsel Jack Smith is trying to influence the November presidential election by seeking to make new evidence and witness testimony public as voters start to go to the polls. The brief is aimed at convincing the trial judge in the case – and eventually, higher courts – that Smith’s case can survive under the Supreme Court’s recent ruling that said Trump had at least some presidential immunity in the prosecution. The filing is expected to reveal new evidence against Trump, including what several witnesses testified to in the grand jury proceedings. Sources say the proposed redactions are minimal, blacking the sources of the information and removing witness names, but leaving the substance of what they said about Trump for public view. Prosecutors from Smith's office have said that such a filing is necessary because it would address the Supreme Court's concerns about presidential immunity issues in the case while limiting the number of possible appeals. CNN —Special counsel David Weiss’ office spent a total of $3.4 million over the past six months, a dramatic increase as it took Hunter Biden to trial in Delaware on gun-related charges and secured a conviction of the president’s son. Spending by two other Justice Department-appointed special counsels, Jack Smith and Robert Hur, decreased slightly compared with the six months prior. The disclosures come as courts have upped their scrutiny of special counsel office operations. Hunter Biden and another defendant in a separate criminal case have so far been unsuccessful in attempting to challenge special counsel Weiss’ authority. CNN —A federal judge on Monday dismissed the classified documents case against Donald Trump, a shock ruling that clears away one of the major legal challenges facing the former president. In a 93-page ruling, District Judge Aileen Cannon said the appointment of special counsel Jack Smith violated the Constitution. She did not rule on whether Trump’s alleged mishandling of classified documents was proper or not. Even though a trial before the presidential election was considered highly unlikely, many legal experts had viewed the classified documents case as the strongest one of the four cases that were pending against the former president. Smith had charged Trump last year with taking classified documents from the White House and resisting the government’s attempts to retrieve the materials.

There may be a path for Smith to revive the case, Cannon noted in her ruling, and Smith can appeal the decision. Cannon left open a potential pathway in her ruling for the classified documents case to be revived. (He is being prosecuted by a separate special counsel, David Weiss.) And during the Trump-Russia investigation, multiple Trump allies similarly attempted to derail special counsel Robert Mueller’s work. Former Attorney General Edwin Meese and Citizens United argued the same, writing that Smith’s appointment “severely undermines” the constitutional order.

CNN —A federal judge paused some filing deadlines in the classified documents case against former President Donald Trump in a brief order Saturday, and agreed to additional briefings on whether she should pause the case to consider what effect the Supreme Court’s immunity ruling may have on the criminal proceedings in Florida. Judge Aileen Cannon set a two-week briefing schedule for those arguments and paused three unrelated filing deadlines that were scheduled to take place during that period. Trump is charged in the case with taking classified documents from the White House and resisting the government’s attempts to retrieve the materials. The Supreme Court ruled Monday that Trump may claim immunity from criminal prosecution for some of the actions he took in the waning days of his presidency. CNN —Attorneys for former President Donald Trump are now seeking to use the Supreme Court’s presidential immunity decision to help him in his criminal case in Florida over the mishandling of classified documents. In a new court filing Friday, Trump’s team said they want an updated schedule in the federal classified documents case so they can argue points related to the Supreme Court decision. The decision “guts the Office’s position that President Trump has ‘no immunity’ and further demonstrates the politically-motivated nature of their contention that the motion is ‘frivolous,’” Trump’s attorneys wrote. The Supreme Court’s decision directly applies to the federal case over 2020 election subversion efforts in Washington, DC, but it could impact all four of the criminal cases against the former president. Trump’s attorneys argue the concurrence “adds force” to motions Trump has filed against how Smith was appointed and funded.
