WASHINGTON — The Supreme Court on Wednesday allowed the Biden administration at least in the short term to enforce its latest attempt to curb climate-harming carbon emissions from coal- and gas-fired power plants that contribute to climate change. The Supreme Court is often skeptical of major agency actions but it has bucked that reputation in recent weeks. Under the proposed rule, the EPA wants to require “carbon capture,” a technique that uses solvents to remove carbon dioxide from a power plant’s emissions. The appeals court in July declined to block the regulation, saying the major questions doctrine did not apply on this occasion. In court papers, the challengers sought to portray the new regulation as being essentially the same as the one the Supreme Court struck down.

CNN —The Supreme Court on Tuesday signaled a willingness to uphold a Biden administration regulation on “ghost guns,” mail-order kits that allow people to build untraceable weapons at home and that are turning up at crime scenes with greater frequency. The difference here, she said, is that the ghost guns are marketed to be built into guns and serve no other conceivable purpose. President Joe Biden’s administration told the court in briefing that police departments have faced an “explosion of crimes involving ghost guns” in recent years. In 2017, police submitted about 1,600 ghost guns recovered at crime scenes for tracing. After that decision, a lower court stepped in to block the regulations as applied to two manufacturers.

The White House finally told the official that it would be in touch it if had additional guidance to offer on the supplemental investigation. Prosecutors have already charged Ryan Wesley Routh with two firearms offenses, and a federal magistrate judge on Monday ordered him detained pending further court proceedings. The attempted assassination charge is “pretty rare,” according to former FBI Deputy Director Andrew McCabe, a CNN senior law enforcement analyst. But it has been used in other high-profile attempted assassination cases, such as that of a man charged with traveling to Brett Kavanaugh’s Maryland home with a gun, burglary tools and other equipment in an apparent attempt on the Supreme Court justice’s life. To prove their case, prosecutors would have to convince a jury that Routh took affirmative steps to carry out a plot to kill the former president. Ron DeSantis said last week that the state “will be conducting its own investigation regarding the attempted assassination at Trump International Golf Club.” Routh has not been charged in state court.

Behind the scenes, the conservative justice sought to put a thumb on the scale for states trying to restrict how social media companies filter content. The states enacted their laws in 2021 and, with variations, restricted the ability of social media platforms to filter third-party messages, videos and other content. Greg Abbott signed that state’s measure, he said, “there is a dangerous movement by social media companies to silence conservative viewpoints and ideas.” In Florida, Gov. Kagan added a footnote to her majority opinion buttressing that point and reinforcing Barrett’s view. But, despite Alito’s protest, Kagan had a majority signing her decision, which, at minimum, offers lower court judges a strong indication of the framework the high court majority would use in future online challenges.

The Idaho law had exemptions only to prevent death of the pregnant woman and in instances of rape or incest. It issued formal guidance saying the Emergency Medical Treatment and Labor Act (EMTALA), which requires stabilizing treatment regardless of a patient’s ability to pay, would preempt any state abortion ban in situations when an emergency termination was needed. Idaho lost in an initial proceeding in a US district court, as a judge issued a temporary injunction against the abortion ban.

To reread "Hillbilly Elegy" now, as I did this week, is to feel a sense of disorientation. JD Vance the author sounds a lot different than JD Vance the politician. Personally, I first read "Hillbilly Elegy" in college, in an earnest if somewhat contrived attempt to better understand communities unlike mine. On stage, he recounted a story that also appears in "Hillbilly Elegy," where Mamaw bluntly threatens violence against one of Vance's friends. There are hints of this in "Hillbilly Elegy" as well: He served as a public affairs Marine, where he was trained in the art of media relations, including "how stay on message."
