Panera Bread has settled with the family of an Ivy League student with a heart condition who died after drinking the chain’s highly caffeinated Charged Lemonade drink. The suit said that Katz bought a Charged Lemonade from a Panera restaurant in September 2022. A second lawsuit blamed it for a Florida man’s death while the other two alleged that the Charged Lemonade caused permanent heart injuries in previously healthy people. The complaint said the Charged Lemonade also had guarana extract, another stimulant, as well as the equivalent of nearly 30 teaspoons of sugar in the large size. It also added prominent signs cautioning that Charged Lemonade contained caffeine, should be consumed in moderation and was not recommended for children, people sensitive to caffeine, pregnant or nursing women.

New York CNN —Dunkin’ is adding an energy drink to its menu to capture some of the buzz generated by heavily caffeinated beverages, which are surging in popularity. But the menu addition comes with a risk: Panera Bread is facing multiple lawsuits over its its own energy drink. The Dunkin’ energy drink has less caffeine for a similarly sized cup with 192 mg for both flavors, according to its website. Despite the controversy, energy drinks are big sellers for chains. At Dutch Bros, a fast-growing chain, its lineup of energy drinks accounts for a quarter of its sales.

A loyal Panera customer, he started regularly ordering “charged lemonade” in late September, according to the suit. The complaint resembles another wrongful death suit filed earlier this year by the parents of Sarah Katz, a 21-year-old woman who died in September 2022 after drinking Panera’s charged lemonade. “Panera Charged Lemonade is a juice beverage marketed to children and adults alike,” the suit claims. Katz, who died last year, may have believed the caffeinated drink was regular lemonade, her parents alleged in the suit they filed against Panera. However, Katz was “reasonably confident it was a traditional lemonade and/or electrolyte sports drink containing a reasonable amount of caffeine safe for her to drink,” the lawsuit says, adding that Panera misled consumers by not properly labeling “Charged Lemonade” as an energy drink in stores. “Instead, Defendants market, advertise, and sell Panera Charged Lemonade as a product that is ‘Plant-based and Clean with as much caffeine as our Dark Roast Coffee,’” the lawsuit reads. However, in their stores, Panera does “not specify what size of Panera Dark Roast coffee is akin to a Panera Charged Lemonade,” making the comparison vague and “unhelpful.”Online, Panera says its “Charged Lemonade” has a comparable amount of caffeine to its Dark Roast coffee. “It’s a dangerous energy drink and it’s not advertised that way.
