E. Jean Carroll is seen outside State Supreme Court on March 4, 2020, in New York. But the unsealed pages of Trump's deposition were not immediately available in U.S. District Court in Manhattan. And Trump's attorneys later Monday filed a letter with Judge Lewis Kaplan asking for three days to oppose the unsealing of the section of the deposition. Former President Donald Trump has filed a motion to dismiss a second lawsuit from E. Jean Carroll. Trump's attorney argued he never defamed Carroll because he didn't disparage her professionally. Carroll previously sued Trump in 2019, alleging that the then-president defamed her by claiming she invented the rape allegations. Trump's court filing on Wednesday argued that Trump's October 12 statement didn't qualify as defamation because it doesn't disparage Carroll's "trade, business or profession." In response to Insider's request for comment, Carroll's attorney, Roberta Kaplan, said Carroll's team looks forward to going to trial in April 2023.

The DC Court of Appeals is deciding whether Trump can be sued for comments about E. Jean Carroll. But Carroll's lawyers argue in their brief, filed Thursday, that previous court rulings show the law is more nuanced. He concocted dark schemes and nefarious motives," Carroll's lawyers wrote in the brief. That is not the law — and this court should not make it so," Carroll's lawyers wrote. Carroll's lawyers want the two cases tried at the same time.
Kaplan did not rule on Carroll's request to hold one trial combining the lawsuit, which the former longtime Elle magazine columnist filed in November 2019, with a second lawsuit she filed last week accusing Trump of battery. Trump, 76, opposed combining the lawsuits, with his lawyers saying they did not know who would represent him in the second lawsuit. Carroll's lawyer Roberta Kaplan said she was pleased with the new trial date, and understood the decision to defer rulings in the second case. Carroll made the rape accusation in her memoir, and sued Trump after he claimed in June 2019 not to know her and said she was "not my type." Her first lawsuit has been delayed as appeals courts consider whether Trump was acting as president when he scoffed at the rape claim.
NEW YORK — A writer who accused former President Donald Trump of rape filed an upgraded lawsuit against him Thursday in New York, minutes after a new state law took effect allowing victims of sexual violence to sue over attacks that occurred decades ago. Previously, Carroll had been barred by state law from suing over the alleged rape because too many years had passed since the incident. Judge Lewis A. Kaplan, who presides over the defamation lawsuit Carroll filed three years ago, may decide to include the new claims in a trial likely to occur in the spring. Trump and Carroll also have already been deposed. Attorney Michael Madaio, a lawyer for Trump, said at the hearing that the new allegations are significantly different than the original defamation lawsuit and would require “an entirely new set” of evidence gathering.

He repeated the denial in an Oct. 12 post on his Truth Social account, calling Carroll's claim a "hoax" and "lie," prompting the new defamation claim. That would likely not affect her second lawsuit because Trump is a private citizen, having left the White House in January 2021. To support her battery claim, she said Trump caused her lasting psychological harm, and left her unable to sustain a romantic relationship. She also told the judge a longer delay made sense because Trump had not hired a lawyer for the second lawsuit. Judge Kaplan said he may decide early next week how to schedule both lawsuits.

WILMINGTON, Del, Nov 23 (Reuters) - Adult sexual abuse victims in New York will get an opportunity to sue over decades-old allegations beginning Thursday when a law revives a range of cases including ones against hospitals, Wall Street banks and former U.S. President Donald Trump. New York's Adult Survivors Act creates a one-year period when victims can file lawsuits that otherwise would have been barred because the case was too old. It was modeled on the state's Child Victims Act that revived old claims over child sex abuse and led to thousands of lawsuits against schools, churches and youth organizations. The number of adult cases is likely to be lower than cases involving children, said Jeff Herman, an attorney who represents victims of sexual abuse. One challenge for adult abuse cases is determining consent, said Herman.

To combat high inflation, the Federal Reserve has raised interest rates this year at the fastest clip in 40 years. But analysts warn that high interest rates and potentially unfavorable terms can trip up shoppers, eroding the hoped-for savings. That’s the highest interest rate since the credit card marketplace began tracking it for store cards in 2018. Using credit cards can help build credit. And with fees and rates for new store cards even higher than the current record levels for traditional credit cards, “many people’s financial margin for error is basically zero,” Schulz says.
A draft of the lawsuit was included in a Thursday filing by her lawyer Roberta Kaplan in Manhattan federal court, where Carroll is also suing Trump for defamation over an earlier statement about the incident. The proposed lawsuit seeks unspecified compensatory and punitive damages, and a retraction of Trump's statement. Carroll's earlier lawsuit stemmed from Trump's June 2019 statement denying that he raped her, and saying she concocted their alleged encounter to sell her forthcoming book. Trump's lawyers have proposed a May 8 trial that does not address the second lawsuit, court papers show. The case is Carroll v. Trump, U.S. District Court, Southern District of New York, No.
George Conway thinks Trump will run in 2024 as protection against his legal cases. "He will run for president, in effect, for protection against these legal proceedings, but there's just gonna be too many of them," Conway said. After the FBI raid of Mar-a-Lago, he said that he thought Trump was "in very substantial legal jeopardy." Conway is married to Kellyanne Conway , Trump's former senior counselor.
Trump was deposed at Mar-a-Lago on Wednesday in writer E. Jean Carroll's 2019 rape defamation suit. In his first response, Trump 'truthed' two clips from the conservative video platform Rumble. Without commenting, Trump 'truthed' out a pair of Rumble clips that combined snippets of old interview footage of Carroll. The misleadingly edited, minute-long clips use Carroll's out-of-context remarks to imply she fantasizes about rape and did not take her own accusations against Trump seriously.
