Wednesday’s pretrial hearing, which has been scheduled for months, followed a whiplash decision by Austin to revoke a plea deal that had been announced just two days prior last week. “What he did was illegal,” Eugene Fidell, who teaches military justice at Yale University and co-founded the National Institute of Military Justice, told CNN. But Sowards argued Wednesday that by revoking the deal, Austin was actually doing more harm to the families. While the terms of the pretrial agreement had not been released publicly, among them was the assurance that the detainees would answer questions by 9/11 victim family members. Sowards said family members had already “been submitting questions in good faith,” and expecting answers in return as part of the deal.

CNN —Members of the grand jury in Arizona that indicted 18 allies of Donald Trump earlier this year for their alleged roles in attempting to overturn the 2020 election had also expressed interest in charging the former president, according to a new court filing. The interest was strong enough that it prompted the state’s lead prosecutor to request that the grand jury not indict the former president and give a PowerPoint presentation to explain his reasoning. Prosecutors cited two primary reasons for why the grand jury should not charge Trump: a lack of evidence and a US Justice Department policy they believe would hamper charges against a former president. The policy cited by prosecutors deals with DOJ guidelines limiting how the federal government can prosecute individuals already charged with similar crimes at the state level. That’s why you do not see that,” the state prosecutor told the grand jury.

An Arizona grand jury that indicted 18 allies of former President Donald Trump on criminal charges related to trying to overturn his 2020 election loss in the state was interested in indicting Trump as well, but was asked not to do so by the state attorney general's office, according to a new court filing. Attorney General Kristin Mayes' office disclosed the grand jury's interest in charging Trump in a filing that disputed a claim by many of the defendants that the office was politically biased in prosecuting them in the so-called fake electors case. "The State Grand Jury was told by the Attorney General's Office on multiple occasions that it had the discretion to indict no one," the office wrote. Arizona Attorney General Kris Mayes’ office announced Monday that Jenna Ellis, a former Donald Trump attorney and one of the 18 defendants in the Arizona “fake electors” case stemming from the 2020 election, is cooperating with the prosecution. Ellis signed the cooperation agreement Monday morning, according to the announcement, which said prosecutors are dropping the charges against her. “This agreement represents a significant step forward in our case,” Mayes, a Democrat, said in a statement. In 2023, Ellis pleaded guilty in the Georgia election interference case in which Trump was also charged. Those accused of being “fake electors” and the others alleged to have been accomplices are charged with fraud, forgery, and conspiracy.

“The Devil,” a U.S. fugitive who was featured on “America’s Most Wanted,” has been captured in Mexico, the United States Marshals Service said. Antonio Riano, 62, was arrested Thursday in his hometown of Zapotitlan Palmas, State of Oaxaca, Mexico, officials said, where he was found to be working an ironic job. “When Riano was arrested in Mexico he was found to be working as a local police officer,” the agency said in a press release on Thursday. Afterwards, he fled the United States allegedly to avoid prosecution. After being captured, Riano was flown from Mexico City to Cincinnati, then transported to the Butler County Jail.

Over the decades he spent in prison, sentenced to life for a fatal shooting in 1990, Christopher Dunn faced one obstacle after another as he sought to clear his name. A Missouri judge had exonerated Mr. Dunn and ordered his release from prison. Dressed in a jacket and tie, Mr. Dunn was signing the last bit of paperwork when he overheard the warden taking a call, saying, “We were just about to release him — what do you want me to do?”The state attorney general, Andrew Bailey, had intervened to keep Mr. Dunn, 52, behind bars. He was ordered to change back into his prison uniform and returned to his cell, leaving the St. Louis prosecutor, who had asked the court to clear Mr. Dunn, scrambling to free him. Mr. Bailey, who took office 17 months ago to fill out his predecessor’s term, is trying to fend off a formidable challenger as he seeks a full four-year term as the state’s top law enforcement officer.

CLARKSBURG, W.Va. — An inmate was sentenced to more than four years Thursday for his role in the 2018 fatal bludgeoning of notorious Boston gangster James “Whitey” Bulger in a troubled West Virginia federal prison. Massachusetts gangster Paul J. DeCologero was sentenced in federal court after pleading guilty to an assault charge. Defense attorney Patrick Nash began by conveying an apology from DeCologero to Bulger’s family as well as the inmate’s own relatives. In Bulger’s killing, “Paul was involved,” Nash said. After Bulger was killed, prison officials were criticized for placing him in the general population instead of more protective housing.
