WASHINGTON (AP) — The House plans to return for a second round of balloting for House speaker on Wednesday morning as Jim Jordan fights to win over his many holdouts for the job to replace the ousted Kevin McCarthy. The House had never ousted its speaker before Kevin McCarthy, and the lawmakers are in rarely tested terrain. Two former Republican House speakers, Newt Gingrich and John Boehner, have come out in support of the idea. Gingrich said that while he likes Jordan, he has “no faith” the nominee can get much beyond the 200 votes he won in the first vote. Both were chased to early retirement by threats of ouster from right-flank insurgents like those who toppled McCarthy.

Hardline Republicans axed Rep. Kevin McCarthy, the man who spent years orchestrating his rise to become House speaker, after he relied on Democrats to help pass a short-term funding bill to keep the government open last month. When McCarthy got the boot, McHenry was elevated to become the powerless temporary speaker – known as speaker pro tempore – able to keep the House in session but not to pass any legislation. The mechanism for such an arrangement could be a simple resolution giving McHenry the temporary power to move appropriations legislation. I asked her by email about why having a temporary speaker would be appealing, and she suggested it’s not a good option, but maybe the least bad option in the face of an institutional leadership crisis. In fact, Postell predicted an even more partisan atmosphere if the House speaker was to permanently become a less powerful position.

Several months before his guilty plea, Kelley posted on social media that the Capitol riot was an FBI “set up." Kelley spoke at a “Stop the Steal” rally at the state Capitol in Lansing in November 2020, shortly after the presidential election. Kelley remained on Capitol grounds for nearly two hours but isn't accused of entering the building that day. Also on Tuesday, a woman who smashed a window at the Capitol and used a bullhorn to direct other rioters on Jan. 6 was sentenced to four years and nine months in prison. A prosecutor has said Powell, 41, of Sandy Lake, Pennsylvania, played a “leading role” during the riot.

Judges can threaten gag order violators with fines or jail time, but jailing a presidential candidate could prompt serious political blowback and pose logistical hurdles. A gag order may also slow down the case because it's likely Trump either violates it and the judge will want to punish him or Trump will challenge the order in advance, he said. In one case, a federal appeals court in 1987 lifted a gag order on U.S. Rep. Harold Ford Sr., a Tennessee Democrat charged in a fraud case. Ford’s gag order prohibited him from even sharing his opinion of or discussing facts of the case. He said he was dubious that Trump’s attacks, “while in very poor taste,” posed the kind of danger to merit a gag order.

It became clear on Thursday that Scalise would not win the support of 217 of the 221 House Republicans, and it was not clear if Jordan would do better. Former President Donald Trump, the frontrunner for the 2024 Republican presidential nomination, backed Jordan just days after McCarthy's ouster. Jordan was one of Trump's most vocal defenders when he was impeached twice during his 2017-21 term. While McCarthy was the first House speaker formally voted out of leadership by his colleagues, his two Republican predecessors Boehner and Paul Ryan also resigned under pressure from their right flanks. "I look at it like a wrestling match," Jordan told the New York Times in an April interview, explaining how he prepares for hearings.
