The Justice Department has asked for a mid-December trial date. “This extraordinary case presents a serious challenge to both the fact and perception of our American democracy,” Trump’s defense team wrote in the filing. “The Court now presides over a prosecution advanced by the administration of a sitting President against his chief political rival, himself a leading candidate for the Presidency of the United States.”Trump’s defense team said the court should “withdraw the current order setting trial” and “postpone” consideration of a new trial date. In a separate filing earlier Monday, Trump’s defense team and the special counsel’s office said July 18 would be an agreeable date for the first appearance before Judge Aileen Cannon on classified information procedures. While Trump entered his not guilty plea in the case on June 13, his aide and co-defendant Walt Nauta was only able to enter his not guilty plea last week due in part to delays in retaining a Florida counsel.

CNN —Revelations that special counsel Jack Smith has been digging into efforts to overturn former President Donald Trump’s Arizona election loss in 2020 bolster growing indications that his investigation is nearing a critical point. Smith has already made Trump the first former president to be formally accused of federal crimes. But a flurry of details about Smith’s inquiries into alleged election-stealing efforts suggest his investigators have had an industrious summer. Multiple sources told CNN that investigators have asked several witnesses before the grand jury and during interviews about the meeting, which happened about six weeks after Donald Trump lost the 2020 election. Some witnesses were asked about the meeting months ago, while several others have faced questions about it more recently, including Rudy Giuliani. Prosecutors have specifically inquired about three outside Trump advisers who participated in the meeting: former Trump lawyer Sidney Powell, one-time national security adviser Michael Flynn and former Overstock CEO Patrick Byrne, sources said. They also discussed naming Powell as special counsel to investigate supposed voter fraud, and Trump invoking martial law as part of his efforts to overturn the election. But the aide didn’t have a lawyer in Florida who could assist with his representation, delaying his initial plea. But the unprecedented nature of Trump and Nauta’s case, as Trump runs again for the White House, makes timing even more crucial with primary voting for the 2024 GOP nomination beginning early next year. That includes continued grand jury activity in Florida and inquiries of witnesses, though it is not yet clear what aspects of the investigation the prosecutors are still pushing toward. Trump has pleaded not guilty, and Nauta is expected to enter a plea of not guilty next week. The two men are expected to head to trial as early as this year. Prosecutors in the filing used the plural “interviews” to describe recordings of Trump – made with his consent – obtained by the special counsel that have now been turned over to his defense team. The prosecutors’ update to the court on Wednesday night marks another swift move toward trial, which the Justice Department has said should happen quickly, and captures at least some of the extent of the evidence investigators secured to build their historic case against Trump. Let’s assume, because it seems like a reasonable assumption, that we have not reached the end of the indictments that will be handed down against Donald Trump. Let’s assume that either the case in Georgia, where he is being investigated for election tampering, or the special counsel’s continuing investigation in Washington, will yield a prosecution related to his conduct between the November 2020 election and the riot on Jan. 6. In that case, Trump’s various indictments would double as a road map to his presidency and his era — each fitting with a different interpretation of the Trump phenomenon, and only together giving the fullest picture of his times. It’s hard to imagine a better illustration of the anti-anti-Trumpist case than an ideological prosecutor in a Democratic city indicting a former president on a charge considered dubious even by many liberal legal experts. “Norms,” indeed: The Stormy Daniels case looks like Resistance theater, partisan lawfare, exactly the kind of overreach that Trump’s defenders insist defines the entirety of anti-Trumpism.

Miami CNN —Former President Donald Trump pleaded not guilty to 37 charges Tuesday in a brief but historic court appearance following his arrest and processing on federal charges. Trump is the first former president to face federal charges following last week’s indictment by special counsel Jack Smith. It underscored the fact that Trump’s legal turmoil is playing out amid a 2024 Republican primary where Trump’s legal troubles have been a central storyline, both for his campaign and his presidential rivals. Nauta’s indictment is the second in the special counsel’s investigation after Trump was indicted on seven counts on Thursday. Nauta’s involvement in the movement of boxes of classified material at Trump’s Florida resort had been a subject of scrutiny of investigators. Investigators obtained surveillance footage showing Nauta and the worker moving boxes of the classified documents around the resort, CNN previously reported. Nauta had spoken to investigators repeatedly in the probe, at first telling them he hadn’t handled boxes or sensitive documents at Mar-a-Lago.
