In the last decade, it has proved surprisingly hard to put politicians accused of corruption behind bars. And juries have occasionally thought the officeholders’ behavior didn’t meet the high standard for corruption. Senator Bob Menendez of New Jersey, who was arraigned yesterday in a federal bribery case, is both an example of the conundrum and a test of whether federal prosecutors now know how to overcome it. In the senator’s last corruption trial, in 2017, jurors couldn’t make sense of the gifts and favors he’d received from a wealthy eye doctor. In exchange, prosecutors say, he attempted to disrupt criminal cases and used his position on the Senate Foreign Relations Committee inappropriately.

For the third time in six months, Senator Robert Menendez stood before a judge in Manhattan on Monday to be arraigned on new criminal charges filed as part of an expansive federal bribery investigation. Mr. Menendez, a Democrat from New Jersey, has previously pleaded not guilty to accepting bribes and acting as an unregistered agent of a foreign government. On Monday, he pleaded not guilty to obstruction of justice, a charge added last week in an updated indictment against the senator; his wife, Nadine Menendez; and two New Jersey businessmen, Wael Hana and Fred Daibes. The new charges come less than two months before the scheduled start of the trial, May 6. The obstruction of justice charge appears to be related to information provided by Jose Uribe, a former insurance broker charged in September in the bribery conspiracy.

Sen. Bob Menendez, D-N.J., is seen after the senate luncheons in the U.S. Capitol on Tuesday, January 23, 2024. New obstruction of justice crimes were added Tuesday to charges against Sen. Bob Menendez and his wife that allege they accepted gold bars, cash and a luxury car in return for favors the senator carried out to assist three businessmen. New charges of conspiracy to obstruct justice and obstruction of justice were added against Menendez and his wife, Nadine. Attorneys for Bob and Nadine Menendez and the other defendants in the case didn't immediately respond to emails requesting comment. Prosecutors allege that Menendez also caused his lawyer to say in the September meeting that Menendez in 2022 had learned that the payments were loans.

The new charges against the Menendezes appear related to information that was provided to the government by Mr. Uribe, who in court on Friday described meeting with Ms. Menendez at a Marriott Hotel after receiving a subpoena in the case. Mr. Uribe said in court that Ms. Menendez had wanted to get their stories straight about a Mercedes-Benz convertible he had given her as a bribe. “She asked what was I going to say if somebody asked me about the car payments,” Mr. Uribe said. In the new charges, prosecutors say that Mr. and Ms. Menendez paid Mr. Uribe back for the payments he had made on the Mercedes and falsely referred to that money as a “loan” in conversations with their lawyers, deliberately mischaracterizing the transaction. As a result, the indictment charges, Mr. Menendez in June “caused his then counsel to make false and misleading statements to the United States attorney’s office for the Southern District of New York.” Two months later, Ms. Menendez did the same.

New York CNN —Fisker, the electric vehicle company founded by auto designer Henrik Fisker, announced in its fourth quarter earnings Thursday that it might not have enough money to survive another year. The company is in discussions with an existing investor about possibly putting more money into the company, the EV maker said in its announcement. Last year, Magna produced more than 10,193 Fisker SUVs, but fewer than half of those were delivered to customers within the calendar year, the company announced. Fisker is founder Henrik Fisker’s second car company. His first, Fisker Automotive, produced a plug-in hybrid luxury car called the Fisker Karma.

Jose Uribe, a former New Jersey insurance broker charged in what prosecutors have described as a broad bribery scheme involving Senator Robert Menendez, pleaded guilty on Friday in Manhattan. Mr. Uribe had been accused of providing Nadine Menendez, the senator’s wife, with a Mercedes-Benz in exchange for Mr. Menendez’s efforts to intercede in an insurance fraud investigation in New Jersey. As part of his guilty plea, Mr. Uribe also agreed to cooperate fully with prosecutors in their investigation, according to a formal plea agreement signed by Mr. Uribe, his lawyer and prosecutors in the U.S. attorney’s office for the Southern District of New York. Mr. Uribe is expected to “truthfully and completely disclose all information with respect to the activities of himself and others concerning all matters about which this office inquires of him,” the agreement states.

In 2021, the German carmaker announced plans only to sell electric vehicles — "where market conditions allow" — by 2030. And, as of Thursday's release, it expects its overall EV sales to reach just 50% by the time 2030 rolls around. During a September interview at the Munich car show, Mercedes CEO Ola Källenius first hinted at a more narrow outlook for the EV market. Mercedes-Benz shares gained around 5% on Thursday morning after the German carmaker beat fourth-quarter earnings expectations and announced a new share buyback program, despite warning of "exceptional" risks in the year ahead. Fourth-quarter earnings before interest and taxation (EBIT) came in at 4.33 billion euros ($4.7 billion), slightly ahead of consensus expectations, taking the full-year figure to 19.66 billion euros. Revenues rose 2% in 2023 to 153.2 billion euros from 150 billion the previous year. The group also announced an additional share buyback program worth up to 3 billion euros, with the repurchased shares subsequently canceled. Automotive analysts at Jefferies said in a reactive note Thursday that although there were no major surprises in the earnings, the cash return policy was "a sign of confidence and consistent with the premium/luxury positioning, with buyback set to keep EPS (earnings per share) growing."
