District Attorney Fani Willis said the lead lawyer she had hired had worked as a judge, private-practice attorney, prosecutor and criminal-defense lawyer. Photo: Brynn Anderson/Associated PressFulton County, Ga., District Attorney Fani Willis defended her decision to hire Nathan Wade as a special prosecutor, saying in a speech Sunday morning that the lead lawyer in her office’s racketeering case against former President Donald Trump and others is well qualified to serve in the role. One of the defendants in the case alleged in a court filing last week that Wade and Willis had been in a continuing romantic relationship since before Willis hired Wade, and that both had benefited financially from the arrangement. The filing also alleged that Wade didn’t have the proper experience for the job.

Fulton County DA Fani Willis was accused of having an "improper" relationship with a prosecutor. Willis appointed the prosecutor, Nathan Wade, to oversee the RICO case against Trump. The motion seeks to dismiss the indictment and disqualify Willis and Wade and their offices from further prosecuting the case. Willis said she hired three special prosecutors for the election case: a white man, a white woman, and a Black man. If Willis financially benefited from her relationship with Wade, that may be an ethics violation," he said.

ATLANTA (AP) — Fulton County District Attorney Fani Willis on Sunday defended the qualifications of a special prosecutor she hired for her case against Donald Trump and others over efforts to overturn the 2020 election in Georgia after a defense lawyer accused Willis of professional impropriety. At the church, Willis did not address the allegations of an improper relationship. They are paid the same hourly rate and no one has questioned the qualifications of the two white lawyers, she said. Merchant's filing offered no proof of the alleged relationship or trips that she said that Willis and Wade had taken together. Pete Skandalakis, a former district attorney who is executive director of the Prosecuting Attorneys’ Council, said district attorneys do not have to seek permission before hiring a special prosecutor.

To try to understand his enduring appeal, Reuters spoke to five Trump supporters in five general election battleground states: Nevada, Georgia, Arizona, Pennsylvania, and Michigan. Trump currently leads Democratic President Joe Biden in several swing state general election polls, suggesting he will be highly competitive in a likely re-match next November. None are full-blown "election deniers" backing Trump's false claims that he, and not Biden, won the 2020 election. The second issue that swung Ruiz back behind Trump was the multiple criminal charges against him. Johnson likes Trump's tough stance on migration, and believes Trump will slow the crossings and deport as many migrants as feasibly possible.

Atlanta police Officer Kiran Kimbrough responded to the crash and he quickly decided Hollman was to blame. About 10 seconds later, a man identified in the lawsuit as the tow truck driver is seen coming to the officer's aid. The lawsuit says the tow truck driver “immediately joined the officer” on top of Hollman’s body and “forcefully grabbed” Hollman's left arm without the officer appearing to ask for help. The lawsuit accuses the tow truck driver of being negligent or reckless, and of causing or contributing to the physical injuries that Hollman suffered before dying. Hollman’s family has called for Kimbrough and the tow truck driver to be arrested and charged in Hollman’s death.

John David Mercer/Pool via REUTERS Acquire Licensing RightsWASHINGTON, Dec 1 (Reuters) - A lawyer for Donald Trump said on Friday that the former U.S. president should not face trial on charges that he sought to overturn the 2020 election results in the state of Georgia if he wins the election next year. Trump is the frontrunner for the Republican nomination to challenge Democratic President Joe Biden in the 2024 election. Sadow said that if Trump wins the election, he would seek to postpone the trial until after he left office, arguing that it would interfere with his responsibilities as president. Fulton County District Attorney Fani Willis last week requested the Georgia trial begin in August 2024, a timeline that would likely extend the proceedings through Election Day and into early 2025. “What would be the state's response that having this trial on Election Day is election interference?” Judge Scott McAfee asked prosecutors.

Atlanta CNN —Former President Donald Trump’s attorneys in the Georgia election subversion case are set to defend their client in a Fulton County courtroom for the first time on Friday as they try to have the charges thrown out on First Amendment grounds. This is the first time Trump’s attorneys will appear in court in the Fulton County case, though their client won’t be with them. Trump hasn’t yet been in the Atlanta courthouse – he previously waived his right to an arraignment hearing – though he was processed at the Fulton County jail in late August. She used a similar legal strategy in a 2014 RICO case in Fulton County, according to a source familiar with the matter. CNN —The prosecution began opening statements Monday morning in the racketeering trial of Grammy-winning rapper Young Thug, who is accused of leading a violent street gang in the Atlanta area affiliated with the national Bloods gang. Young Thug, whose real name is Jeffery Williams, was charged alongside more than two dozen other people under the state’s expansive Racketeer Influenced and Corrupt Organizations Act – known as RICO. Young Thug is among six defendants who have pleaded not guilty to all charges and are standing trial in an Atlanta courtroom, the judge said Monday. Prosecutors say Young Thug is the cofounder of a criminal street gang – Young Slime Life – that’s responsible for violent acts dating back a decade. The trial is expected to last months and could feature a star-studded list of witnesses, including rappers Lil Wayne and Killer Mike.

ATLANTA (AP) — Georgia's state Supreme Court on Wednesday refused to approve rules for a new commission to discipline and remove state prosecutors, meaning the commission can't begin operating. In an unsigned order, justices said they have “grave doubts” about their ability to regulate the duties of district attorneys beyond the practice of law. Beyond the hurdle of state Supreme Court approval of rules, four district attorneys are suing to overturn the commission, arguing that it unconstitutionally infringes on their power. The Georgia law states a prosecutor can't refuse to prosecute whole categories of crimes, but must instead decide charges case by case. It applies both to district attorneys and elected solicitors general, who prosecute lower-level crimes in some Georgia counties.

CNN —The judge overseeing the Fulton County election racketeering case declined Tuesday to send one of Donald Trump’s co-defendants to jail over recent social media posts and other comments he made targeting witnesses. He does not get an ‘oh, I’m sorry,’ after I’ve already intimidated the witnesses in this case,” Willis said. The felonies Floyd faces in the case are largely tied to his role in an intimidation campaign targeting two Atlanta election workers in late 2020. The leader of Black Voices for Trump, Floyd was separately charged in May with simple assault of a federal officer who was delivering a subpoena to him to testify before a grand jury in Washington, DC. He said that Floyd’s posts about Freeman have led to a “spike” in online activity targeting Freeman.

Trump said he opposed that date in a filing posted shortly after prosecutors made their request. "This proposed trial date balances potential delays from Defendant Trump's other criminal trials in sister sovereigns and the other defendants' constitutional speedy trial rights," Willis said. Willis said in Friday's filing that prosecutors would be able to try Trump and all remaining defendants in the case together in one trial. The Georgia trial will have to compete with three other criminal cases against Trump, which are all scheduled to go to trial next year. The New York hush-money trial is scheduled for March, though that date could change as well.

A prosecutor asked a judge to Friday to schedule the Georgia election interference criminal trial of former President Donald Trump and his co-defendants to begin on Aug. 5 — exactly three months before the 2024 presidential Election Day. "The State clearly retains the logistical and prosecutorial capabilities to try all of the remaining Defendants together," Willis said in her motion. Trump's campaign spokesman said, "Radical Democrat Fani Willis has again proven that her case is purely political, designed to interfere with President Trump's re-election by demanding a trial date in the most vital time in President Trump's winning campaign." "Crooked Joe Biden knows he can't beat President Trump and this corrupt step by Fani Willis is just further proof of that fact," the spokesman said. The Manhattan Supreme Court judge in that case has said he will willing to re-schedule it to avoid a conflict with Trump's trial earlier that same month in Washington.

ATLANTA (AP) — The Georgia prosecutor pursuing a case against former President Donald Trump and others on Wednesday asked a judge to revoke the bond of defendant Harrison Floyd, saying he has been intimidating witnesses and codefendants in the case. Floyd, Trump and 17 others were indicted in August by a Fulton County grand jury, accused of participating in a wide-ranging scheme to illegally try to overturn the 2020 election in Georgia. The charges against Floyd stem from allegations of harassment of Ruby Freeman, a Fulton County election worker who had been falsely accused of election fraud by Trump and his supporters. Chris Kachouroff, an attorney for Floyd, said District Attorney Fani Willis' attempt to revoke his client's bond was nonsense, adding, “She's not going to get it granted." In addition to the charges in Georgia, Floyd also faces federal charges that accuse him of aggressively confronting two FBI agents sent to serve him with a grand jury subpoena.

On the issue of intent, in last week’s testimony, Donald Trump Jr. and Eric Trump both attempted to shift the blame onto their accountants. First, the judge has already rejected a key route Trump tried to avoid an admission that he intended to defraud the victims. He fined Trump’s lawyers for doing just that. Again, the attorney general wins whether Trump denies it, or whether he doubles down on what the judge has called Trump’s “fantasy world” financial claims. Will Trump’s Barbs Land Him Behind Bars?

It was a historic and jarring event when FBI agents searched former President Donald Trump's home last year to look for classified documents he was accused of hoarding. "Courts and prosecutors have to become normalized to the idea of detaining Trump – if he continues to violate gag orders and/or if he is convicted at trial," Signorelli says. Less-powerful defendants have been punished with time behind bars for being in contempt of court (including violating gag orders) or threatening authorities. Sam Bankman-Fried, the former billionaire crypto trader, was put behind bars in August weeks before his fraud trial after giving a media outlet private writings by a witness. While courts are sensitive to First Amendment protections – especially for someone running for president – Trump is pushing the legal envelope, Eisen says.

A lead prosecutor and a judge involved in separate criminal cases against Donald Trump received violent threats within two days of the former president warning that he was "coming after" his foes, court documents allege. Prosecutors allege Arthur Hanson, 59, of Huntsville, Alabama, delivered the threats in voicemails left for Willis and Labat on Aug. 6. Smith cited the same post in a September court filing seeking a gag order against Trump. Later in August, Trump was booked and had his mugshot taken at Fulton County jail, which was run by Labat.
