By Jonathan Stempel(Reuters) - A Virginia doctor who prescribed more than 500,000 opioid doses in less than two years had his conviction and 40-year prison sentence thrown out by a federal appeals court on Friday, because the jury instructions misstated the law. Circuit Court of Appeals in Richmond, Virginia also ordered a new trial for Joel Smithers, 41, who has been serving his sentence in an Atlanta prison. Overprescription of painkillers is one of the main causes of the nation's opioid crisis. Prosecutors said Smithers prescribed controlled substances including fentanyl, hydromorphone, oxycodone and oxymorphone to every patient he saw at the Martinsville, Virginia office he opened in August 2015. MEXICO CITY (AP) — Mexico's economy barely eked out a 0.1% increase in the fourth quarter, bringing estimated growth for 2023 to 3.1%, according to preliminary figures published Tuesday by Mexico’s National Statistics Institute. The institute said that services advanced 0.1% in the fourth quarter, agricultural output declined by the same amount and manufacturing remained unchanged. Inflation declined to 4.66% by the end of 2023, but domestic interest rates remained high at 11.5%. High rates at home and abroad increased the cost of servicing Mexico’s debt, the Treasury Department acknowledged. Mexico’s peso remained strong Tuesday at about 17.20 to $1 and the Mexican stock exchange’s main index was trading slightly higher.

CNN —A former conservative federal appellate judge is urging the Supreme Court to keep Donald Trump off the ballot, arguing the ex-president’s effort to cling to power after his 2020 election loss was “broader” than South Carolina’s secession from the US that triggered the Civil War. Trump tried to prevent the newly-elected President Biden from governing anywhere in the United States. “Trump incited, and therefore engaged in, an armed insurrection against the Constitution’s express and foundational mandates that require the peaceful transfer of executive power to a newly-elected President,” the brief said. The US Supreme Court agreed earlier this month to review the unprecedented decision from the Colorado Supreme Court that removed him from that state’s ballot. In a 4-3 ruling issued last month, the state court said Trump is constitutionally ineligible to run in 2024 because the 14th Amendment’s ban on insurrectionists holding office covers his conduct on January 6, 2021.

SANTA CLARA, Calif. (AP) — The aggressiveness that characterized the turnaround for the Detroit Lions under coach Dan Campbell backfired at the worst possible time. Detroit failed on two fourth-down tries in field-goal range in the second half, contributing to a blown 17-point halftime lead and a 34-31 loss to the San Francisco 49ers in the NFC championship game Sunday. The result was just the fourth conference game loss for a team that held a lead of at least 17 points. A magical season for the Lions ended one game short of the franchise’s first Super Bowl appearance. Detroit remains the only team to play every season of the Super Bowl era without reaching the ultimate game.
