The Supreme Court on Tuesday declined to hear arguments in a case challenging the Food and Drug Administration's authority to reject approvals of flavored electronic cigarettes. The FDA issues marketing denial orders to reject product applications. A spokesperson for the FDA did not immediately respond to a request for comment on the Supreme Court's decision. In 2016, the FDA determined that e-cigarettes were subject to its regulation, like traditional tobacco products. The agency gave companies until September 2020 to submit applications for approval of each of their vape products, even if they were already on the market.

So too has frustration with infighting in Scholz's heterogeneous three-way coalition of Social Democrats (SPD), the Greens and pro-business Free Democrats (FDP) mid-way through its term. "The coalition is suffering the mid-term blues and must reckon with losses," said Stefan Marschall, political scientist at the University of Duesseldorf. "The FDP in particular must reckon with falling out of both state parliaments which could bring greater tensions into the coalition. More striking is the fact the populist Free Voters (FW) party, which governs Bavaria in coalition with the CSU, has seen a bump in poll support of several percentage points to 15% since being swept up in an anti-semitic scandal.

Constellation Brands on Thursday reported earnings and revenue that topped analysts' expectations for its fiscal second quarter of 2024. The Mexican beer powerhouse, owner of the Modelo Especial and Corona Extra brands, reported double-digit sales growth in its beer business as the division continues to dominate the overall beer and high-end categories. Cannabis producer Tilray Brands on Wednesday reported a jump in revenue as it diversifies its portfolio and moves deeper into the beer industry. The company reported $177 million in net revenue, up 15% year-over-year, for its fiscal first-quarter. Its cannabis division brought in $70 million in net revenue, reflecting a 20% spike year-over-year. It also narrowed its net loss to $55.9 million during the quarter, compared with a loss of $65.8 million a year earlier. The company said it grew cannabis revenue in Canada by 16.5%, and strengthened its leading market share position in the country to 13.4%.

BEIJING, Sept 30 (Reuters) - The Asian Development Bank (ADB) said on Saturday it had approved a $300 million loan to an industrial city in a major Chinese coal-producing province to help "catalyse green" transformation of the city of 3 million people. The loan for Changzhi in the northern province of Shanxi will help fund a $665 million project, partly financed by the Chinese government, to reduce poverty, cut carbon emissions and improve urban liveability in a city that has long depended on coal, the ADB said. "Knowledge gained from the project will serve as a model for replication in other heavy-industry regions," ADB Principal Urban Development Specialist Stefan Rau said in a statement. As part of the project, Changzhi will build treated wastewater reuse facilities, put electric buses on roads and create bicycle-paths made from construction waste. A new bill that aims to give the marijuana industry access to banking services is expected to move forward in the Senate on Wednesday. The bill would provide legal protection to banks or other financial institutions that offer services to state-legal marijuana businesses. The Senate Banking Committee will mark up the bill Wednesday, and the panel is expected to vote to advance it to the full chamber's floor. Even as 39 states have legalized marijuana for recreational or medical use, the sector has struggled to scale. Sweden's central bank hiked interest rates for the eighth consecutive time on Thursday, taking the main rate to 4%, as the country continues to battle high inflation. The lawsuit also alleged that a backstage manager on the tour sent a photo “graphically depicting male genitalia” to a group text message that included the plaintiff, tour management and other crew members; the lawsuit said the singer’s management failed to properly address the message, responding to it with humor in a way that encouraged an “unsafe, sexually charged workplace culture.”The plaintiff also said she was subjected to long hours and frequently denied breaks, alleging that Nomura required her to be on her feet all day despite an ankle injury. Attempts to reach Nomura on Thursday were not immediately successful. In response to the lawsuit, a spokesman for Lizzo, Stefan Friedman, said that Daniels never had any contact with the pop star during her time with the tour. “As Lizzo receives a humanitarian award tonight from the Black Music Action Coalition for the incredible charitable work she has done to lift up all people, an ambulance-chasing lawyer tries to sully this honor by recruiting someone to file a bogus, absurd publicity-stunt lawsuit,” Friedman said.
