The Supreme Court in recent years has struck down two trademark laws based on free speech concerns. Elster applied for the "Trump Too Small" trademark to use on T-shirts, inspired by an exchange between Trump and U.S. Elster told the Supreme Court that his trademark uses a double meaning to criticize Trump while expressing his views about "the smallness of Donald Trump's overall approach to governing." Ernst also said the law at issue does not further the overarching trademark law goal of preventing marketplace confusion. "Nobody would be confused into believing that Donald Trump is selling T-shirts accusing him of being too small," Ernst said.

On Oct. 23, Fed Chair Jay Powell said a strong economy and tight jobs market could warrant more rate rises. Interest rate futures show traders believe the BoE will not cut rates, now at their highest since 2008, until at least June 2024. "The Governing Council’s past interest rate increases continue to be transmitted forcefully into financing conditions," the ECB said, adding it would follow a "data-dependent" approach and future decisions would be based on incoming data. Prime Minister Jonas Gahr Stoere told parliament last week interest rates may have peaked. That could make it difficult for the party to deliver a coherent message on early voting. In an advertisement that aired during the first Republican presidential debate in August, RNC Chairwoman Ronna McDaniel said into the camera: "When Republicans vote early, we win." With Trump railing against the practice, Democrats have increased their edge in early voting. In 2022, that gap widened, with Democrats accounting for 42.5% of early ballots and Republicans 33.8%. But Youngkin advisers said their data showed the early vote campaign had brought in ballots from low-propensity voters as well.

REUTERS/Brian Snyder/File photo Acquire Licensing RightsOct 25 (Reuters) - IT software and consultancy services provider IBM (IBM.N) reported third-quarter revenue slightly above Wall Street targets on Wednesday, buoyed by stable demand for its software solutions and a stronger-than-expected mainframe business. Shares of the Armonk, New York-based company rose 2% in trading after the bell. While the company has seen a slowdown in the growth of its overall business compared to last year, it reiterated its annual target for revenue growth and free-cash-flow generation. Revenue at its software segment, which now includes newly acquired IT budgeting software maker Apptio, rose nearly 8%, excluding the impact from a strong dollar. The sun sets at the U.S. Capitol as House Republican candidates hold a forum before they select the next GOP House Speaker nominee on Capitol Hill in Washington, U.S. October 23, 2023. But after three weeks of infighting, some Republicans predicted that a new speaker could be elected on the House floor quickly. 3 House Republican can point to leadership and campaign fundraising experience that normally would make him a strong candidate for the post. The infighting has left the House unable to respond to President Joe Biden's $106 billion request for aid to Israel, Ukraine and U.S. border security. Republicans control the House by a narrow 221-212 margin, which means they can afford no more than four defections on partisan votes.

Some Republican contenders for their party's 2024 presidential nomination have turned to a blunt policy proposal to tamp down on crime: killing criminals. Crime, meanwhile, is a greater concern for voters than it has been in previous elections, even as crime trends are mixed. The former president has reiterated previous calls for drug dealers to receive the death penalty, despite legal scholars questioning its constitutionality. For instance, the U.S. Supreme Court holds that the application of the death penalty for crimes that do not result in the death of the victim is generally unconstitutional. In 2008, the court left open the possibility of the death penalty for "drug kingpin activity," though it has never been applied.

The marketing failure that's going to kill us all

A good example of bad climate marketing comes from the Irish budget airline Ryanair. Carbon offsets involve contributing money to a project that will help avoid, reduce, or remove carbon emissions from the atmosphere, such as planting trees or building wind farms. Some of the most successful corporate efforts at climate marketing place more emphasis on consumers' personal concerns. According to the International Energy Agency, global carbon emissions reached a record high last year. The more you focus on what everyday people care about, Berger said, the more effective your marketing campaign will be.
