House Republicans have temporarily forced themselves out of the presidential line of succession. As a result, House Republicans for the time being would be skipped over entirely. Never before in history has the line of succession gone past the vice president, meaning most of this discussion is purely academic. Still, House Republicans are currently risking what they would be rightfully entitled to thanks to their slim majority following the 2022 midterm elections. Many legal scholars have long had issues with the Truman-era law governing presidential succession.

To become speaker of the House, Kevin McCarthy was forced to make several concessions. He agreed to change House rules to allow any member to bring a motion to vacate the speakership. In January, just a few short months after an election where Republicans just barely gained majority control of the House of Representatives, McCarthy had emerged as the frontrunner to become the next House speaker. Traditionally, it only takes one ballot and less than one day to elect a speaker, and the victor only needs a simple majority vote to ascend to the speakership. If a simple majority of House members vote in favor, McCarthy will be removed from the post and replaced with a temporary, unknown speaker to preside over the chamber until a new speaker is formally elected.

U.S. Rep. John Curtis won't run to succeed Mitt Romney, leaving the race to replace the nationally known Utah senator clear of one of the state's best known Republicans. “We’ve accomplished a lot but my work for them is not done," Rep. John Curtis wrote in a Monday op-ed in the Deseret News. “I believe we need elected leaders who are more concerned about doing their job than getting the next job. Curtis emerged as a possible candidate after Romney, 76, announced last month that he won’t run for reelection. He would have been a formidable contender for the job in Republican-dominated Utah, along with Republican Utah House Speaker Brad Wilson, 54, who announced his campaign Wednesday.

House Speaker Kevin McCarthy on Tuesday lashed out at Rep. Matt Gaetz, saying that the fellow Republican lawmaker who is seeking to oust him has "personal things in his life that he has challenges with." In February, the Department of Justice ended a two-year criminal sex trafficking investigation of Gaetz without filing charges against the Florida congressman. McCarthy on Tuesday accused Gaetz of targeting him because of a House ethics investigation into Gaetz's conduct that was also the subject of the criminal probe. "For some people, policy failures are recast as personal because their own failures are personally embarrassing to them," Gaetz had said. Gaetz on Monday night filed a resolution that seeks to remove McCarthy as speaker.

The House voted to vacate the Office of the Speaker on Tuesday, booting Kevin McCarthy from his job. The House, under interim speaker Rep. Patrick McHenry of North Carolina, will now have to hold speaker elections once again, and it's not clear where that will lead. In 1910, House Speaker Joseph Cannon called the motion himself as he faced a mutiny from his own party, daring his own members to oust him. The Saturday measure, while supported by most House Republicans, ultimately passed with more Democratic than Republican votes. Gaetz and dozens of other House Republicans — potentially more than half — oppose sending more aid to the besieged country.

When Speaker Kevin McCarthy failed to keep his leadership post, his 269-day speakership became the shortest in more than 140 years. Seven previous members of Congress served single speakership terms shorter than McCarthy’s, which ended by resignation or dying in office. But those speakers served when their party was in leadership in other Congresses and ultimately had longer cumulative speakerships. No House speaker has served for less than a year in total since 1876. A House speaker has stayed in power for an average of roughly 638 days since 2001, compared to 459 days during the 19th Century.

WASHINGTON — House Speaker Kevin McCarthy told his Republican caucus members he will bring a motion that seeks to oust him to a vote Tuesday afternoon, two GOP lawmakers told NBC News. Rep. Matt Gaetz, R-Fla., a longtime foe of McCarthy's, on Monday night filed a motion to vacate targeting the speaker's position. Gaetz has been threatening McCarthy with a motion to vacate since he worked with Democrats on a debt ceiling deal in the spring. McCarthy told CNBC's "Squawk Box" on Tuesday morning that Gaetz has "personal things in his life that he has challenges with." In January, as a condition to secure enough votes to become speaker, McCarthy agreed to change the rules to lower the threshold needed to bring a motion to oust a speaker from five votes to just one.

Washington CNN —Democratic Sen. Laphonza Butler made history Tuesday when she was sworn in by Vice President Kamala Harris as the first out Black lesbian to enter Congress and the only Black woman presently serving in the Senate. Gavin Newsom to fill the seat left vacant by the death of Democratic Sen. Dianne Feinstein, becomes only the third Black woman to serve as a US senator. Harris, formerly the sole Black woman in the Senate, vacated her seat in 2021 after her election as vice president. Newsom was under intense pressure within California to choose a Black woman to succeed her, but instead appointed Alex Padilla, then California’s secretary of state, who became the first Latino senator from the state. Newsom later pledged to appoint a Black woman to Feinstein’s seat should the senator resign before her term’s end.

House Speaker Kevin McCarthy speaks with reporters at the U.S. Capitol in Washington, DC, October 3, 2023. No House speaker has ever been ousted through the passage of a resolution to remove them. If a procedural vote fails, then there would be a vote directly on whether to remove McCarthy as speaker, which would take only a majority to succeed. CNN —A group of eight House Republicans joined with Democrats Tuesday in a historic vote to remove Republican Rep. Kevin McCarthy as speaker. The vote in the House of Representatives on the motion to vacate was 216-210, with Florida Rep. Matt Gaetz leading the effort. Because of the GOP’s razor-thin majority in the House and a Democratic conference united against him, McCarthy needed the support of nearly all of his party’s members to keep the gavel. It was not immediately clear who would replace the California Republican, and GOP Rep. Patrick McHenry of North Carolina was named speaker in the interim.
