Trump is arguing that Jack Smith – who has brought charges against Trump in Florida and Washington, DC – was unlawfully appointed as special counsel. At the center of Trump’s argument is the claim that the Attorney General Merrick Garland does not have legal authority to appoint someone as special counsel who hasn’t confirmed by the Senate. The Justice Department says the attorney general has ample authority to appoint “inferior officers,” which would include special counsels. “This Court should hold as a matter of law that the Attorney General lawfully appointed the Special Counsel,” the attorneys wrote. Almost inverse from Trump, Biden argued that special counsel David Weiss was unlawfully appointed because he was already in the federal government and therefore not fully independent.

CNN —The Supreme Court on Thursday upheld a Trump-era tax on overseas investments, rejecting an argument from a Washington state couple in a case that could have jeopardized existing tax provisions and torpedoed Democratic talk of a wealth tax. Justice Brett Kavanaugh wrote the majority opinion and Justice Clarence Thomas wrote a dissent. In reading his opinion from the bench, Kavanaugh repeatedly stressed that the opinion was “narrow” and did not implicate the raging debate over a wealth tax. “Those are potential issues for another day, and we do not address or resolve any of those issues here,” Kavanaugh wrote in Thursday’s opinion. Elizabeth Warren of Massachusetts and Ron Wyden of Oregon and Independent Sen. Bernie Sanders of Vermont have also unveiled tax proposals that would hit the wealthiest Americans.

For those looking for the hidden hand of politics in what the Supreme Court does, there’s plenty of reason for suspicion on Donald Trump’s as-yet-decided immunity case given its urgency. That eight-week interval is much quicker than the ordinary Supreme Court briefing process, which usually extends for at least 10 weeks. Nearly two months have passed since the justices heard lawyers for the former president and for the special counsel’s office argue the immunity case. The immunity case is not the only big case hanging fire. Some two dozen remain undecided that were argued even before the April 25 oral argument over Mr. Trump’s immunity.

CNN —Judge Aileen Cannon had been on the federal bench for little more than a year when a senior judge offered to preside over one of her first criminal trials in her isolated south Florida courthouse. The Georgia Court of Appeals on Wednesday stayed the criminal election interference case against former President Donald J. Trump until an appellate panel could resolve the matter of whether the district attorney in Fulton County should be disqualified from prosecuting the case based on a conflict of interest. In a one-page order, the court stated that any movement at the trial-court level pertaining to Mr. Trump and eight other defendants who have appealed a ruling allowing the prosecutor, Fani T. Willis, to remain on the case was “stayed pending the outcome of these appeals.”Earlier this week, the appellate court set a tentative date for oral argument of Oct. 4. Legal experts expect the appeals will take months to resolve. The order was more bad news for critics and opponents of Mr. Trump who had hoped that he would stand trial in Georgia before he faced off against President Joseph R. Biden in the general election. Mr. Trump and a number of his allies were indicted in Georgia last summer in a sweeping racketeering case that accused them of trying to overturn his 2020 election loss in the state.

Cannon is planning on holding a sprawling hearing on Trump’s request to declare Jack Smith’s appointment as special counsel invalid, signaling she could be more willing than any other trial judge to veto the special prosecutor’s authority. Wednesday, Cannon went further, adding a hearing on a gag order request from prosecutors to limit Trump’s rhetoric about law enforcement and allotting more time to hear arguments on the special counsel issue. With a one-page order, the Georgia Court of Appeals on Monday made it all the more likely that Donald J. Trump will not face a criminal trial in the state before he faces off against President Biden in the November election. That suggests that the matter almost certainly will not be resolved in time for a trial to start before the election. On a mild Houston day in March 2021, Judge Marvin Isgur prepared to oversee the only case on his docket that morning. In October 2023, the Fifth Circuit Court rebuked Judge David Jones but said that his longtime colleague, Judge Marvin Isgur, had been "unaware" of Jones' inappropriate relationship. "But only Judge Isgur knows what he knew or didn't know about the relationship." Much of this work was in cases before either Judge Isgur or Judge Jones. Isgur can continue to hear the case, he ruled, writing in the December 2023 opinion that lawyers for the creditor "failed to demonstrate much other than that former Judge Jones and Judge Isgur are close friends."

The indictment alleged that Trump was a part of an illegal conspiracy to undermine the integrity of the 2016 election. While hush money payments are not illegal in themselves, each charge was tied to a specific allegedly false entry among the financial records of the Trump Organization. Trump has argued that the payments to Michael Cohen, his former fixer who paid Daniels, were correctly labeled as legal expenses. NEW YORK CNN —A Manhattan prosecutor said Wednesday a new indictment against Harvey Weinstein is possible as additional accusers have come forward with claims against the powerful Hollywood producer whose downfall became a symbol of the #MeToo movement. That trial similarly used “prior bad acts” witnesses and has also been appealed. In addition, three other women testified at trial as “prior bad acts” witnesses. They argued the “prior bad acts” witnesses should not have been allowed to testify and the court should not have given prosecutors the ability to question Weinstein about instances of verbal abuse and bullying on cross-examination.
