Xavier Niel’s GAM raid looks less quixotic
  + stars: | 2023-07-18 | by ( ) www.reuters.com   time to read: +2 min
NewGAMe, whose backers include telecoms mogul Xavier Niel and Swiss wealth manager Bruellan, launched a tender offer for just under 18% of GAM’s shares. Liontrust’s offer looked like the least bad option for GAM, which is losing money as its assets have more than halved since 2018 to 68 billion Swiss francs. And at least one other investor, with 6.5%, has said it won’t accept Liontrust’s offer. That means Liontrust will probably struggle to get to the two-thirds vote it would need to take over GAM. But GAM also has over 2 billion Swiss francs of tax losses to carry forward, lowering any future tax burden.

As depressing as the outcomes often were, these tortuous paths of jurisprudence were often absurd. A closer look at the opinions helps illustrate how legal decision-making is often deeply entwined with the justices’ deeply held passions and religious beliefs, their occasionally tense relationships with their colleagues and their personality quirks. Here are a few mostly tin medals for the outstanding lowlights (and a few highlights) of the year. ImageMost compassionate opinion correcting a historical American injustice:Justice Neil Gorsuch’s concurring opinion in Haaland v. That prompted a flurry of downgrades from analysts that in turn helped spur a steep sell-off in telecom stocks. Since the investigation’s publication, AT&T shares have tumbled roughly 14%, Verizon fell 10% and Frontier Communications slid 33%. AT&T shares on Tuesday fell to $13.45, its lowest closing price since 1993. Verizon shares fell 7.5% to $31.46 on Monday to their lowest closing level since 2010 before paring back their losses slightly on Tuesday. Lawmakers have demanded action to further investigate the network of toxic lead cables in the wake of the release.

Worse, the path to safety is not clear; simply getting past the next election without the democratic system grinding to a halt seems like a big achievement. Both authors had predicted, by a decade or more, that a period of great crisis would arrive around 2020, though neither foresaw a pandemic. He proposes a cyclical scheme of societal rise and subsequent disintegration based on a “wealth pump,” whereby elites get richer and ever more entrenched. Inequality, if left unchecked, grows to the point that the system fragments and has to be rebuilt from the ground up. Such is the situation today in America, where oligarchy has become so extreme that a huge redistribution of power needs to take place.

In a ruling on July 18, the ICC appeals judges rejected an attempt by the Philippines to block an investigation into the bloody anti-narcotics campaign of former President Rodrigo Duterte. A majority of judges rejected all four points of Manila's appeal, including that the ICC has no jurisdiction in the Philippines and that authorities there were conducting their own investigation. "The ICC appeals judges' ruling marks the next step toward justice for victims of 'drug war' killings and their families," Bryony Lau, deputy Asia director at Human Rights Watch (HRW), said in a statement. The decision left some of the families of drug war victims in tears after they watched the court proceeding online. But appeals judges ruled prosecutors still had jurisdiction over the alleged crimes because they occurred when the Philippines was still an ICC member.

Novartis buyback offers partial cure for M&A risk

LONDON, July 18 (Reuters Breakingviews) - Novartis’s (NOVN.S) bumper buyback will offer a little relief to investors. Many had been waiting to see what the $225 billion Swiss pharma giant would do with an extra $20 billion burning a hole in its pocket after Roche(ROG.S) bought back its stake in 2021. It needs new drugs to replenish its pipeline and boost an ailing share price, which has still not recovered since the pandemic. But on Tuesday, CEO Vasant Narasimhan said he will launch a $15 billion buyback programme. The Swiss drugmaker’s $15.4 billion of net debt is less than 1 times its forecast 2023 EBITDA, according to Refinitiv.

Economists this week are embracing a higher probability that the Fed will achieve a "soft landing." A much-hoped-for "soft landing" indeed seems increasingly likely now as inflation cools and the job market remains strong. US retail and food services sales were up 1.6% from April to June, following a slight decline in March. "Consumers are far from depressed, but neither are they in celebratory mood," GlobalData retail analyst Neil Saunders said in a note. As consumer spending accounts for roughly 70% of the US economy, the continued strength in that area has been key to the US outperforming every other wealthy nation in the world.

LONDON, July 17 (Reuters) - Insurers are reviewing whether to freeze cover for any ships willing to sail to Ukraine after Russia said on Monday it will suspend participation in a UN-backed deal that allows the export of grain through a Black Sea safe corridor, sources said. "Due to the collapse of the Black Sea corridor deal, most shipowners will now refrain from calling Ukrainian ports," Christian Vinther Christensen, chief operating officer with Danish shipping group NORDEN told Reuters. The (key) question is whether Russia mines the area which would effectively cease any form of cover being offered," one insurance industry source said. The Lloyd's of London insurance market has already placed the Black Sea region on its high-risk list. Additional war risk insurance premiums, which are charged when entering the Black Sea area, need to be renewed every seven days.

The blasts were the second time the Kerch Strait Bridge has been hit in 10 months. Russia on Monday accused Ukraine of using maritime drones to assault the bridge, a strategic link for Russian forces fighting in southern Ukraine. Ukrainian officials celebrated the attack, but neither claimed nor denied responsibility for the blasts. Hours after the attack, Moscow announced that it was pulling out of the Black Sea grain deal, an agreement that had allowed Ukraine to export its grain by sea despite Moscow’s naval blockade. Dmitri S. Peskov, the Kremlin’s spokesman, said the bridge attack was not related to Russia’s decision to suspend its participation in the deal, which had helped keep global food prices stable.

REUTERS/Jorge SilvaBANGKOK/NEW DELHI, July 17 (Reuters) - Indian tourists are streaming into Southeast Asia, cementing the world most populous country's position as a key growth market for a travel and tourism sector that is feeling the pinch of China's slower-than-expected re-opening. "Southeast Asia is obviously very well positioned for a lot of the growth that is inevitably going to come from India," aviation analyst Brendan Sobie told an industry conference last month. Tanes Petsuwan, deputy governor of the Tourism Authority of Thailand said 1.6 million Indians were expected to visit the kingdom this year. Indians are helping to sustain a post-pandemic rebound for hospitality chains, including Minor Hotels, which has 45 properties in Southeast Asia with more than 6,000 rooms. The Kerch Strait Bridge that links the Crimean Peninsula to mainland Russia, in March. Russian officials blamed Ukraine for the attack on the Kerch Strait Bridge. Ukrainian officials offered no comment on the incident. Video and photographs verified by The Times showed damage to both sides of the road bridge, with the most significant being along a span of the bridge heading into Russia. The attack came as Ukrainian forces were engaged in an ambitious and grinding counteroffensive aimed at driving Russian forces from southern Ukraine.

Not long ago, the names on the marquee would have been right at home on Fox News: Stephen K. Bannon, Tucker Carlson and Roger J. But Fox News ousted Mr. Carlson three months ago, and Mr. Bannon, Mr. Stone and a boisterous pro-Trump crowd at the Turning Point Action Conference were eager to take shots at the conservative network, arguing that it has not been sufficiently supportive of former President Donald J. Trump as he seeks to regain the office he lost in 2020. July 14 (Reuters) - Former Fox News (FOXA.O) host Tucker Carlson and former White House adviser Neil Patel are looking to raise funds to start a new media company that could potentially be anchored on Twitter, the Wall Street Journal reported on Friday. The duo is looking to raise hundreds of millions of dollars to fund the company, the report said, citing people familiar with the matter. Carlson did not immediately respond to Reuters' request for a comment, while Patel was not immediately reachable. In a video posted on Twitter in May, Carlson had said he would relaunch his show on the social media platform "soon". He released the first episode of his new show, "Tucker on Twitter", in June.

July 13 (Reuters) - A group of Republican U.S. state attorney generals on Thursday warned the country's largest companies that certain workforce diversity policies could be illegal in light of the U.S. Supreme Court's decision effectively striking down affirmative action in higher education. The attorney generals urged the companies to abandon race-based quotas or preferences in hiring, promotion and contracting and threatened legal action "sooner rather than later" if they do not. "Companies that engage in racial discrimination should and will face serious legal consequences," the attorney generals wrote. They were joined by the attorney generals of Indiana, South Carolina and Missouri, among others. But in Thursday's letter, the attorney generals said well-intentioned race discrimination is still illegal.

That would mean the alliance itself would be at war, and leaders won't go that far. But by the end, after one-on-one meetings with U.S. President Joe Biden and other NATO leaders, Zelenskiy had softened his tone, describing the outcome as "good", though not "ideal". "It is very important: for the first time since independence, we have formed a security foundation for Ukraine on its way to NATO," Zelenskiy said, adding there had also been "a good reinforcement with weapons." Experts say the technology will help address a steep and prolonged slowdown in productivity growth in many Western economies, which has kept businesses’ costs higher than they would otherwise be and made inflation harder to tame. “AI has huge potential to increase productivity,” BlackRock CEO Larry Fink said at the company’s Investor Day last month. Productivity gains in Europe could be similar, albeit slightly smaller, Brynjolfsson told CNN. In some cases, productivity gains could be achieved sooner. That’s because most generative AI tools live on the internet — “the technology we already have on our desks” — making them widely accessible, Brynjolfsson said.

Headline inflation eased to just 3% in June, marking the lowest inflation reading in 2 years. Core inflation, meanwhile, posted a year-per-year increase of 4.8% last month, below the expected 5%. Meanwhile, core CPI, which excludes volatile food and energy prices, rose 4.8% year-per-year, below economists' estimates of a 5% increase. The AI revolution is here and will spark a 15% rally in tech stocks, according to Wedbush's Dan Ives. A recession is looking less likely as inflation cools and the job market stays resilient, according to top economist Paul Krugman.

LONDON, July 12 (Reuters Breakingviews) - The Bank of England’s silence has left traders in a tizzy. Market interest rates have spiked due to soaring inflation expectations, pushing up mortgage costs. That looks like an over-reaction but unless Governor Andrew Bailey says so, homeowners will pay the price. Now, traders believe rates will be at around 6.2% in a year’s time and stay above 5.8% for a further two years. That spike sent the average two-year fixed mortgage rate to 6.66% on Tuesday, the highest level since August 2008, according to Moneyfacts.

Trade between the US and Mexico reached $263 billion during the first four months of this year. That pushed Mexico past China and Canada as the top trade partner since the start of the pandemic. China was the top partner for much of the 2010s and again at the start of the pandemic. Trade with Mexico accounted for 15.4% of all the goods exported and imported by the US, just ahead of America's trade totals with Canada (15.2%) and China (12.0%). Ellen Hovde, a documentarian who was one of the directors of “Grey Gardens,” the groundbreaking 1975 movie that examined the lives of two reclusive women living in a deteriorating mansion on Long Island and inspired both a Broadway musical and an HBO film, died on Feb. 16 at her home in Brooklyn. She was 97. Her death, which had not been widely reported, was confirmed last week by her children, Tessa Huxley and Mark Trevenen Huxley, who said the cause was Alzheimer’s disease. In 1969 she was a contributing editor on “Salesman,” a documentary by the Maysleses and Charlotte Zwerin that followed four salesmen as they peddled $49.95 Bibles door to door in New England and Florida. The next year she was an editor on “Gimme Shelter,” the documentary by the Maysleses and Ms. Zwerin that captured a Rolling Stones tour, including the concert at Altamont Speedway in Northern California in late 1969 at which a concertgoer was killed by a Hells Angel.
