The scene at Coney Island on Saturday was typical for a humid and hot weekend in July: colorful towels, tents and umbrellas packed into the strip of sand. Along the famed boardwalk in Brooklyn, signs warned visitors of the potential dangers posed by lightning or strong currents, and delineated where and when it was safe to swim. Roberts Jr. pooh-poohed the fears of his liberal colleagues who worried in dissent that the broad protections the Supreme Court had conferred on former President Donald J. Trump would place future presidents beyond the reach of the law. The real concern, Chief Justice Roberts said, was not that immunity would embolden presidents to commit crimes with impunity, but rather that without it, the country’s rival leaders would endlessly be at each others’ throats. “The dissents overlook the more likely prospect of an executive branch that cannibalizes itself,” he wrote, “with each successive president free to prosecute his predecessors.”That dark vision, however right or wrong it proves to be, did not come out of nowhere: It was offered to the court by Mr. Trump’s own lawyers during oral arguments on the question of immunity that took place in April.

A US appeals court threw out the dismissal of an antitrust lawsuit accusing 10 large banks of overcharging investors on corporate bonds, saying the trial judge should have been recused because his wife owned stock in one of the banks. Liman, an appointee of former President Donald Trump, was assigned the lawsuit in April 2020 and dismissed it with prejudice in October 2021, three months after his wife sold $15,000 of Bank of America stock. The banks said Liman’s failure to uncover his conflict didn’t require recusal or reviving the case. But the appeals court found a “legitimate risk” that similar violations could undermine public confidence in the judicial process. Justice Amy Coney Barrett expressed frustration with how the court was sending the case back down for more proceedings. She suggested that because Trump’s wholesale challenge to the indictment had failed, at least some of the case could go forward.
