CNN —Donald Trump’s former lawyer Rudy Giuliani is one step closer to being disbarred. The professional responsibility board in Washington, DC, recommended Friday that the ex-New York mayor and federal prosecutor lose his law license because of his involvement in a bogus 2020 election fraud lawsuit. Giuliani’s law license had already been suspended due to his work boosting Trump’s false assertions about his electoral loss. It is up to the DC Court of Appeals to decide whether to permanently disbar Giuliani. Earlier this week, attorney Jenna Ellis saw her Colorado law license suspended for three years because of her guilty plea in the criminal 2020 election interference case brought in Georgia.

Smartmatic and Newsmax have since been embroiled in the years-long defamation case, which is slated to go to trial this September in Delaware Superior Court, barring an out-of-court settlement. Smartmatic further accused Newsmax of intentionally “destroying relevant evidence” by deleting texts and emails from senior officials. Fox News famously paid more than $787 million to Dominion Voting Systems to settle a case last year over similar 2020 election lies on its airwaves. A trial could put Newsmax’s financial future in peril, but there is one major difference between the Newsmax and Fox cases. The network denies wrongdoing and maintains that its 2020 election coverage is protected by the First Amendment.

Part of the reason for those modest hopes was the fact that the defense case would not include testimony by the defendant. Later, the charging conference to agree on jury instructions showed how daunting the law is that Trump faces. All of that is bad news not just for Costello, whose clash with Merchan won Trump’s praise outside the courtroom Monday, but also for the defense. Because Costello was one of Trump’s only witnesses, there is also the risk that he — and the jury’s reaction to his poor attitude — will taint the defense case overall. There was little the defense could do about the law in the charging conference beyond their usual able argument.

CNN —Followers of former President Donald Trump were meant to be startled when they were sent an email Tuesday, addressed from “President Trump,” with this arresting subject line:“They were authorized to shoot me!”The preview line in the email did not back down. The judge, Beryl Howell, cited the discovery of additional documents with classified markings found in Trump’s Mar-a-Lago bedroom months after the FBI search. Trump is a master sensationalist, so place the email subject line where he says he’s in physical harm within his oeuvre of over-the-top and untrue allegations. How to get people to open fundraising emailsThe email address where I get fundraising pitches from politicians received seven such messages from Trump on Tuesday. Trump’s allegations about the FBI document were not just contained in the fundraising email.

CNN —Rudy Giuliani has agreed to never again publicly accuse two Georgia election workers of tampering with votes in the 2020 election, a false accusation that he has repeated frequently and that led to his bankruptcy. With the agreement, Giuliani is forfeiting a yearslong verbal and legal battle he’s waged with the election workers, Ruby Freeman and her daughter, Shaye Moss. “Today ends his efforts to profit off of lies about these two heroes of American democracy,” the workers’ attorney Michael Gottlieb said in a statement. The trial provided a searing glimpse into the harassment election workers suffered while prominent Trump supporters spread lies about the 2020 election. Giuliani is also in Chapter 11 personal bankruptcy, with Freeman, Moss and others pursuing everything he has of value.

CNN —The defense rested its case in Donald Trump’s criminal hush money trial on Tuesday after roughly 90 minutes of testimony – and without the former president taking the stand. Here are takeaways from the final day of testimony in the Trump hush money trial:Trump doesn’t take the standOver the last several months, Trump repeatedly teased that he would take the stand in his own defense. “That was a lie,” Blanche alleged of Cohen’s testimony he spoke to Trump about moving forward with the hush money deal. Prosecutor Susan Hoffinger also tried to remind jurors that it was Trump – not Cohen – who was on trial in this case. In their first meeting, Costello said Cohen was “absolutely manic” and suicidal after the FBI raid on his properties.

Phoenix CNN —Rudy Giuliani and 10 others pleaded not guilty in an Arizona court Tuesday to charges of allegedly conspiring to overturn the 2020 presidential election results. Giuliani was served Friday in Palm Beach, Florida, at his 80th birthday bash held by a GOP operative. Arizona prosecutors spent weeks trying to track down Giuliani and eventually found him based on some of his podcasts. That evening, Giuliani posted a tweet saying that “if Arizona authorities can’t find me by tomorrow morning” they would have to dismiss the indictment. “I haven’t been hiding from anyone,” Giuliani told the judge during Tuesday’s hearing.

So it goes for Menendez, who is likely pleased to have his legal drama playing out in relative obscurity. More recently, Fetterman mocked the senator’s defense, which relies in part on pointing the finger of blame on Nadine Menendez, his wife. Republicans in Washington, as they’ve done during these first two weeks of the Menendez trial in New York, have been consistently deferential to the New Jersey Democrat. Rep. Andy Kim, a popular Democrat from South Jersey, is expected to win the nomination to succeed Menendez. Andrew Giuliani, pressed for a thought on the senator’s trial or the allegations against him, shrugged.

CNN —The prosecution rested their case against Donald J. Trump on Monday in the former president’s hush money trial, which is barreling toward a conclusion as soon as next week. Regardless of the break, the Trump hush money trial is near its end – and roughly a week away from being in the hands of the jury. Cohen was the key witness, spending more than 17 hours on the witness stand over four days before wrapping up on Monday. Eight times a day during his felony trial, the former president of the United States must stand and honor 12 jurors and six alternates as they walk past, eyes straight ahead or down, casting no glances at him. It’s inspiring to watch these ordinary citizens as sovereign soldiers for justice. On Monday, this calm processional was disrupted, as jurors were forced to hurry out after a pro-Trump witness for the defense mocked the authority of the court. Moments later, Justice Juan Merchan ordered the courtroom immediately cleared and reporters fled in a frenzy. Michael Cohen had testified earlier that Costello and Rudy Giuliani were assigned by Trump to open a “back channel” to Cohen to keep him in the Trump fold.

The witness, attorney Robert Costello, was called by the defense to attack the credibility of key prosecution witness Michael Cohen. Within minutes of taking the stand, Costello was in open conflict with New York Supreme Court Justice Juan Merchan, the judge presiding over the case. "If you don't like my ruling you don't say 'Jeez," you don't give me side eye, and you don't roll your eyes," the judge scolded. "You don't say 'strike it,'" the judge told the witness, adding that it's his job, not the witness' to strike testimony. Bove could not instigate a "trial within a trial," the judge ordered, by asking Costello questions beyond this limited topic.

Have you all noticed the Republican stars and wannabes showing up at Donald Trump’s trial? For its part, Team Trump may just be happy to have some respectable, unindicted players on Mr. Trump’s side. OK, Mr. Paxton doesn’t strictly meet those criteria, but you get my point. And of the many sordid ways Mr. Trump sets himself apart, his crew of henchmen is a doozy. Michael Cohen deserves top billing with his juicy court appearances this week, as Mr. Trump’s former fixer shared the nitty-gritty of how to keep your boss’s alleged extramarital encounters from blowing up a presidential campaign.

CNN —Rudy Giuliani was suspended from New York City radio station WABC and his talk show canceled after he flagrantly ignored orders not to discuss false 2020 election conspiracy theories, the station’s owner said Monday. In recent months, Giuliani was repeatedly directed to not make claims of electronic voting manipulation surrounding the 2020 election, John Catsimatidis, the billionaire GOP donor and owner of the radio station, said in a statement. “Guiliani has admitted repeatedly over the past few days that he agreed not to speak about Dominion,” Catsimatidis said. CNN —An attorney discipline judge in California has rejected a request from ex-Trump election lawyer John Eastman to reactivate his law license following her recent recommendation that he be disbarred, which rendered him unable to practice law for now. Judge Yvette Roland, who oversees state bar proceedings in California, recommended in March that Eastman be disbarred for his election subversion efforts. The California Supreme Court will ultimately decide whether to endorse or reject Roland’s recommendation to disbar Eastman. “Eastman failed to uphold his primary duty of honesty and breached his ethical obligations by presenting falsehoods to bolster his legal arguments,” Roland wrote in her opinion recommending he be disbarred. He also was indicted last month in Arizona in connection with efforts to overturn the 2020 election, along with more than a dozen other Trump allies, including Mark Meadows and Rudy Giuliani.

Barrett pins Trump down on his absolute immunity argumentsAs the second-least senior justice, Barrett sits at the far end of the Supreme Court’s mahogany bench. That was a notable break from earlier arguments Trump submitted that called for “absolute” immunity on a much wider scale of acts. A party turns to a private attorney, Barrett hypothesized, “who was willing to spread knowingly false claims of election fraud” to spearhead his challenges to an election. That appeared to be a reference to former Trump attorney Rudy Giuliani, identified by CNN as “co-conspirator 1” in Smith’s indictment. “This is where someone like Justice Barrett gets to pressure test an advocate’s points,” she said.

Trump himself has continued to lobby for absolute immunity, including before his appearance at a New York court where he’s on trial for business fraud. Dreeben told Barrett that the indictment against Trump is substantially about private conduct, meaning that a trial could proceed even if the Supreme Court finds some immunity for Trump’s official actions. Liberal justices weren’t impressed with Trump’s absolute immunity claimsIt was pretty clear where the court’s three liberals will be when the opinion lands.
