U.S. District Judge Lewis Kaplan on Monday threw out Mr. Rapp’s claim of intentional infliction of emotional distress. Judge Kaplan permitted Mr. Rapp’s claim of battery to move forward.

In a significant development Monday, the judge overseeing the trial tossed out Rapp's claim for intentional infliction of emotional distress. Judge Lewis A. Kaplan said that claim "repeats and re-alleges" Rapp's allegation of battery. The actor testified that he "certainly had a degree of shame" about being gay because he grew up with his father's hateful views. Spacey is expected to rebut Rapp's allegation of sexual misconduct on Monday afternoon following a roughly hour-long lunch break. Rapp testified that Spacey invited him to a party at his apartment.

CNN —Actor Kevin Spacey will testify in the sexual misconduct trial against him, his attorney said in court Monday. Earlier Monday, attorneys for actor Anthony Rapp finished presenting their case against Spacey. He is suing Spacey for assault, battery and intentional infliction of emotional distress. Spacey’s attorneys have attempted to poke holes in Rapp’s claims by pointing to discrepancies, including dates Rapp alleged to have run into Spacey at industry events. Before ending his time on the stand, Rapp’s attorney Peter Saghir asked the actor if he had been lying about his allegations against Spacey.

NEW YORK, Oct 17 (Reuters) - Kevin Spacey is expected to testify in his own defense later on Monday in a civil lawsuit accusing the Oscar-winning actor of making an unwanted sexual advance on a 14-year-old boy in 1986. Spacey’s lawyers have tried to convince the jury of six men and six women that Rapp fabricated his claim in large part because he was bitterly envious of their client's success. Rapp, they contend, desperately wanted Spacey’s career: the hit films, the plum roles, the two Oscars. But through the first five days of the trial in downtown Manhattan, Rapp’s alleged jealousy has been a recurring and striking theme. “I wanted my career.”Warrington Parker, a San Francisco trial attorney, and Danny Cevallos, an NBC News legal analyst, both described the jealousy argument as a high-risk bet for Spacey’s lawyers.

Rocchio testified that Rapp "did suffer emotional distress, assuming this occurred." She told jurors that Rapp experienced feelings of "shame, guilt and self-blame" as an adolescent. Rapp testified on Wednesday that the alleged encounter with Spacey was "the most traumatic single event of my life" and caused "lingering impacts." Rocchio recalled that Rapp told her he was having trouble remembering his lines of dialogue at some point in 2019. "One of the ways he tried to avoid thinking about things was to throw himself into his work," Rocchio testified.

Actor Cuba Gooding Jr. resolved his New York City forcible touching case Thursday with a guilty plea to a lesser charge and no jail time after complying with the terms of a conditional plea agreement reached in April. Gooding, 54, faces no additional penalties and, by replacing his misdemeanor plea with a plea to a noncriminal violation, he will not have a criminal record. Gooding pleaded guilty in April to a misdemeanor charge that he forcibly kissed a worker at a New York nightclub in 2018. Judge Curtis Farber earlier had ruled if the Gooding case went to trial, prosecutors could have called two additional women to testify about their allegations that Gooding also violated them. Along with the criminal case, Gooding is accused in a lawsuit of raping a woman in New York City in 2013.

CNN —Jennifer Keller, a lead attorney representing Kevin Spacey in the sexual misconduct lawsuit filed by Anthony Rapp, has tested positive for Covid-19. Keller tested positive Thursday morning and is symptomatic, US District a judge Lewis Kaplan told the court. Clinical and forensic psychologist Lisa Rocchio is on direct examination by Rapp’s legal team and is expected to be their final witness. Spacey’s attorneys have attempted to poke holes in Rapp’s claims, among them, that Lupita Nyong’o’s New York Times op-ed is what inspired him to come forward with his allegations to Buzzfeed in 2017. Spacey’s legal team has also pointed to discrepancies between Rapp’s claims, including dates he ran into Spacey at industry events.

Rapp testified that he went on to see six other Spacey movies, including "The Usual Suspects," "L.A. Rapp testified that he shared his allegations privately with at least five friends over the years, including Barrowman. Rapp testified that he was not involved in the publication process and did not see a draft of the article before it was published.
