WASHINGTON (AP) — Lawsuits against Donald Trump brought by Capitol Police officers and Democratic lawmakers over the U.S. Capitol riot, can move forward, a federal appeals court ruled on Friday. Circuit Court of Appeals denied Trump's request to dismiss the lawsuits that accuse him of inciting the violent mob on Jan. 6, 2021. Political Cartoons View All 1274 ImagesTrump’s lawyers have said the president’s words involved “matters of public concern” and falls within the scope of absolute presidential immunity. They noted in court papers that Trump was acquitted in the U.S. Senate of inciting the riot after a historic impeachment trial, and claimed the lawsuits are “just this type of harassment presidential immunity is meant to foreclose.”The D.C. appeals court decision comes after Trump challenged a federal judge's ruling denying his effort to throw out the lawsuits. U.S. District Judge Amit Mehta had ruled that Trump’s words during the rally before the storming of the Capitol were likely “words of incitement not protected by the First Amendment.”

BALTIMORE (AP) — A federal judge has denied a compassionate release request filed by a former Baltimore police officer convicted in 2018 as part of the department’s Gun Trace Task Force corruption scandal. Daniel Hersl, the oldest member of the deeply corrupt and now-disbanded Baltimore police unit, was sentenced to 18 years behind bars after a jury found him guilty of racketeering and robbery. Last month, he filed the request for release, saying he was recently diagnosed with metastatic prostate cancer that has spread to his lymph nodes, liver, lungs and more. He said a prison doctor concluded he has less than 18 months to live, and asked for home detention. Hersl, 53, was one of eight indicted members of the once-lauded Gun Trace Task Force, which was created to get illegal guns off the streets of a city plagued by violent crime.

BALTIMORE (AP) — A federal appeals court on Tuesday struck down Maryland’s handgun licensing law, finding that its requirements, which include submitting fingerprints for a background check and taking a four-hour firearms safety course, are unconstitutionally restrictive. Circuit Court of Appeals in Richmond said they considered the case in light of a U.S. Supreme Court decision last year that “effected a sea change in Second Amendment law.”The underlying lawsuit was filed in 2016 as a challenge to a Maryland law requiring people to obtain a special license before purchasing a handgun. Even though Maryland’s law doesn’t prohibit people from “owning handguns at some time in the future, it still prohibits them from owning handguns now,” Richardson wrote. Pennack said the 2013 law made obtaining a handgun an overly expensive and arduous process. Before that law passed, he said, people had to complete a more limited training and pass a background check, among other requirements.

The Kansas Highway Patrol must stop using a tactic known as the “Kansas Two-Step” to detain out-of-state drivers long enough to find a reason to search their vehicles for illegal drugs, a federal judge has ruled. It follows Vratil's ruling in July that determined that the tactic violated drivers' constitutional rights against unreasonable searches. The judge concluded that the patrol targeted drivers traveling along Interstate 70 to or from states that have legalized either the medical or recreational use of marijuana. “The Kansas Highway Patrol is not above the law,” Sharon Brett, legal director for the ACLU of Kansas, said in a statement Tuesday. Questions about the patrol’s tactics became more visible after Colorado legalized recreational marijuana almost a decade ago.

A spokesperson for Oklahoma Attorney General Gentner Drummond did not immediately return a phone call for comment Saturday. “The Court’s findings and conclusions rest upon a record compiled in 2005–2009,” the poultry companies' motion stated. Oregon State and Washington State claim the actions of the Pac-12 and Commissioner George Kliavkoff in response to members announcing their intent to leave the conference in 2024 show those departing schools relinquished their rights to decide the long-term future of the league. “The Pac-12 cannot continue to be paralyzed at such a critical time," Washington State and Oregon State said in a joint statement. Earlier this month, the University of Washington asked to intervene in the case and for the court to dismiss the lawsuit brought by Oregon State and Washington State. A mediation process is also ongoing between Oregon State and Washington State and the 10 departing Pac-12 members. Lastly, according to the filing, Kliavkoff sent a text message to representatives of Oregon State, Washington State, Stanford and Cal following announcements by Washington, Oregon, Arizona, Arizona State and Utah on Aug. 4 that they were leaving for new conferences stating: “(a)s of today we have 4 board members."

The Labor Day tragedy in 2019 spurred changes to maritime regulations, congressional reform and civil lawsuits. At the time of the fire, no owner, operator or charterer had been cited or fined for failure to post a roving patrol since 1991, Coast Guard records showed. The NTSB faulted the Coast Guard for not enforcing that requirement and recommended it develop a program to ensure boats with overnight passengers actually have the watchman. The Coast Guard has since enacted new regulations regarding fire detection systems, extinguishers, escape routes and other safety measures as mandated by Congress. Victims' families have sued the Coast Guard in one of several ongoing civil suits.

He didn’t live to see the allies’ victory in World War II that year or the conference in San Francisco that month that established the United Nations. But his diplomatic efforts to meet with Arab leaders came undone after a devastating explosion at a hospital in Gaza. Biden himself initially supported the US 2003 war in Iraq only to end up as the president who ordered the US pullout of Afghanistan. “This is the politics that Donald Trump’s rhetoric has wrought among his supporters in the Republican Party,” wrote Avlon.

DAVENPORT, Iowa (AP) — An Iowa woman who falsely claimed to have cancer and documented her “battle” on social media will stay out of prison after a judge gave her probation and a suspended sentence. As part of the 10-year suspended sentence handed down Friday, she was ordered to pay $39,000 in restitution and a $1,370 fine. Russo told the court she made her story up because she hoped her fake cancer battle would force her troubled family to focus on her. Police subpoenaed her medical records and found she had never been diagnosed with cancer at any medical facility in the area. That bothered Rhonda Miles, who runs a pancreatic cancer foundation in Nashville, Tennessee, that donated to Russo and testified at the hearing.

Speaking at a campaign rally in Iowa on Monday, Trump called the judge's order "unconstitutional" and vowed to appeal it. "I'll be the only politician in history that runs with a gag order where I'm not allowed to criticize people," Trump told supporters. The order bars Trump, frontrunner for the 2024 Republican presidential nomination, and attorneys in the case from personally targeting Special Counsel Jack Smith, prosecutors working with him and court staff. Prosecutors sought a limited gag order that would bar certain statements from Trump during the case. The judge said she would allow Trump to make critical statements about the U.S. Justice Department and that denounce the prosecution as politically motivated.

At one point, Chutkan asked prosecutor Molly Gaston to define which of Trump's statements about the case would qualify as "disparaging," and therefore be barred under the gag order. Lauro also argued that a gag order would adversely impact Trump's 2024 presidential campaign. "I do not need to hear any campaign rhetoric in my court," Chutkan chided Lauro at one point. Trump himself has repeatedly railed against the prosecutors' request for a partial gag order, accusing them of trying to "silence" him.
