The Paradox of Prosecuting Domestic Terrorism
  + stars: | 2023-02-08 | by ( James Verini | ) www.nytimes.com   time to read: +52 min
The preventive approach to domestic terrorism goes back even further than the 1990s and it begins with the basic police work and surveillance of the joint terrorism task forces. In fact, there is no section of the U.S. Criminal Code that criminalizes domestic terrorism as such. The absence of clear law around domestic terrorism, and the imperatives of prevention, mean that investigators and prosecutors who work domestic terrorism cases must focus on more common charges: weapons violations, illegal drug possession, burglary, aiding and abetting and so forth. But this was not enough to overrule the fear of domestic terrorism that was gripping the nation and that hung in the courtroom. It reflected the legal paradoxes of the case and domestic terrorism law in general or, maybe more accurately, the absence of it.

Companies Deutsche Bank AG FollowJan 23 (Reuters) - The U.S. Supreme Court on Monday turned away appeals by two former Deutsche Bank AG (DBKGn.DE) commodities traders convicted of manipulating precious metals prices by placing "spoof" orders. The pair were convicted in 2020 for carrying out what prosecutors said was a yearslong spoofing scheme between 2008 and 2013. Their trades created a false sense of supply and demand, and induced other traders to make trades they would otherwise not have made, prosecutors said. On appeal, Vorley and Chanu argued they had not made the kind of explicit false statements targeted by wire-fraud law. Circuit Court of Appeals in Chicago upheld the convictions last July, saying that "spoofing of this kind falls under the wire fraud prohibition."

LONDON, Jan 3 (Reuters) - Reinsurers are excluding Russia, Ukraine and Belarus from policies offered to their insurance clients and cutting back their exposure to U.S. hurricanes, a report from reinsurance broker Gallagher Re (AJG.N) showed on Tuesday. Reinsurers insure insurers and Jan. 1 is the most important date in the calendar for policy renewals. Some insurers have already backed away from providing cover in Russia, Ukraine and Belarus due to risk of sanctions or of steep losses. Without reinsurance, insurers are likely to be even more reluctant to provide cover for Russia or Ukraine, industry sources say. Aviation reinsurance rates rose by as much as 200% on Jan. 1 for some types of business, Gallagher Re said.

It is important for kids with strep to get care right away so they can start taking antibiotics like penicillin.

Nov 17 (Reuters) - Australia's top order fired in unison to secure a six-wicket win over England with Dawid Malan's career-best 134 for the tourists in vain as in the first one-day international on Thursday. David Willey's unbeaten 34 was the next highest score by an England batter as the tourists went on to post a decent 287-9 at the Adelaide Oval. A 147-run opening stand between David Warner (86) and Travis Head (69) effectively laid the platform for Australia's comprehensive victory. The teams move to Sydney for the second ODI on Saturday to be followed by the third and final match in Melbourne on Tuesday. Their agreement to talk again about climate thawed relations frozen earlier this year after U.S. House Speaker Nancy Pelosi angered China by visiting Taiwan. Teresa Ribera, Spain's climate minister, said she was hopeful that the rapprochement would energise negotiations. “This unequivocal signal from the two largest economies to work together to address the climate crisis is more than welcome; it’s essential," Bapna said. Heading into the last week of the two-week conference progress has been slow, frustrating negotiators who are struggling to find consensus on how rich countries should help developing nations meet the cost of climate-fuelled disasters. The outcome on that issue, referred to in climate talks as "loss and damage", could define the perceived success or failure of the COP27 talks.

Deutsche Bank joins recent industry criticism of ECB

FRANKFURT, Nov 9 (Reuters) - Deutsche Bank (DBKGn.DE) on Wednesday waded into the financial industry's criticism of the European Central Bank, with the German lender's finance chief saying authorities should do more to champion banks. The ECB and other parts of official sector "should be moving to championing the banks to help the economy rather than not," Chief Financial Officer James von Moltke said at a financial conference. Reporting by Tom Sims, Editing by Miranda MurrayOur Standards: The Thomson Reuters Trust Principles.
The European Central Bank (ECB), which supervises euro zone banks, believes some lenders have overly optimistic assumptions about the economy, based on models that cannot fully capture the damage from the current bout of inflation, the sources say. Source: S&P Global-EBAMorgan Stanley estimates euro zone banks will pay out 40 billion euros ($40 billion) in 2022 dividends plus an additional 60 billion euros in share buybacks between this year and next - an outsized return by recent standards. "It's not a good idea to pay out capital during a recession," Intesa's Chief Executive Carlo Messina told analysts last week. "With the economy entering recession, the time of massive bank payouts is over," Marco Troiano, a managing director at Scope Ratings, said. "Running down capital cushions would weaken banks."
Those are comments from one investment advisor despite lenders on the continent posting bumper third-quarter results this week. Barclays on Wednesday reported net profits of £1.5 billion ($1.73 billion), while Deutsche Bank revealed a net income of 1.12 billion euros ($1.11 billion). Deutsche Bank's net interest margin grew to 1.5% in the quarter, up from 1.4% in the prior quarter and from 1.2% in the year-ago period. But this income source for banks is unlikely to be long-lived as European capitals debate imposing a "windfall tax" on banks' profits. Hickmore said that senior debt from European banks is more attractive now as they are immune to many risks banks face.

And Italy's UniCredit (CRDI.MI) raised its 2022 profit goal, helped by higher interest rates and lower loan loss provisions that also drove quarterly earnings above forecasts. For years, banks bemoaned ultra loose monetary policy, but now higher interest rates means banks can start to benefit from the increased gap between what they charge borrowers and what they pay savers. Standard Chartered's third-quarter profit surged 40% as higher interest rates boosted the emerging markets-focused bank's income, giving it ammunition to upgrade its revenue outlook despite a weakening global economy. For Santander, higher loan loss provisions in key markets like Brazil and the United States overshadowed better than expected third-quarter earnings. While benefiting from higher interest rates, banks also face the unwinding of a scheme that buoyed their profits for years.
