CNN —Donald Trump is not immune from prosecution for alleged crimes he committed during his presidency to reverse the 2020 election results, a federal appeals court said Tuesday. The ruling is a major blow to Trump’s key defense thus far in the federal election subversion case brought against him by special counsel Jack Smith. “For the purpose of this criminal case, former President Trump has become citizen Trump, with all of the defenses of any other criminal defendant. But any executive immunity that may have protected him while he served as President no longer protects him against this prosecution,” the court wrote. Not protected under separation of powers clauseThe appeals court found that Trump is not protected from criminal prosecution under the separation of powers clause.

Trump has pledged to appeal and has until Monday to ask the Supreme Court to temporarily block the ruling. Perhaps to speed things along, the appeals court established a quick schedule for Trump to respond to Tuesday’s ruling, giving Trump until February 12 to file an emergency stay request with the Supreme Court. The Supreme Court, however, can take as long as it likes at each step. The cases are entirely separate – this is a criminal prosecution against Trump, and the upcoming Supreme Court case is a civil attempt to remove Trump from state ballots. Further, the appeals court’s findings and explanations in Tuesday’s ruling are not binding on the Supreme Court.

But it also sets the stage for additional appeals from the Republican ex-president that could reach the U.S. Supreme Court and result in further delays. The judges gave Trump until February 12 to ask the Supreme Court to pause the ruling. The appeals court took center stage in the immunity dispute after the Supreme Court in December said it was at least temporarily staying out of it, rejecting a request from Smith's team to take up the matter quickly and issue a speedy ruling. But the court could yet still decide to act on a Trump team appeal, adding to the uncertainty of a trial date. The high court declined the request, leaving the matter with the appeals court.

CNN —The Doomsday Clock that has been ticking for 77 years is no ordinary clock — it attempts to gauge how close humanity is to destroying the world. Last year the Bulletin set the clock at 90 seconds to midnight mainly due to Russia’s invasion of Ukraine and the increased risk of nuclear escalation. The clock isn’t designed to definitively measure existential threats, but rather to spark conversations about difficult scientific topics such as climate change, according to the Bulletin. Donald Trump’s victory in the Iowa caucuses was resounding enough to make the race for the Republican nomination look essentially finished at the start. But it wasn’t resounding enough to remove the sense that it could have been otherwise, that yet again his opposition within the Republican Party made things ridiculously easy for his candidacy. Trump is essentially running an incumbent’s campaign, presenting himself as the default leader of the party, declining to debate, rolling up endorsements. Eugene McCarthy’s 42 percent of the New Hampshire primary vote in 1968 forced Lyndon Johnson out of the race. Ted Kennedy’s 31 percent in Iowa and 37 percent in New Hampshire in 1980 betokened a long and bitter campaign for Jimmy Carter.

Despite what its marketing might suggest, “Mean Girls” (in theaters), the latest in a set of pink-accented nesting dolls, is irrefutably a movie musical. Adapted from the 2018 Broadway musical, which was itself based on the 2004 film, which was in turn inspired by the 2002 nonfiction book “Queen Bees and Wannabes,” this new version has singing. It has one delectable moment in which the members of the school marching band raise their saxophones and tubas high. Barring a split-second shot of the band, you wouldn’t know that from the film’s trailers. It was made to look instead like a vaguely edgier remix of the 2004 film.

The system, a rapid bus network called TransMilenio, rolled out in 2000. Its buses weren’t as big or as fast as trains, but they were up and running in a fraction of the time and at a vastly lower cost. The idea of rapid buses became the rage from Jakarta to Mexico City, and Enrique Peñalosa, the Bogotá mayor who cooked up the idea for TransMilenio, became a globe-trotting celebrity after his term ended. But there was another colorful character whose contributions to TransMilenio I had to leave on the cutting room floor. (He explained the dropping of his pants by citing the French sociologist Pierre Bourdieu’s concept of “symbolic violence.”)

NEW YORK (AP) — Denny Laine, a British singer, songwriter and guitarist who performed in an early, pop-oriented version of the Moody Blues and was later Paul McCartney's longtime sideman in the ex-Beatle's solo band Wings, has died at age 79. Laine, inducted five years ago into the Rock and Roll Hall of Fame as a member of the Moody Blues, died Tuesday in Naples, Florida. His death comes almost exactly 50 years after the release of McCartney's acclaimed “Band On the Run” album, on which Laine played guitar and provided backing vocals. The Moody Blues then turned to the ambitious, classically influenced sounds of “Nights in White Satin" and other songs. Founded in 1971, the year after the Beatles broke up, Wings went through various personnel changes over the following decade, with Laine, McCartney and McCartney's wife, Linda.

No one behind in the national polls by as much as Haley at this point in the primary calendar has ever ended up winning the nomination. A late October Des Moines Register poll had Trump at 43% to Haley and DeSantis each at 16% in Iowa. They both went on to win Iowa. Haley, however, doesn’t need to win Iowa to secure the GOP nomination. Hart’s overperformance in Iowa was a big reason he went to win the New Hampshire primary in 1984.

The Insurrection Act contains a number of provisions, and not all are equally bad. But the act gets worse, much worse.
