The new nine-month Supreme Court term officially starts Monday, with the justices appearing in the courtroom to hear oral arguments. Major cases at the Supreme Court: U.S. v. Skrmetti — Challenge to state laws that ban gender-affirming care for trans teenagers. When the Supreme Court decided Bush v. Gore, its reputation took a hit but quickly rebounded. Republicans challenged those changes, but the Supreme Court never took up a case about the issue at the time. The Supreme Court has relatively few cases of consequence on the argument calendar so far.

Special counsel Jack Smith, left, seen in Washington, D.C., on Aug. 1, and former President Donald Trump, seen in Palm Beach, Florida, on Nov. 8, 2022. WASHINGTON — The Supreme Court on Monday rejected an appeal brought by X, Elon Musk's social media company, declining to decide whether prosecutors should have been able to obtain data from former President Donald Trump's Twitter account without him being notified. The case arose as part of special counsel Jack Smith's investigation into Trump over alleged election interference in 2020, which the Supreme Court stymied earlier this year by ruling that presidents have broad immunity from prosecution for official acts taken in office. Smith has already obtained the data at issue in the appeal brought by X, as Twitter is now known following Musk's takeover of the social media company. A federal judge approved the warrant, as well as a nondisclosure order that prevents X from telling Trump or anyone else about it.

CNN —In his first appearance with Donald Trump on the campaign trail, billionaire Elon Musk on Saturday called on people to register to vote as he cast Democrats as a threat to democracy. “Register to vote, OK? Drag them to register to vote. There’s only two days left to register to vote in Georgia and Arizona. And then make sure they actually do vote,” Musk said at the former president’s rally in Butler, Pennsylvania.

Wearing a cap with the “Make America Great Again” slogan of Trump’s campaign, Musk appeared to acknowledge the foreboding nature of his remarks. It was the first time that Musk joined one of Trump's rallies and was evidence of their growing alliance in the final stretch of the presidential election. Trump has said he would tap Musk to lead a government efficiency commission if he regains the White House. Trump joined Musk in August for a rare public conversation on X, a friendly chat that spanned more than two hours. “If she comes up short in Michigan, I don’t think it’s because of young voters,” said Gray, a former co-president of the University of Michigan College Democrats who graduated in May. But young voters’ level of support is a big question for 2024 because of anger and disappointment with how the Biden-Harris administration has handled the Israel-Hamas conflict. In the two prior conversations, both said Biden’s age was a concern for many young voters who felt little connection to the octogenarian president. ‘We feel a sense of betrayal’The biggest risk for Harris is that young voters stay home, skip the presidential line on the ballot, or vote third party. Colorado and web designer Lorie Smith’s lawyers at conservative law firm Alliance Defending Freedom disclosed the accord in a court filing last week. Alliance Defending Freedom senior counsel Bryan Neihart in a statement on Monday said it was common for the prevailing party in a civil rights case to ask for and receive legal fees after winning in court. Arizona-based Alliance Defending Freedom is a faith-based legal advocacy organization that pursues lawsuits related to religious liberty. In Smith’s bid for fees, Alliance Defending Freedom said its $2 million request would reimburse them for 2,174.4 hours of work on the litigation. HOUSTON — A Black high school student in Texas who was punished for nearly all of his junior year over his hairstyle has left his school district rather than spend another year of in-school suspension, according to his attorney. It would allow him to return to school while a federal lawsuit he filed proceeds. George’s federal lawsuit also alleged that his punishment violates the CROWN Act, a recent state law prohibiting race-based discrimination of hair. In February, a state judge ruled in a lawsuit filed by the school district that its punishment does not violate the CROWN Act. Barbers Hill’s hair policy was also challenged in a May 2020 federal lawsuit filed by two other students.

Read previewAlex Jones' conspiracy theory empire Infowars will be sold off for parts to pay off a fraction of his massive court judgments — but it likely won't be the end of the far-right commentator. In a court hearing on Tuesday, a Texas bankruptcy judge announced that he will approve the auctioning off of Infowars' parent company, Free Speech Systems, which Jones fully owns, according to The Associated Press. The auction is a result of Jones agreeing in June to liquidate his assets after both he and Free Speech Systems filed separately for bankruptcy in 2022. Advertisement"It's very cut and dry that the assets of Free Speech Systems, the website, the equipment, the shopping cart, all that, can be sold," Jones said. The bankruptcy trustee overseeing Jones' assets said in court this week that some potential buyers have already expressed interest in getting a piece of Free Speech Systems, NPR reported.

Elon Musk purchased Twitter with a pledge to make it a bastion for free speech. AdvertisementA new "transparency report" from X might surprise anyone who has heard its owner, Elon Musk, talk about the importance of free speech. Three years after Musk took control of the company and rebranded it X, it has finally released a new transparency report. According to its transparency reports at the time, Twitter suspended almost 873,000 accounts in the last half of 2019. That number grew to about 1.3 million account suspensions in the latter half of 2021.

Jones’ personal social media sites, including his account on the social platform X, which has 2.8 million followers, would not be included. Murray also is expected to sell many of Jones’ personal assets. The Sandy Hook families who won the Connecticut lawsuit want Jones to lose his personal social media accounts. It’s unclear how much money would be raised by selling Infowars and Jones’ assets, and how much money the Sandy Hook families would get. If the debt is found to be valid, that could reduce any amount the Sandy Hook families ultimately get from the liquidations.

Anyone can place a bid for Infowars, including its dubious dietary supplement store, and use the property for any reason. Nothing would prevent him from continuing to broadcast under a new owner, although he would still need to pay off the debt he owes the Sandy Hook families with any earnings he may receive. There’s also nothing stopping Jones from continuing to speak about the Sandy Hook massacre or the families. The only way Jones would be prevented from speaking about Sandy Hook entirely is through a separate settlement with the families. But even if all of Jones’ personal intellectual property is sold off along with Infowars, it’s unlikely to make more than a small dent in the amount he owes the Sandy Hook families.

Two reports released Monday provide a mixed but compelling outlook on the wave of book removals and challenges as the annual Banned Books Week begins for schools, stores and libraries nationwide. The ALA attributed the decline in book challenges in the first eight months of 2024, in part, to the work of anti-censorship activists and “success in courts” against laws that restrict book access. “But, you know, the First Amendment protects the rights of minors as well.”While the ALA’s report shows signs of book challenges abating, objections to certain titles still persist. Like the ALA, PEN said a large portion of the books targeted have racial or LGBTQ themes. It is supported by the ALA, PEN, the Authors Guild, the National Book Foundation and more than a dozen other organizations.

The investigation sparked debate about free speech and criminal activity online, but the authorities’ concerns weren’t exactly a surprise. The Brazilian Supreme Court asked the social media platform Saturday to present documents validating its new legal representative in the country. X was shut down in Brazil in late August after it did not comply with orders from the top court related to hate speech moderation on the platform. X lawyers said late Friday that the platform had named a legal representative in Brazil, addressing a key demand imposed by the court. X had a legal representative in Brazil until mid-August, when it decided to close its offices and fire its local staff. It was not immediately clear which were the accounts X has been ordered to block, as the probe is confidential.
