FTC bans employers from using noncompete clauses

New York CNN —The Federal Trade Commission on Tuesday voted to ban for-profit US employers from making employees sign agreements with noncompete clauses. And – with one exception – it makes currently existing noncompete agreements unenforceable after the rule’s effective date, which is set at 120 days from the rule’s publication in the Federal Register. The rule, however, does allow currently existing noncompete agreements for senior executives to remain in force. The ban would apply nationwide, overriding state laws regarding noncompete agreements. In December of last year, New York State Governor Kathleen Hochul vetoed a bill passed by the state legislature to completely ban noncompete agreements in that state.

Trump nevertheless went after Cohen in remarks on camera after leaving court on Monday. Trump’s lawyers have argued that his social media posts do not actually violate the gag order. CNN —Former Trump Organization CFO Allen Weisselberg, who admitted to testifying falsely in Donald Trump’s civil fraud case, was sentenced on Wednesday to five months in jail on perjury charges. Weisselberg also admitted to testifying falsely at the civil fraud trial last fall but that is not among the charges to which he pleaded guilty. As part of the plea deal, prosecutors agreed to recommend Weisselberg serve a sentence of five months in jail. It is the second guilty plea by Weisselberg, who in 2022 pleaded guilty to 15 counts of tax fraud and testified in the trial of two Trump Org. Weisselberg was central to the financial dealings but neither prosecutors nor Trump’s attorneys said they plan to call him as a witness.

A judge on Wednesday rejected a last-ditch effort by former president Donald Trump to delay his hush money trial scheduled to begin in New York on April 15. Merchan, in shooting down that request, said Trump had "myriad opportunities" to make an argument that he was immune in the hush money case before March 7, when his attorneys first raised that claim. "Defendant's motion is DENIED as untimely," Merchan wrote in his decision issued in Manhattan Supreme Court, which is a trial-level court. Trump is charged in the case with falsifying business records related to a hush money payment to Daniels shortly before the 2016 presidential election. in his ruling, Merchan wrote that Trump's lawyers "fail to explain why Defendant waited long past" a statutory deadline of 45 days before trial to make a pre-trial motion seeking a delay.

State Bar Court of California Judge Yvette Roland's recommendation, issued Wednesday, now goes to the California Supreme Court for a final ruling on whether he should be disbarred.
