As his murder trial began in December 2009, Arvel Marshall made a desperate plea to his lawyer: Ask for surveillance videos of the Brooklyn street where he was accused of fatally shooting a 22-year-old man. Mr. Marshall’s lawyer made a halfhearted request for the footage. The prosecutor said initially that it did not exist, then that it was not accessible, and the judge moved the trial along. Mr. Marshall was convicted and sentenced to 25 years to life in prison. The video in question, captured from a nearby building, showed two men, neither of them Mr. Marshall, walking down a Crown Heights street toward where Moustapha Oumaria was sitting outside his home with three friends.

CNN —Former President Donald Trump recounted a story to reporters on Thursday about being involved in a helicopter emergency landing with former San Francisco Mayor Willie Brown. “I know Willie Brown very well. We were in a helicopter going to a certain location together, and there was an emergency landing,” Trump told reporters gathered at his Mar-a-Lago resort in Florida for his first news conference since the Democratic ticket was announced. CNN —Members of the grand jury in Arizona that indicted 18 allies of Donald Trump earlier this year for their alleged roles in attempting to overturn the 2020 election had also expressed interest in charging the former president, according to a new court filing. The interest was strong enough that it prompted the state’s lead prosecutor to request that the grand jury not indict the former president and give a PowerPoint presentation to explain his reasoning. Prosecutors cited two primary reasons for why the grand jury should not charge Trump: a lack of evidence and a US Justice Department policy they believe would hamper charges against a former president. The policy cited by prosecutors deals with DOJ guidelines limiting how the federal government can prosecute individuals already charged with similar crimes at the state level. That’s why you do not see that,” the state prosecutor told the grand jury.

But prosecutors had no direct evidence tying Black to the location of the murder, an Ohio appellate court later said. In many cases, prosecutors themselves don't even have access to the source code and haven't reviewed the underlying technology. Back in Akron, the judge in Rankin's case ordered the Cybercheck evidence excluded after prosecutors failed to turn over the source code. The Summit County Prosecutor's Office declined to comment when reached by BI. It's unclear how many others may be behind bars because of Cybercheck evidence that was never rigorously scrutinized.

After Donald Trump told journalists on Wednesday that his presidential opponent Kamala Harris “turned Black” for political gain, Trump’s comments have impacted the way many multirace voters are thinking about the two candidates. Some identify with Harris’ politics more than others but, overall, they told NBC News that Trump’s comments will not go unnoticed. She said she doesn’t support Harris’ past criminal justice policies as a district attorney and she doesn’t think President Joe Biden is doing enough to support Gaza. She uses everybody, including her racial identity!”Trump has relied on his familiar tactic of attacking Harris’ race and gender since Biden dropped out of the presidential race and endorsed Harris. But some have said Trump’s race- and gender-centered attacks may alienate women and voters of color.

Two special prosecutors said Monday they will file a criminal obstruction of justice charge against a former Kansas police chief who directed warrant searches of a publisher and his newsroom over its retrieval of public information. As of Monday, prosecutors hadn't filed any criminal charges against former Marion Police Chief Gideon Cody. It was not immediately clear if they would be seeking a felony or misdemeanor charge against Cody. Vice President Kamala Harris had a secret weapon on hand as she worked the phones in the hours after President Biden dropped his re-election bid and endorsed her. Tony West, her brother-in-law and the chief legal officer at Uber, was with Ms. Harris in the vice president’s residence when she received the news, and he spent the afternoon helping her reach out to would-be supporters. Since that Sunday, Mr. West has emerged as a major force behind Ms. Harris’s campaign and its record-setting fund-raising, but also as a concern for some progressives who want her to take a hard line against big business. Ms. Harris’s campaign brought on several senior political operatives on Friday, some of whom worked on former President Barack Obama’s campaigns, to add to the team that had been assembled to re-elect Mr. Biden. But none has the advantage of family ties like her brother-in-law, who has held top positions in the Justice Department and corporate America while advising Ms. Harris’s campaigns since she ran for San Francisco district attorney in 2003.

The Summary Many young climate advocates see Kamala Harris as stronger on environmental issues than Joe Biden. President Joe Biden may have passed the United States’ most significant climate legislation ever, but many young environmental activists say they see Kamala Harris as stronger on the issue. But several young climate activists ages 16 to 29 said for them, the expansion of the fossil fuel industry during Biden’s presidency has clouded those successes. Harris’ young supporters have highlighted the settlements she secured as California attorney general with Chevron, BP and ConocoPhillips over their handling of hazardous materials. Sunrise Movement protesters gather near Vice President Harris' Brentwood home on April 14, calling on her to urge President Biden to declare a climate emergency.

Four teenagers accused of fatally beating a classmate last year in Las Vegas have agreed to plead guilty to voluntary manslaughter, which will keep them from being tried as adults, attorneys confirmed Thursday. Attorney Robert Draskovich represents one of the four teens charged in the beating. Draskovich said his client agreed to plead guilty in a deal that would crumble if one of the defendants involved changes their plea. Mellisa Ready, Lewis’ mother, told NBC affiliate KMCC of Las Vegas on Thursday that she was “dumbfounded” and "in shock" by the plea agreement. After all, the last time a guy named Shapiro had been elected governor of Pennsylvania, he had years earlier anglicized his name to Shapp. “I’m not aware of how his position on Israel differs from the other potential vice presidents,” Hawaii Sen. CNN —A New York appeals court has rejected Donald Trump’s attempt to lift a gag order that continues to restrict his public statements in the wake of his New York criminal conviction. As it stands, the gag order bars Trump from publicly discussing the prosecutors, court staff and their families. In the decision filed Thursday, a panel of judges from the Appellate Division First Department said Judge Juan Merchan can keep the gag order in place through Trump’s sentencing. “Contrary to petitioner’s contentions, the People’s evidentiary submissions in opposition to his motion in Supreme Court demonstrate that threats received by District Attorney staff after the jury verdict continued to pose a significant and imminent threat,” the appeals court ruled. Trump’s sentencing, which was originally scheduled for July, was delayed to mid-September while Merchan considers his motion to toss the conviction in the wake of the US Supreme Court’s presidential immunity decision.
