MONTGOMERY, Ala. (AP) — A Black riverboat co-captain at the center of an Alabama riverfront brawl that drew national attention has been accused of misdemeanor assault in the melee by one of the white boaters charged in the fight. The co-captain faces a charge of misdemeanor assault, according to court records. The complaint was filed Oct. 26 ahead of the man's Nov. 16 trial on a misdemeanor assault charge of hitting and kicking the riverboat co-captain. The August riverfront melee in Montgomery drew national attention after bystanders filmed white boaters hitting a Black riverboat co-captain and others rushing to his defense. Two white boaters previously pleaded guilty to charges of misdemeanor assault or harassment.

The Justice Department filed a statement of interest in consolidated lawsuits against Alabama Attorney General Steve Marshall seeking to block him from using conspiracy statutes to prosecute people who help Alabama women travel to obtain an abortion. Alabama bans abortion at any stage of pregnancy with no exceptions for rape and incest. The Justice Department argued in the filing that the U.S. Constitution protects the right to travel. The two Alabama lawsuits seek a ruling clarifying that people and groups can provide assistance to women leaving the state for an abortion. In a July statement issued when the lawsuits were filed, his office said it would enforce the state's abortion ban.

CNN —Alabama has scheduled the nation’s first execution by nitrogen hypoxia, an alternative to lethal injection, its Republican governor said. He asked the state to be put to death by nitrogen gas rather than lethal injection after what he called a botched execution. Smith’s execution now is set to take place between January 25 and 26, according to a news release from Gov. The court’s action came after the justices divided 6-3 earlier in the term to allow Smith’s execution to go forward by lethal injection. Smith’s case was tried by a jury twice, Alabama Attorney General Steve Marshall has noted, both of which resulted in convictions.

Under North Dakota’s law, health care providers can be charged with a felony for performing gender affirmation surgeries on minors, punishable by up to 10 years’ imprisonment and/or a $20,000 fine. Opponents said such surgeries are not performed on minors in North Dakota, and that the ban on gender-affirming care would harm transgender youth, who are at increased risk for depression, suicide and self-harm. The law exempts minors who were already receiving gender-affirming care, and allows for the treatment of “a minor born with a medically verifiable genetic disorder of sex development." More than 3,700 babies were born with congenital syphilis in 2022 — 10 times more than a decade ago and a 32% increase from 2021, the Centers for Disease Control and Prevention said Tuesday. The 2022 count was the most in more than 30 years, CDC officials said, and in more than half of the congenital syphilis cases, the mothers tested positive during pregnancy but did not get properly treated. The rise in congenital syphilis comes despite repeated warnings by public health agencies and it’s tied to the surge in primary and secondary cases of syphilis in adults, CDC officials said. It’s also been increasingly difficult for medical providers to get benzathine penicillin injections — the main medical weapon against congenital syphilis — because of supply shortages. Nearly 40% of last year’s congenital syphilis cases involved mothers who didn't have prenatal care, the CDC said.

The FSIS said that Tyson had recalled around 29,819 pounds of the dinosaur-shaped nuggets, which is around 16,500 packets. In September, the US Department of Labor announced they were investigating Tyson Foods and Perdue Farms, another major poultry producer, over the reports. The Tyson family has become one of the country's richest families, but Tyson Foods announced earlier this year that it was shutting four of its chicken plants as it sought to cut costs amid falling demand.

Tyson Foods is recalling nearly 30,000 pounds (13,600 kilograms) of breaded chicken ""Fun Nuggets'' after consumers complained of finding metal pieces in the dinosaur-shaped patties. Tyson informed the U.S. Department of Agriculture's Food Safety and Inspection Service and said it recalled the nuggets voluntarily “out of an abundance of caution.'' USDA said that there had been only one report of a ”minor oral injury associated with consumption of this product.'' They were shipped to distributors in Alabama, California, Illinois, Kentucky, Michigan, Ohio, Tennessee, Virginia and Wisconsin to be passed on to retailers. The USDA urged consumers with the nuggets in their freezers to throw them out or return them to the place of purchase.

New York CNN —Tyson Foods is voluntarily recalling about 30,000 pounds of its dino-shaped chicken nuggets after some consumers reported finding small metal pieces in their patties. The recall, announced on Saturday, is for 29-ounce plastic bag packages containing frozen, “fully cooked fun nuggets breaded shaped chicken patties,” according to the US Department of Agriculture’s Food Safety and Inspection Service. There has been “one minor oral injury” associated with consumption of the nuggets, according to the USDA, but no other reports of harm so far. But officials at the agency said they were concerned consumers may still have bags of the recalled “fun nuggets” in their freezers, and advised anyone who does should discard or return the product immediately. Tyson advised purchasers and consumers of recalled nuggets to cut the UPC and date code from the packaging and call or text 1-855-382-3101.
