Opinion | Why Jan. 6 Wasn’t an Insurrection
  + stars: | 2024-01-12 | by ( Ross Douthat | ) www.nytimes.com   time to read: +2 min
I’ve written several times about the case for disqualifying Donald Trump via the 14th Amendment, arguing that it fails tests of political prudence and constitutional plausibility alike. But the debate keeps going, and the proponents of disqualification have dug into the position that whatever the prudential concerns about the amendment’s application, the events of Jan. 6, 2021, obviously amounted to an insurrection in the sense intended by the Constitution, and saying otherwise is just evasion or denial. Such a limitation, they say, ignores all the obvious ways that lesser, less comprehensive forms of resistance to lawful authority clearly qualify as insurrectionary. I have a basic sympathy with Calabresi’s suggestion that the “paradigmatic example” that the drafters of the 14th Amendment had in mind should guide our understanding of its ambiguities, and since the paradigmatic example is the Civil War, in which hundreds of thousands of people were killed, a five-hour riot probably doesn’t clear the bar. (For related arguments about the perils of applying precedents from specific crises to radically different situations, see this essay from Samuel Issacharoff as well.)

COMEDY BOOK: How Comedy Conquered Culture — and the Magic That Makes It Work, by Jesse David FoxOUTRAGEOUS: A History of Showbiz and the Culture Wars, by Kliph NesteroffDid you hear the one about cancel culture? But two new books share an exasperation with the common sentiment that there’s never been a worse time to express oneself than the present. Kliph Nesteroff’s fact-packed “Outrageous: A History of Showbiz and the Culture Wars” finds American entertainers in a perpetual state of despair over the censorious climate of their day — whatever day it happens to be. To Jesse David Fox, the author of “Comedy Book,” the risk of backlash is part of the point. It’s what makes it more exciting than watching a bunch of men sprinting with helmets on.”

NEW YORK (AP) — The irreverent feminist website Jezebel is making a comeback less than a month after it was shut down. Paste Magazine, a digital pop culture publication based in Atlanta, announced Wednesday that it was buying Jezebel.com from G/O Media, which closed it and laid off its staff earlier this month. Like many other digital publications, however, Jezebel struggled in recent years to find a sustainable business model as digital advertising plummeted. Paste said Jezebel's “acquisition is poised to bring together the strengths of Paste Magazine’s established presence in the media landscape with Jezebel’s influential position in addressing contemporary issues.”Paste did not immediately return an e-mail seeking further details. The New York Times reported that Paste is searching for a new editor-in-chief for Jezebel before hiring writers.

In yet another sign of its decline, Popular Science has stopped publishing its online magazine, three years after it shut its storied print edition, which began in 1872. Popular Science will continue to publish articles and videos on its website, and will still produce its podcast, “The Weirdest Thing I Learned This Week.”But its digital magazine, which was published quarterly since it began in 2021, has ceased publication and will no longer charge for subscriptions, according to Recurrent Ventures, the magazine’s parent company. Its last online issue, titled “Fake,” was published in September and featured articles about taxidermy, artificial intelligence and fake crystals.

Three years ago, journalists at Sports Illustrated were worried that the venerable magazine’s new owners and operators were drastically lowering its standards. On Monday, the science and technology publication Futurism reported that Sports Illustrated had published product reviews under fake author names with fake author biographies. “If true, these practices violate everything we believe in about journalism,” the union representing Sports Illustrated journalists said in a statement after the report was published. “We deplore being associated with something so disrespectful to our readers.”The Arena Group, which publishes Sports Illustrated under a complicated management structure, blamed a vendor, AdVon Commerce, for the situation. Sports Illustrated licenses product reviews from AdVon, and AdVon assured the Arena Group that “all of the articles in question were written and edited by humans,” said Rachael Fink, an Arena Group spokeswoman.

CNN —The most famous relationship in the world right now has the stamp of approval from the National Football League’s (NFL) commissioner. Roger Goodell, who has served as commissioner since 2006, appeared on CBS Mornings ahead of the NFL’s Thanksgiving games and discussed the superstar pairing of singer Taylor Swift and Kansas City Chiefs tight end Travis Kelce. In October, Kelce and his brother said in their podcast that the NFL was “overdoing it a little bit” on social media regarding the romance between the pop star and the Chiefs tight end. I think it brings a little bit more to the atmosphere, brings a little bit more to what you’re watching. Kelce and Kansas City, who have a 7-3 record heading into Week 12 of the NFL regular season, will take on the Las Vegas Raiders at Arrowhead Stadium on Sunday.

Words Without Borders, one of the few magazines in the world dedicated to literature in translation, is turning 20 at a fraught time: Around the world, wars are raging. Writers are being jailed, dissident voices silenced and books banned. The answer, said Karen M. Phillips, the magazine’s executive editor and publisher, was right there, baked into their mission — to gather and celebrate international literature, and in doing so, strengthen the connection between readers and writers around the world. “Literature is a really powerful space for imagining new ways forward, or thinking through situations that are impossible if you take them head on as facts,” she said. “We’re always publishing contemporary writers who are reflecting, through their literature, the events and crises of the world.”
