Under a 1974 federal law that governs retirement accounts, employers have a duty to manage 401(k) plans in the best interest of employees, including to vet the investments and fees. Known as Erisa, the law also imposes this fiduciary standard on advisers to act in a client’s best interest when giving advice in 401(k)s.

The DOL’s proposed rule seeks to ensure “all retirement investors receive the same quality of investment advice regardless of product or services,” said DOL Acting Secretary Julie Su in a call with reporters. NEW YORK (Reuters) -The judge overseeing Donald Trump’s civil fraud trial on Tuesday imposed a gag order - promising sanctions for any violations - after the former U.S. president used social media to lash out against the judge’s top law clerk. The trial could lead to the dismantling of Trump’s business empire as he seeks to regain the presidency in 2024. Engoron had ruled before the trial that Trump committed fraud, and canceled business certificates for companies that control crown jewels of Trump’s portfolio, including Trump Tower and 40 Wall Street in downtown Manhattan. The trial will review six additional claims including falsifying business records, insurance fraud and conspiracy, and address how much the defendants should pay in penalties. He also faces a January civil damages trial for defaming a writer who accused him of rape, which he denies.

That should be no surprise considering that a consistent proponent of this inquiry was former President Donald Trump. I make that judgment based on my work as a scholar of impeachment and also as a practitioner who helped lead the first Trump impeachment and trial as counsel to the House Judiciary Committee. McCarthy bitterly — and now hypocritically — criticized former Speaker Nancy Pelosi for announcing the first Trump impeachment before a vote (she later scheduled one). Given that, Trump’s lawyers may well advise him to stay off the witness stand and avoid the risks of cross examination — but demure silence is hardly in his nature.
