Senate Minority Leader Mitch McConnell, R-Ky., suggested Wednesday that the Supreme Court should punish at least two Democratic senators over their calls for Justice Samuel Alito to recuse himself from key cases related to former President Donald Trump. Richard Blumenthal of Connecticut and Sheldon Whitehouse of Rhode Island are bound by court rules that "provide for discipline against those who engage in conduct unbecoming an officer of the court," McConnell said on the Senate floor. But McConnell singled out Blumenthal and Whitehouse because they are members of the Supreme Court bar. They are therefore "potentially engaged in unethical professional conduct before the court," McConnell said of Blumenthal and Whitehouse, both of whom are members of the Senate Judiciary Committee. CNN —Special counsel’s office prosecutors on Friday asked a federal judge in Florida to place a gag order on Donald Trump that would limit his ability to comment about law enforcement that searched his Mar-a-Lago resort. The same standard FBI policy was used in the searches of President Joe Biden’s homes and offices in a separate classified documents investigation. The prosecutors say the gag order is needed to protect the integrity of the criminal case and law enforcement officers associated with it. Prosecutors noted that Trump has been amplifying accusations about the FBI in the search on his Truth Social account Friday. In a notably direct pushback to Trump, Attorney General Merrick Garland on Thursday addressed the claims that Trump has made about the FBI search at Mar-a-Lago.

A state ethics panel quietly dismissed a complaint last summer against the New York judge presiding over the criminal trial of Donald J. Trump, issuing a warning over small donations the judge had made to groups supporting Democrats, including the campaign of Joseph R. Biden. The judge, Juan M. Merchan, donated a total of $35 to the groups in 2020, including a $15 donation earmarked for the Biden campaign, and $10 to a group called “Stop Republicans.”Political contributions of any kind are prohibited under state judicial ethics rules. “Justice Merchan said the complaint, from more than a year ago, was dismissed in July with a caution,” the spokesman for the court system, Al Baker, said in a statement. A caution does not include any penalty, but it can be considered in any future cases reviewed by the state’s Commission on Judicial Conduct. A letter outlining the caution was not released because of the commission’s rules, and Justice Merchan did not make the letter available.

CNN —The Biden administration plans to speed up court cases for some recently arrived migrants who are seeking asylum, marking the latest move to address arrivals at the US-Mexico border, according to senior administration officials. The Department of Homeland Security and Justice Department announced Thursday a new court docket targeting migrants who have unlawfully crossed the US southern border. Cases can often take years because of an immigration court backlog, prompting the effort to set up a process intended to expeditiously work through cases. The immigration court backlog exceeds 3 million pending cases, according to Syracuse University’s Transactional Records Access Clearinghouse or TRAC, which tracks immigration court data. “We’ve identified judges who have availability to manage to do these and manage along with all the existing work that they’re doing,” the senior administration official said.

CNN —A few weeks ago, I gave the keynote speech at an inaugural conference on Black literacy exploring what the organizers called an “alarming literacy gap” between Black students and their peers. The White students even had their prom at the local country club while the Black students’ prom was held in the school gym. And since schools with high numbers of poor Black and Brown students tend to be drastically underfunded the correlation between poverty and lower academic achievement is hardly surprising. More than two-thirds attend schools in which only a minority of students are eligible for FRPL, schools where better funding and opportunities mean better outcomes. Research shows that integration raises the attainment levels of all students — not just those who are Black, Brown and poor.

The Major Supreme Court Cases of 2024No Supreme Court term in recent memory has featured so many cases with the potential to transform American society. In 2015, the Supreme Court limited the sweep of the statute at issue in the case, the Sarbanes-Oxley Act of 2002. In 2023, the Supreme Court temporarily blocked efforts to severely curb access to the pill, mifepristone, as an appeal moved forward. A series of Supreme Court decisions say that making race the predominant factor in drawing voting districts violates the Constitution. The difference matters because the Supreme Court has said that only racial gerrymandering may be challenged in federal court under the Constitution.
