CNN —The Arizona Senate on Wednesday will vote on legislation to repeal the state’s 160-year-old near-total abortion ban, three weeks after the state Supreme Court revived the law and thrust reproductive rights into the political spotlight. Katie Hobbs signs it, as expected, it would clear the way for the state’s 15-week limit to remain state law. On April 9, the state Supreme Court ruled that the ban should be the state law. Abortion rights advocates are also gathering signatures for a ballot initiative to enshrine abortion rights into the state constitution. Several Arizona House members, including House Speaker Ben Toma, spoke out against the repeal last week.

The Supreme Court denied military chaplains' lawsuit claiming retaliation for refusing the COVID-19 vaccine. The appellate court ruled that the Defense Department's decision in January 2023 to rescind the vaccine mandate rendered the chaplains' case moot. CNN —A stricter abortion law is set to take effect in Florida on Wednesday — dropping the state’s 15-week ban to a six-week ban — and it will likely affect thousands of people seeking abortion care within the first month alone. In Texas, the number of abortions provided within the formal health-care system dropped by about half after a six-week abortion ban took effect in 2021, and there were thousands more births than expected in the following year. Florida will join Georgia and South Carolina with a six-week ban. The Tampa Bay Abortion Fund anticipates that at least 90% of people who call their hotline will be impacted by a six-week abortion ban and will need to seek abortion care outside of Florida. The six-week ban will only exacerbate those barriers in the cruelest fashion,” Kris Lawler, president of the Tampa Bay Abortion Fund Board said in a statement.

Overall, 92% of Republicans call Trump’s time in office a success, while just 73% of Democrats say Biden’s has been a success so far. Among independents, 51% say Trump’s presidency was successful, while only 37% see Biden’s as a success. Those voters who say the economy is deeply important break heavily for Trump in a matchup against Biden, 62% to 30%. In the Biden vs. Trump matchup, the poll finds Biden faring worse than in previous CNN polls among the youngest voters, trailing Trump by a 51%-to-40% margin among voters younger than 35. Prosecutors have framed the trial as more than a simple case of falsifying business records — the offense with which Trump has been charged. But the results of Trump’s pending cases — and whether they even come to trial — could help decide the tone of a future presidency. But at the same time, Trump is using the privileges of appeals available to any defendant to their full extent. “We’re writing a rule for the ages.”It’s always hazardous to speculate how Supreme Court justices will rule based on their questioning in oral arguments. This could mean the case returns to lower courts for more litigation — a move that could delay the federal election trial for months, far beyond the November election.

CNN —Searching for some evidence that the Founding Fathers would have supported “absolute immunity” from criminal prosecution for former President Donald Trump, his lawyers have turned to George Washington. Washington’s thought does not end where Trump’s lawyers put the period. In his farewell address, the first president advised his fellow citizens that “Religion and morality” were the “great Pillars of human happiness, these firmest props of the duties of Men and citizens." Another Washington historian, Alexis Coe, who wrote a recent biography, described the Trump lawyers’ view of Washington’s farewell address as “bonkers.” She thinks that rather than trying to seek exemption from laws, Washington would find ways around them. Anything that delays Trump’s prosecution is a clear win for the former president, who is playing for time until the November election.

CNN —The Arizona House of Representatives voted Wednesday to overturn the state’s 160-year-old abortion ban, setting the stage for a repeal that would leave the state’s 15-week restriction on the procedure in place. The vote comes after two failed attempts by state House lawmakers to bring the bill to the floor last week. If it succeeds, Arizona’s 15-week restriction on abortions will continue to be state law. That legislation stated explicitly that it did not overrule the 1864 law. Arizona state Rep. Stephanie Stahl Hamilton, left, hugs Arizona state Sen. CNN —The fertility rate in the United States has been trending down for decades, and a new report shows that another drop in births in 2023 brought the rate down to the lowest it’s been in more than century. But Donald Trump’s return to his hush money trial Thursday does not even represent the most critical courtroom drama of his day. Trump blames Judge Juan Merchan for dashing his hopes of being at the Supreme Court Thursday. Trump’s Supreme Court gambit is also part of his wider campaign strategy. Merchan didn't hit Blanche as hard as a federal judge in Manhattan has hit Trump lawyer Alina Habba for her lawyering. During the E. Jean Carroll defamation trial in January, Judge Lewis Kaplan bench-slapped Habba 14 times during a single day of testimony. "Please direct me to the portion of the original gag order, or the subsequent gag order, where it makes any exception if Mr. Trump feels he is under attack. The judge told Blanche to file a response, in writing, explaining why Trump should not be held in contempt for violating the gag order. First, the conventions of the criminal trial – like those in thousands of courtrooms every day – mean this case will grind on relentlessly. In previous civil trials, Trump challenged the dignity of the rule of the court and feuded with other judges. But potential jurors appeared to take their obligation deeply seriously. But other potential jurors said they’d be able to put any political feelings about Trump to one side and focus on the evidence and the law. And in another revealing trend that hinted at the ex-president’s political appeal, some potential jurors mentioned that they viewed his rhetorical eruptions as those of someone who speaks his mind, unlike conventional politicians.

CNN —A federal appeals court ruled Tuesday that West Virginia cannot enforce its anti-transgender sports ban against a 13-year-old girl, dealing a blow to one of nearly two dozen such laws enacted by GOP-led states in recent years. We hold it cannot,” Circuit Judge Toby Heytens wrote in the decision, which was joined by Judge Pamela Harris. Signed into law by West Virginia Republican Gov. The court’s majority said the law violates Pepper-Jackson’s rights under Title IX, a federal law that prohibits discrimination on the basis of sex at schools that receive federal aid.
