A Manhattan federal judge said in an opinion that cryptocurrencies are considered securities regardless of how they are sold. U.S. District Judge Jed Rakoff's decision Monday complicates SEC's litigation with both Ripple and crypto exchange Coinbase. The Ripple ruling was considered a win by the industry because it said a cryptocurrency may or may not be a security depending on who's buying it. The SEC has argued in cases against Binance, Coinbase and Kraken that many cryptocurrencies listed on popular exchanges are securities. The SEC has pursued numerous other crypto firms over the alleged unregistered offer and sale of securities, including Coinbase , Gemini and Genesis.

Bitcoin made a stunning jump in the first half of 2023, hitting $30,000 again for the first time in months. Five market experts responded to CNBC questions via email, and three said they expect bitcoin to reach the $50,000 level by the end of 2023. That is a net annual reduction in selling of BTC 250,000 — a large number relative to bitcoin market turnover." "We previously predicted that this driver would add USD 10,000 to the bitcoin price," he added. Mobius said he expects bitcoin to climb to $40,000 by the end of 2023, citing investor "belief" in the digital coin.

"DEI leaders are facing extreme fatigue and burnout," says Chandra Robinson, vice president in the Gartner HR practice. "Unfortunately," she says, "with so much attention paid to DEI, undue pressures are put on DEI leaders to make progress" quickly. Half of DEI leaders say their biggest challenge is when other leaders fail to take ownership for driving diversity outcomes, and one-third say they have limited power to effectively drive change, according to a 2022 Gartner survey of 181 DEI leaders. Black women are more likely than women overall to aspire to executive roles, according to the joint Lean In and McKinsey "Women in the Workplace" report. But they also face more barriers to advance in their career: Black women leaders are more likely to be undermined at work, and 1 in 3 Black women leaders says they've been denied or passed over for opportunities because of personal characteristics, including their race and gender.

The Museum of Contemporary Art Chicago and the educator Romi Crawford have become partners in a new program that focuses on pairing instruction by artists of color with hands-on learning by students working alongside them. This intensive, semester-long course, which its founders announced on Monday, is called the New Art School Modality and will start in September at the museum. Traditional models of art education have become increasingly endangered as trusted schools — from the San Francisco Art Institute to the Watkins College of Art in Nashville — have fallen into bankruptcy or merged with larger institutions. The New Art School Modality is intended to create a sweet spot in academia. “The flashing words are experimentation and improvisation,” said Crawford, 56, an art historian at the School of the Art Institute of Chicago.

Joseph Pedott, whose decades of commercials for the zany plantlike figurines known as Chia Pets launched them into the pantheon of American consumer culture, died on June 22 in San Francisco. The origins of the Chia Pet’s popularity can be traced to March 1977, when Mr. Pedott (pronounced PEE-dot), an independent advertising executive, wandered around a Chicago home and housewares trade expo looking for new clients. “He said, ‘There’s this stupid item called the Chia Pet. I don’t know why anybody buys it,’” Mr. Pedott later recalled. The sales executive faxed Mr. Pedott a picture of the stupid item in question.

One of the world's oldest spirits is making a comeback

The anise-flavored liquor is one of the oldest spirits in the world. He noted that it’s still common for Middle Eastern restaurants to stock European wines rather than traditional spirits like arak. He was experimenting to refine the production of al-kohl, a traditional form of eyeliner, according to Arak Muaddi, a Palestinian craft distillery. Nader Muaddi, the founder of Arak Muaddi, explained that producing arak starts with creating wine. The Middle East has “a very rich history of making wine and spirits, and it’s about time that we share it with the world,” Muaddi went on.

Who is Mr. Prigozhin? Europe and the United States have been trying to shut down Prigozhin’s sprawling business operations for years. On the F.B.I.’s most wanted list, Mr. Prigozhin rose quickly in Putin’s Russia — from being the president’s favored caterer to winning major contracts that bankrolled Wagner Group, his private mercenary operation. Mr. Prigozhin also relies on a global network of corporate lawyers to fend off Western authorities, according to a separate F.T. Bill Browder, a former investor in Russia who has become one of Mr. Putin’s biggest critics, told DealBook that the president would look to reassert his authority by whatever means necessary.

"Terra Nova," a time-traveling epic about what would happen to Earth if it becomes too populated, was canceled after just one season, leaving viewers to wonder what became of the citizens of Terra Nova. Essentially, the Earth will become overcrowded and almost inhospitable by the mid-22nd century, so technology was developed to help citizens travel back 85 million years to inhabit the untouched Earth in a settlement called Terra Nova. The series' sole season ended in 2011 with the main character, Jim, destroying the portal to the past and narrowly making it back to Terra Nova. What would that mean for the people of Terra Nova? Fans will never know since Fox canceled the show soon after, Entertainment Weekly reported.

The goal was to restore one of the Ozarks’ rarest ecosystems, a type of dry, rocky grassland known as a glade. To bring back the grass, we had to clear it of trees. Under the trees’ dense canopy, the native grassland species couldn’t thrive. If the glade had remained covered in trees for a couple more decades, it might have been too late. But with the tree cover gone and sunlight pouring in, woodland species are now giving way to the grassland species.

Nearly eight miles north of Times Square, the United Palace in Washington Heights is a dazzling remnant of a golden age of cinema. On Sunday, it will provide the backdrop for Broadway’s biggest night. This former Loew’s “Wonder Theater,” at Broadway between 175th and 176th Streets, is beguiling, if mysterious. Its landmark exterior — where pigeons make themselves at home among terra-cotta ziggurats and pilasters — is said to have been influenced by Egyptian, Aztec or Mayan design, or perhaps the architecture of the 16th- to 18th-century Mughal Empire.

Cryptocurrency prices dropped Monday after the U.S. Securities and Exchange Commission charged Binance, the largest crypto exchange in the world, with violating securities laws. Binance Coin , a token used to pay transaction and trading fees on the Binance exchange, tumbled 9.5%. The declines came after the SEC alleged Binance and its co-founder, Changpeng Zhao, comingled billions of dollars of investor funds with their own and violated securities laws. "Any regulatory action against a major player in the cryptocurrency space creates uncertainty and leads to increased market volatility in the short term. Bitcoin last week capped its worst month of trading since November, finishing May down 7.9% after trading in a narrow range of between $26,000 and $28,000.

Venice, Italy CNN —Until recently, the Venice Architecture Biennale — arguably the world’s largest architecture exhibition — has drawn crowds for its (mainly Western) star appeal. In a May 20 Facebook post titled “Venice Biennale Blues,” Zaha Hadid Architects’ principal, Patrik Schumacher, wrote that “the ‘Architecture’ Biennale is mislabeled and should stop laying claim to the title of architecture. The German pavilion, which is displaying construction waste produced by 2022’s Venice Art Biennale is a case in point. The German Pavilion at the 18th Architecture Biennale is displaying and repurposing constuction waste from the city's Art Biennale last year. From 1880s Brooklyn, the Weir Greenhouse Returns
  + stars: | 2023-05-19 | by ( John Freeman Gill | ) www.nytimes.com   time to read: +1 min
By 2011, vandals and a century-plus of weather had rendered the fragile greenhouse a virtual ruin. Many of its badly rotting ground-floor window frames had been kicked in by marauding thieves. Leaking and missing window panes abounded, with repair estimates topping $1 million. Although the hothouse was a city landmark, it was at risk of presiding over its own funeral. But in 2012, Green-Wood Cemetery swooped in to rescue it, buying the decaying treasure for $1.63 million from McGovern Florists, a flower-selling family with deep Brooklyn roots that had owned the place for 41 years.
Trading in cryptocurrencies is akin to gambling and should be treated as such, British lawmakers said. Unbacked tokens like bitcoin and ether aren't underpinned by underlying assets and have "no intrinsic value," lawmakers on the U.K. Treasury Select Committee said in a report published Tuesday. The Treasury committee said it was concerned by government proposals to regulate consumer crypto trading as a financial service. This, lawmakers said, would create a "halo" effect that leads people to believe crypto trading is safe and protected, when this is not the case. Blair Halliday, U.K. managing director for top U.S. crypto exchange Kraken, said: "We fundamentally disagree with the Treasury Select Committee's conclusion that cryptoassets have no intrinsic value.
The Tiny Craft Mapping Superstorms at Sea Shortly after dawn on Sept. 30, 2021, Richard Jenkins watched a Category 4 hurricane overrun his life’s work. That August, a sister ship, SD 1031, successfully entered Tropical Storm Henri, but only in its early stages. Hurricane research, modeling and forecasting requires many terabytes of data for every square mile the storm passes through, including vitally important sea-level data from inside a storm. The next day, the depression was upgraded to a tropical storm and officially given the name Sam. And four months later, Tropical Storm Megi killed more than 150, wiped out several villages with landslides and displaced more than a million people.

Buying tether and bitcoin is really a vote against the U.S. system," says Jensen. The CEO of cryptocurrency exchange Coinbase , Brian Armstrong, doubled down on his criticisms of the U.S. Securities and Exchange Commission chief Gary Gensler Monday, but added the exchange would not leave the U.S. despite the regulatory uncertainty the company is facing in the country. At the heart of the regulator's dispute with Coinbase, and a host of other crypto companies, is the allegation that it is selling unregistered securities to investors. "The SEC is a bit of an outlier here," Armstrong told CNBC's Dan Murphy in an interview in Dubai Monday. "There's kind of a lone crusade, if you will, with Gary Gensler, the chair there, and he has taken a more anti-crypto view for some reason." "I don't think he's necessarily trying to regulate the industry as much as maybe curtail it.
