FBI agents on Thursday arrested an Alabama man for his alleged role in the Jan. 9 hack of the Securities and Exchange Commission's X account, which sent the price of bitcoin spiking by more than $1,000, the Department of Justice announced. The tweet said, "Today the SEC grants approval for #Bitcoin ETFs for listing on all registered national securities exchanges." Shortly afterward, the SEC regained control of its social media account, and announced the tweet was false and the result of a hack. A day after the hack, the SEC approved rule changes that allowed the creation of bitcoin ETFs in the United States. ISIS-K, the Afghan branch of the Islamic State, directed an Afghan man’s foiled U.S. Election Day terror plot, according to two senior U.S. officials briefed on the matter. The revelation that a foreign terrorist organization was in communication with a would-be attacker inside the U.S. makes the alleged Election Day plot different from most terrorism cases in the past decade, most of which involved people self-radicalized online or self-directed attempts. The charging documents say Tawhedi told the FBI that he was communicating with a person named “Malik” and that he knew “Malik” was affiliated with ISIS. Philip Esformes, whose 20-year prison sentence for a massive, $1.3 billion Medicare fraud scheme was commuted in 2020 by then-President Donald Trump, was arrested over the weekend in Florida on domestic-violence related charges. Esformes is at least the seventh person who received executive clemency from Trump, and has since been charged with new crimes, according to The New York Times, which first reported this latest arrest. Court records show that Esformes was arrested Saturday and then charged with tampering with a victim or witness, and with criminal mischief involving property damage. CNBC also has requested comment from a lawyer for Esformes' ex-wife, Sherri Beth Esformes, whose divorce from him was finalized in July 2020. On Tuesday, a judge in Miami federal court set a deadline of Nov. 4 for Philip Esformes to respond to his ex-wife's filing.

New York CNN —TD Bank will pay $3 billion to settle charges that it failed to properly monitor money laundering by drug cartels, regulators announced Thursday. TD also intends to pay $1.8 billion to the US Justice Department and plead guilty to resolve the US government’s investigation that the bank violated of the Bank Secrecy Act and allowed money laundering. The US Department of Justice said in a statement that TD Bank had “long-term, pervasive, and systemic deficiencies” in its procedures of monitoring transactions. TD Bank declined to comment on the fine, but the bank plans to hold a call with investors later on Thursday.
