(AP) — A U.S. District Court judge is standing by her decision to block portions of a public health order from New Mexico's governor that would suspend the right to carry firearms in many public parks in the Albuquerque area, with appeals pending before a higher court. The Monday order from Albuquerque-based Judge Kae Riggs denied a request from the governor to leave in place a temporary ban on firearms in some public places in greater Albuquerque, including most public parks. “Judge Riggs’ opinion ignores this caselaw and the massive amount of historical evidence in the record supporting the constitutionality of the temporary restrictions imposed by the public health order,” Hayden said in an email. The rest of the public health orders have remained intact, including directives for monthly inspections of firearm dealers statewide, reports on gunshot victims at New Mexico hospitals, wastewater testing for illicit substances at schools and more. Votes against the bill were cast by two Republican lawmakers who are pursuing impeachment proceedings against the governor for her emergency health orders on gun violence.

"Maryland has not shown that this regime is consistent with our nation's historical tradition of firearm regulation," U.S. A gun rights group called Maryland Shall Issue sued in 2016 along with two individuals and a gun store, arguing that the restrictions violated the Second Amendment. Richardson on Tuesday said the Supreme Court in 2022 "effected a sea change in Second Amendment law" when it struck down New York state's limits on carrying concealed handguns outside the home. Despite Trump’s much-vaunted travel ban, there was plenty of terrorism on his watch as the 45th president of the United States. Also, the most lethal antisemitic attack ever in the United States took place on October 27, 2018, when a terrorist killed eleven people at the Tree of Life Synagogue in Pittsburgh. It seems, at least in Trump’s mind, that lethal acts of terrorism carried out by far-right terrorists don’t count as terrorism. Terrorism did not disappear with Trump, and his proposed “solution,” were he to become president again – amping up the Muslim travel ban – likely won’t accomplish much of anything. As Trump spends more time on the campaign trail, we will surely be seeing more factually challenged statements of this type.

It’s also a clear sign that the gun safety movement needs to get to work reforming the Supreme Court. Regardless of how Rahimi is decided, the Supreme Court has already done enormous damage to our ability to keep Americans safe from gun violence. We need Supreme Court expansion to restore balance and sanity to the Court. Fortunately, Supreme Court expansion is clearly constitutional: Congress has done it multiple times throughout American history and we can do it again. Expanding the Supreme Court would be yet another way we can fight the war against senseless gun violence.
