Her evidence on Tuesday was deeply embarrassing for Trump and drew an aggressive cross-examination from his attorney trying to shatter Daniels’ credibility. Merchan also instructed Trump’s attorney, Todd Blanche, to rein in his client after complaining that the defendant had cursed audibly and shaken his head during Daniels’ testimony. So far, Trump — who has launched searing attacks on the judge — has managed to refrain from openly attacking Daniels since she took the stand. And her appearance is only an appetizer for expected explosive evidence in the coming days of the biggest star witness, Trump’s former lawyer and fixer Michael Cohen. The coming days will therefore require qualities that Trump has always struggled to demonstrate in a riotous life in business and politics: restraint and self-discipline.

Some legal observers believe the Weinstein decision could prove relevant as the hush money trial against former President Donald Trump unfolds in Manhattan. Judge Juan Merchan, who is overseeing the trial and making day-by-day decisions about what evidence is allowed in court, is bound to the same guidelines as the Weinstein trial judge. Stephen Gillers, professor of law at New York University, said the Weinstein ruling will certainly be important to Merchan. Judge Madeline Singas dissented from the Weinstein appeals court ruling, saying the information was needed for the jury to consider. Gillers said the Weinstein decision is not just weighing on the judge’s mind.

CNN —Judge Juan Merchan handed down his first punishment to Donald Trump for violating the judge’s gag order in the New York hush money trial Tuesday, fining Trump $9,000 for nine violations. Instead, Davidson negotiated a $130,000 hush money deal with Cohen on Daniels’ behalf, and she did not speak out publicly before the 2016 election. In his order, the judge warned Trump that he could be imprisoned if he continues to willfully violate the gag order. “All you have to do is talk to that a**hole Cohen,” Davidson recalled. His son, Eric Trump, attended the trial – the first family member of the former president to appear during the trial.

Jim Walden Courtesy of Jim WaldenA few days later, New York’s highest court overturned the sex crimes conviction of Hollywood movie mogul Harvey Weinstein. And the recent dramatic developments in the Weinstein case demonstrate why the presiding judge in the Trump trial, Judge Juan Merchan, needs to reverse his ruling allowing Trump to be questioned about proven misconduct from other cases. If he doesn’t, Trump could have an easy path to having a conviction in the case tossed out. This is essentially what happened in the Weinstein case. If he does not, Trump could get a conviction overturned while the ink hasn’t yet dried on the jury’s verdict.

CNN —A federal judge on Thursday upheld the verdict and award in E. Jean Carroll’s defamation case against former President Donald Trump and denied Trump’s motion for a new trial. Judge Lewis Kaplan, in a written opinion, said Trump’s legal arguments are without merit. The judge also found that the punitive damages the jury awarded to Carroll “passes constitutional muster.”Trump is also separately appealing the verdict. This is a breaking story and will be updated.

CNN —An email Monday night from Donald Trump – subject line: “My farewell message” – carried a fateful warning to his backers. Throughout the first six days of his trial, Trump’s dramatized retellings of his legal peril have veered considerably from the events actually unfolding in and around Manhattan’s criminal courthouse. In one fundraising email on the first day of his trial, Trump claimed he “stormed out” of the proceedings. With the courtroom quiet Tuesday, Trump flipped through a pile of papers loud enough to hear the pages turning. “I will not have any jurors intimidated in the courtroom,” Merchan said.

But on Monday, his diminished reality as a criminal defendant will become clear in humbling fashion during opening statements in his first criminal trial. The process, known as a Sandoval hearing, offered the ex-president a glimpse of personal and unflattering revelations that the trial could dredge up. The political case against the prosecutions was laid out by South Dakota Gov. But Noem rehearsed a political argument that Trump and his associates will be seeking to land as the trial goes ahead. Just before noon last Saturday, a 9-year-old girl was with her mother at Grand Central Terminal when a man strode up to the child and, without warning, punched her in the face, according to the police. The child, dizzy and in pain, was taken to the hospital. It was the second time in nine days that Mr. Zarzuela had randomly attacked someone at the terminal, the police said. On April 4, they said, he punched a 56-year-old woman in the face, causing her nose to bleed and her left eye to swell shut. And it was among a number of recent assaults that have unnerved New Yorkers, who have seen a rash of attacks reported on the streets and on the subway.

CNN —If Donald Trump opts to testify at his New York criminal trial, Manhattan prosecutors want to use his past legal run-ins to discredit him to the jury. Prosecutors say they’ll want to question him about what they claim is false testimony he gave on the stand at that trial last November. The judge plans to hold a proceeding called a Sandoval hearing to rule on what’s fair fodder for prosecutors if Trump takes the stand in his defense later at trial. A Sandoval hearing is a common preliminary proceeding that reviews a defendant’s criminal history and looks at how much prosecutors can ask if a defendant testifies. “If for some reason we are fortunate and get done early on Friday, we will take up Sandoval at that time,” Merchan said.
