Fifty-two countries will participate in arguments at The Hague over the six-day hearing – more than any other case heard by the court in its history. Israel captured the West Bank, East Jerusalem and Gaza in the 1967 Six-Day War. The ICJ's six days of hearings starting on Monday come after the U.N. General Assembly asked the court in 2022 for an advisory, or non-binding, opinion on the occupation. It is the second time the U.N. General Assembly has asked the ICJ, also known as the World Court, for an advisory opinion related to the occupied Palestinian territory. “The International Court of Justice is set for the first time to broadly consider the legal consequences of Israel’s nearly six-decades-long occupation and mistreatment of the Palestinian people,” said Clive Baldwin, senior legal adviser at Human Rights Watch. While Israel has filed a written statement with the court, it has not asked to participate in the hearings.

With Israel continuing to warn that it plans a ground invasion of Rafah, the southernmost city in Gaza, South Africa has asked the International Court of Justice in The Hague to issue new constraints on Israel’s military offensive to prevent genocide. In December, South Africa filed a case with the International Court of Justice, the U.N.’s highest court, accusing Israel of genocide and asking the court to step in with emergency orders. In response, the court ordered Israel last month to ensure that its actions would not lead to genocide and to increase humanitarian aid to Gaza. Under court rules, the judges will have to consider South Africa’s request as a matter of priority. Israel’s foreign ministry did not immediately respond to a request for comment on Tuesday, but Israel has rejected accusations of genocide.

CNN —The UN’s top court ordered Israel to “take all measures” to prevent genocide in Gaza, but stopped short of calling for Israel to suspend its military campaign in the war-torn enclave. South Africa had accused Israel of violating international laws on genocide in its war in Gaza, and wanted the court to order a halt in fighting. Friday’s decision related only to South Africa’s request for emergency measures, which act like a restraining order while the Court considers the full merits of the full genocide case, which could take years. The Court also ordered Israel to “prevent and punish the direct and public incitement to commit genocide,” as well as to “ensure the provision of urgently needed basic services and humanitarian assistance” in Gaza. Netanyahu hails rulingApart from its call for a halt in fighting, the bulk of South Africa’s nine requests to the Court were met.
