I had two thoughts on Friday as I listened to the chief judge of the International Court of Justice tell Israel to halt its military offensive in Rafah, the city in southern Gaza to which more than a million displaced people fled earlier in the conflict. The first was that the court’s ruling was unusually forceful: the judge said Israel “must halt” its military offensive in Rafah “immediately.” Many observers had not expected the court to issue such a direct order because it has no jurisdiction to impose similar requirements on Hamas, Israel’s opponent in the war. My second thought was that the court’s use of punctuation was definitely going to provoke debate. Here’s the key part of the ruling:The State of Israel shall, in conformity with its obligations under the Convention on the Prevention and Punishment of the Crime of Genocide, and in view of the worsening conditions of life faced by civilians in the Rafah Governorate: Immediately halt its military offensive, and any other action in the Rafah Governorate, which may inflict on the Palestinian group in Gaza conditions of life that could bring about its physical destruction in whole or in part. Sure enough, for several days some legal scholars have been arguing about whether the clause that begins “which may inflict” might put conditions on the order to “immediately halt.”Has Israel been told to halt its offensive, or to do so only if that offensive is about to partly or completely destroy Palestinians as a group?

The answer I’ve been hearing is that the goal is to send a message: If Gaza costs Biden the election, Democrats will understand that in the next election they will need to rethink their seemingly reflexive support for Israel’s government and commit as a party to the protection of Palestinian rights. There are many questions one could ask about this argument, but from a certain perspective, the most important one for American voters may well be: What next election? The war in Gaza has produced a blatant disregard for the mission of the United Nations, including outrageous attacks on the employees, facilities and operations of the United Nations Relief and Works Agency for Palestine Refugees. As I write this, our agency has verified that at least 192 UNRWA employees have been killed in Gaza. UNRWA-run schools have been demolished; some 450 displaced people have been killed while sheltered inside UNRWA schools and other structures. Since Oct. 7, Israeli security forces have rounded up UNRWA personnel in Gaza, who have alleged torture and mistreatment while in detention in the Strip and in Israel. In April, gunfire hit World Food Program and UNICEF vehicles, apparently inadvertently but despite coordination with the Israeli authorities.

Hong Kong CNN —Chinese leader Xi Jinping decried “tremendous sufferings” in the Middle East and called for an international peace conference as leaders from Arab nations visit Beijing this week amid mounting global concern over Israel’s war in Gaza. Justice should not be absent forever,” Xi said Thursday at the opening of a meeting between top diplomats from China and Arab states, also attended by several leaders from the region. Delegations from 22 Arab states joined that event at Beijing’s Diaoyutai State Guesthouse, according to Chinese state media. China has recognized a Palestinian state since 1988. Thursday’s ministerial meeting is the first such gathering since China held its first joint summit with Arab leaders in late 2022 in Saudi Arabia.

The bombs used in the Israeli strike that killed dozens of Palestinians in a camp for displaced people near Rafah on Sunday were made in the United States, according to weapons experts and visual evidence reviewed by The New York Times. CNN —The war in Gaza will likely continue through at least the end of the year, an Israeli official warned Wednesday, seeming to dismiss the idea that fighting would end after the military offensive against Hamas in Rafah. Israel’s national security adviser, Tzachi Hanegbi, said the year 2024 has been “defined as a year of combat” by Israel’s war cabinet. The Israeli government had previously signaled that entering Rafah would be the final stage of its war against Hamas, which attacked Israel on October 7, killing about 1,200 people and taking some 250 people hostage. In response, Israel launched a devastating offensive in Gaza which has killed more than 36,000 people, according to Palestinian officials. This resilience is what has allowed this nation to survive for 75 years, and even for 3,000 years before that.
