New York CNN —Restaurant chain Panera Bread has faced three separate lawsuits in recent months claiming the high levels of caffeine in its Charged Lemonade led to the death of two customers and irreversible health complications in another. Lawsuits claim advertising was unclearBoth wrongful death suits allege the Charged Lemonade does not clearly advertise its high levels of caffeine , and does not provide a warning to customers. A large-size Charged Lemonade, which comes in a 30-oz cup, contains up to 236 mg of caffeine. Similarly, the second lawsuit, filed in December by the family of a 46-year-old man with a chromosomal deficiency disorder, ADHD and high blood pressure, claimed that the product was not properly labeled. New York CNN —Flight cancellations across the country continue to cause headaches for thousands of travelers, and Southwest is topping the list of most-affected airlines for the second consecutive day. Saturday and Sunday saw more than 16,500 flights delays and nearly 3,000 cancellations across the United States, according to FlightAware. The Federal Aviation Administration instated the order after a piece of the fuselage blew off an Alaska Airlines flight on January 5 with 177 people on board. United has canceled nearly 13% of its flights, making it the second most affected airline behind Southwest, which doesn’t fly any Max 9 planes. Alaska Airlines experienced the third-highest rate of cancellations on Sunday, having called off about 15% of its total flights.

The packaged foods maker said Thursday it is recalling additional products that include more cereals bars and snacks. A loyal Panera customer, he started regularly ordering “charged lemonade” in late September, according to the suit. The complaint resembles another wrongful death suit filed earlier this year by the parents of Sarah Katz, a 21-year-old woman who died in September 2022 after drinking Panera’s charged lemonade. “Panera Charged Lemonade is a juice beverage marketed to children and adults alike,” the suit claims. Katz, who died last year, may have believed the caffeinated drink was regular lemonade, her parents alleged in the suit they filed against Panera. Now, a 30-ounce charged Panera drink has no more than 237 milligrams of caffeine, according to Panera’s site.

CNN —Alaska Air (ALK) on Sunday announced it will buy Hawaiian Airlines (HA) for $1.9 billion. “This is a fantastic deal that bring two airlines that have amazing loyalties in our regions together,” said Alaska Airlines CEO Ben Minicucci in a news conference, adding that the merger will give customers in both states expanded domestic and international choices. The deal, which is forecast to take nine to 18 months, will see both companies keep their brands, a unique decision that Minicucci and Hawaiian Airlines CEO and President Peter Ingram say was made out of respect for the nearly hundred-year legacy of both airlines and the communities they serve. “In Alaska Airlines, we are joining an airline that has long served Hawai‘i, and has a complementary network and a shared culture of service,” said Ingram. “With the additional scale and resources that this transaction with Alaska Airlines brings, we will be able to accelerate investments in our guest experience and technology, while maintaining the Hawaiian Airlines brand.”Minicucci, who will become the CEO of both airlines, heralded the move as pro-consumer will allow for more robust domestic competition with United, Delta, Southwest and American airlines, which currently own 80% of the market share.

CNN —Movie theaters slumped into a “Slow-vember,” say industry analysts, as several of the season’s most anticipated movies drew underwhelming box office sales last month. Domestic theaters grossed about $553.6 million this November, a 12% decline from last year and still more than $400 million short of pre-pandemic levels, according to data from research firm Comscore. Between 2009 and 2019, Novembers were a reliably lucrative month and could be counted on to rake in nearly a billion dollars, owing in part to the long Thanksgiving weekend. It was also surpassed by “The Hunger Games,” which was the top movie over Thanksgiving weekend, grossing $42 million. December could see a similar slump, according to Robbins, given the “Ghostbusters” sequel has been delayed until next year and “Aquaman and the Lost Kingdom” will likely not live up to the first movie’s box office revenue.

Woodson spoke with more than 100 Black professionals about what he calls the Black ceiling — a significant barrier that impedes career progression and creates stigma and anxiety in the workplace. CNN —Honda is recalling more than 300,000 vehicles over faulty seat belts. In a notice filed with the National Highway Traffic Safety Administration (NHTSA) on Tuesday, the automaker said some front seat belts in 2023-2024 Accords and HR-Vs have missing pretensioner rivets. A pretensioner is the seat belt component that tightens it in place during an accident, preventing the seat occupant from flying forward. Defective pretensioners increase the risk of injury in the event of a collision, Honda said in the notice. In a safety recall report also filed with the NHTSA, Honda said it received the initial complaint about the seat belt issue in May.

Both in-store and online retail sales increased year-over-year unadjusted for inflation, according to Mastercard’s SpendingPulse insights, which noted that apparel, jewelry and restaurant categories saw considerable spikes. Most shoppers did their browsing and buying on their phones, with mobile purchases accounting for $5.3 billion in sales. E-commerce platform Shopify also reported record sales totaling more than $4 billion worldwide, 22% higher than last year. As holiday shopping ramps up ahead of Christmas, analysts predict a busy time for retailers over the next few weeks.

According to a new American Express survey of small business owners, “55% anticipate Small Business Saturday will make a significant contribution to their overall holiday sales this year.” In a consumer survey conducted by the company in October, half of respondents said they plan to participate in the upcoming Small Business Saturday, and 85% said they anticipated shopping small this holiday season. Over the past 13 years, the company says consumers have reported spending nearly $184 billion during Small Business Saturday. American Express estimated that Small Business Saturday drove nearly $18 billion in consumer spending last year. Donnell Johns, who runs Veterans Growing America, an organization that supports veteran- and military-spouse-owned small businesses, said that Small Business Saturday is valuable because it creates an awareness for shopping small. CNN —Libertarian Javier Milei’s victory Sunday in Argentina’s presidential run-off contest has far-reaching consequences for the country’s struggling economy, including the fate of the peso. A political outsider who ran on a promise to “break the status quo,” Milei’s economic platform rested on a desire to dollarize the Argentinian economy. Dollarization means the country would give up the Argentine peso and use the US dollar as its currency. Milei’s proposal to switch Argentina’s currency from the peso to the US dollar rests on the argument that the dollar is stronger than the peso and, unlike the peso, cannot be printed at will. CNN —Honda is recalling almost 250,000 vehicles due to a manufacturing error that may damage the engine. 2018 and 2019 Honda Odysseys, 2016, 2018 and 2019 Pilots, and Ridgelines manufactured between 2017 and 2019 are also potentially affected. This recall brings the number of Honda vehicles recalled in 2023 up to more than three million. Honda said owners will be notified by letter in early January, and that dealers will inspect, repair and replace the engines for free. CNN —Government officials, public health professionals and concerned parents are calling on Congress to ban water beads, a children’s toy that they say poses significant health risks. Water beads are tiny balls made out of extremely absorbent polymer material. Pall also emphasized that water beads have been responsible for 4,500 emergency room visits nationwide since 2017, and that these incidents have grown more frequent. Most recently, the Commission and company Buffalo Games recalled about 52,000 Chuckle & Roar Ultimate Water Beads Activity Kits in September. Hoehn-Saric said that, beyond the Commission’s recalls, the CPSC is investigating taking further action regarding potentially harmful chemicals in water beads.

CNN —Former fashion mogul Peter Nygard was found guilty of four counts of sexual assault in a Toronto court on Sunday, following a six-week trial. The accusers were then “forcibly sexually assaulted, drugged, and/or coerced into sexual contact with Nygard,” according to the US indictment. Nygard consented to be extradited to the United States in 2021 but in 2023 he appealed against extradition, according to court documents reviewed by CBC. Nygard served as chairman of Winnipeg-based women’s clothing company Nygard International, which he founded in 1967. In March 2020, Nygard International filed for bankruptcy protection in Canada and the United States after the sex trafficking allegations.

1 at the box office in its opening weekend but grossed just $47 million in domestic sales, according to studio estimates on Sunday. In fact, “The Marvels” is only the third Marvel movie to make less than $60 million during its opening weekend, and the first since “Ant-Man” opened with $57 million in 2015. The lackluster opening weekend numbers for “The Marvels” are also symptomatic of overarching studio challenges in recent years, say experts. Marvel’s November offering last year, “Black Panther: Wakanda Forever,” which was also a sequel to an Infinity-Saga-era film, made nearly four times the domestic opening weekend earnings as “The Marvels” with more than $181.3 million. However, the video-game-based movie is also available online for Peacock subscribers, and streaming may siphon off some moviegoers.

☆ Gina Raimondo seeks better ties with China amid tensions over tech, Taiwan

CNN —Ahead of high-stakes meetings next week between the United States and China, US Commerce Secretary Gina Raimondo dismissed the notion there would be a military conflict with China over Taiwan. Both the United States and China “have a desire to stabilize (their) relationship,” Raimondo told CNN’s Christiane Amanpour in an interviewed that aired Saturday. Raimondo noted the world is looking to the United States and China “to be responsible and manage this relationship.”Raimondo acknowledged there is a “great competition” with China, echoing similar sentiments expressed by President Joe Biden, who has stated the United States wants competition with China, rather than outright hostility and conflict. At the same time, Raimondo said she has told China “there can be no negotiation when it comes to matters of national security,” particularly with regard to semiconductor chips used to manufacture advanced weapons. Also on the table are issues surrounding military communication between the United States and China, the climate crisis and narcotics trafficking.
