A mid-level state appeals court last week reinstated the gag orders, which barred Trump and his lawyers from making public statements about court staff. Justice Arthur Engoron imposed the gag order on Trump on Oct. 3 after Trump accused Engoron's top clerk of political bias in a post on his Truth Social platform. The post left the court "inundated" with hundreds of threats from Trump supporters, Engoron said in a court filing. In Monday's filing, Trump lawyer Clifford Robert asked the mid-level appeals court, known as the Appellate Division, to allow Trump to appeal its reinstatement of the orders to the Albany-based Court of Appeals.

Prosecutor Peter Carter said the brothers "used information which they should not have used – because it was private, confidential, price-sensitive information – to gamble effectively, to invest on the stock exchange". He told the jury that Goldman Sachs' internal policies strictly forbid any use of confidential information acquired by the investment bank or its employees. "To breach a confidence or to use confidential information improperly or carelessly would be unthinkable," the policy says. Carter said the policy was clear that employees are not allowed to use confidential information "other than for your work at (Goldman Sachs) and nothing else".

Judge Arthur Engoron's wider gag order came after Trump's lawyers made what the judge characterized as "on the record, repeated, inappropriate remarks" about his law clerk. They "falsely [accused] her of bias against them and of improperly influencing the ongoing bench trial," Engoron wrote. Of the $4 billion writedown, $2.8 billion was connected to the Ocean Wind 1 project, Orsted said. The Ocean Wind 1 project would have been New Jersey's first offshore wind farm and would have generated enough electricity to power half a million homes, according to a website about the project. It was going to include 98 turbines located 15 miles off the coast of southern New Jersey. The similarly sized Ocean Wind 2 project was also going to be located off the southern New Jersey shore and was due to start in 2028, according to a website about the project.

The others will use a combination of renewables, nuclear power, and natural gas with carbon capture and storage. Putting federal money behind a program to fight climate change while using natural gas, a fossil fuel, as one of its main ingredients may not seem intuitive. To wit, the Bipartisan Infrastructure Law, where the funding for the hydrogen hubs comes from, specifically required that two of the selected hydrogen hubs be located in natural gas-rich regions. Making hydrogen from natural gas with carbon capture will require additional energy and be more expensive than producing hydrogen from natural gas where the excess carbon emissions just spew into the atmosphere. That is what the U.S. government is trying to change with its hydrogen hubs program and the production tax credit.
