The hearing at the U.S. 5th Circuit Court of Appeals in New Orleans comes 11 months after the Supreme Court ruled there was no longer a federal constitutional right to abortion. But if it refuses to hear an appeal, the 5th Circuit decision will be the final word on the drug's fate. Days later, the DOJ appealed Kacsmaryk's decision to the 5th Circuit, which handles cases arising from the Northern District of Texas. He said the Supreme Court will likely agree to take the case if the 5th Circuit panel decides to pull mifepristone from the U.S. market.
However the 5th Circuit rules, the case will likely continue for months or years. HOW DID THE CASE GET TO THE 5TH CIRCUIT? WHAT COULD THE 5TH CIRCUIT DO? A messy legal fight over the Food and Drug Administration's approval of the abortion pill mifepristone poses risks to the biopharma industry that go beyond the single drug. If a subsequent decision tosses out the pill's approval, it could potentially stifle innovation in the sector and deter investments in the development of life-changing drugs, biopharma companies and experts in law and economics say. More than 200 biopharma companies made a similar claim Monday in an open letter calling for the reversal of Kacsmaryk's decision. A federal judge in Texas has extended until Feb. 24 the deadline in a lawsuit seeking to overturn the Food and Drug Administration's approval of the abortion pill. The abortion rights group NARAL Pro-Choice America, in an analysis published Friday, said 40 million women would lose access to the abortion pill if the Alliance for Hippocratic Medicine succeeds and mifepristone is effectively banned. Last week San Antonio’s City Council voted 9-2 to authorize the use of eminent domain to take a bar owner’s property because the city wants it for a $400 million makeover of the Alamo mission and battle site. The bar is called the Moses Rose ’s Hideout, named for the man who is said to have deserted his comrades at the Alamo to save himself. The latest appraisal projects the bar’s value in 10 years at $2.8 million, so San Antonio thinks its offer is more than generous.
