☆ Opinion: The basic problem with putting Trump on trial

In this week’s mammoth New York trial of former President Donald Trump on charges of falsifying business records in connection to hush money paid to an adult film star, the yawning gap between “Us” and “Them” is along partisan lines. After all, making hush money payments, as Trump is alleged to have done with former adult film actress Stormy Daniels, isn’t illegal. For decades, Trump has been a fixture on our airwaves, social media sites and political coverage. But they didn’t, and now many are feeling a rally-round-the-flag effect in what is likely the first and potentially only Trump criminal case that’s going to trial before Election Day. Bragg’s decision to bring this case, with its attenuated connection to an actual crime, can’t be taken out of its political context.

This week Donald Trump was put on trial by a liberal prosecutor on what seems like the most nakedly political of the multiple charges that he’s facing. This fairly pitiful scene made an interesting accompaniment to the country’s biggest movie at the moment, Alex Garland’s “Civil War,” which depicts a version of contemporary America riven by civil strife, with various secessionist forces at war against a dictatorial president who’s stayed on for a third term. That president is clearly a Trump-like figure, but the movie is extremely light on politics; it’s mostly interested in juxtaposing scenes of brutality — mass graves, tortured prisoners, firefights and summary executions — with the familiar American landscapes of shopping malls, carwashes and the pillars of the White House. We aren’t supposed to ask for detailed how-we-got-here explanations; we’re just supposed to meditate on how easily It Could Happen Here. Some people who like “Civil War” find the political lacuna admirable, since it cuts the movie free from current ideological preoccupations and lets us take the antiwar message straight.

At least 14 people were killed and scores more injured when three Russian missiles struck a busy downtown district of Chernihiv, north of Kyiv, just before noon on Wednesday, Ukrainian officials said. President Volodymyr Zelensky said the death toll, reported by the office of Ukraine’s prosecutor general, might rise and blamed Ukraine’s lack of air defenses for the loss of life. The prosecutor general said that 61 people were reported injured. “This would not have happened if Ukraine had received enough air defense equipment and if the world’s determination to counter Russian terror was also sufficient,” Mr. Zelensky said in a statement. Ukrainian officials did not comment on the apparent attack, but Russian military bloggers affiliated with the Kremlin reported that Ukrainian missiles had struck locations around the air base in Dzhankoi, Crimea.

We should call it an “election interference” trial going forward. Assistant District Attorney Joshua Steinglass skillfully advanced the election interference theory by structuring his evidentiary points in chronological order within that frame. Trump’s alleged 2020 attempt to overthrow our government distorts perceptions of how serious the charges related to the 2016 election are. How can we call this an election interference trial, they ask, if the election was already over when the 34 alleged document falsification crimes occurred? It is an election interference one and we should say so.

The social media post is the latest challenge to the limits of a gag order that forbids Trump from making public statements about likely witnesses and jurors. In the weeks since, Trump has repeatedly gambled on the limits of the gag order. It would not be the first time Trump has faced consequences for disobeying a gag order.
