Trump could testify as soon as Monday in the defamation trial over his 2019 comments branding Carroll a liar who faked a sexual attack to sell a memoir. He plans to be in court as the New York trial resumes after a weekend break. He regularly addressed the news cameras waiting outside the fraud trial in a New York state court. He lied, and he shattered my reputation,” Carroll, a former longtime Elle magazine advice columnist, told jurors and Trump while he was still in court. Trump has said his lawyers advised him not to dignify the first trial by attending it.

The trial was delayed Monday for a juror COVID scare — and Tuesday is the New Hampshire primary. If the trial isn't delayed another day, as Trump's lawyers requested, he may lose his chance to take the stand. Well, that's the New Hampshire Republican presidential primary — and Trump made clear through his defense team Monday that he plans on being there. Now, that chain of events — a sick juror, and the New Hampshire primary — may well conspire to keep Trump off the witness stand entirely. AdvertisementThe judge paused the trial until Tuesday, but that day will be busy as well, given the New Hampshire primary.

In court filings viewed by Business Insider, Carroll's lawyer, Roberta Kaplan, notified US District Judge Lewis Kaplan that she intends to submit several pieces of evidence on Monday for the ongoing defamation trial. Carroll's lawsuit centers entirely on the allegation that Trump defamed her by saying she lied about him raping her in a Manhattan department store in the mid-1990s. AdvertisementThe exhibits also include a Truth Social post that Trump put up on the day Kaplan filed her letter of intent to submit more evidence. Even before his day in court, Trump continued to attack Carroll on social media, calling the writer's allegations a "fake story" and a "witch hunt." WASHINGTON (AP) — The 10-day search to rescue two Navy SEALs lost in the Arabian Sea during a mission to board a ship and confiscate Iranian-made weapons has been ended and the sailors are now considered deceased, the U.S. military said Sunday. In a statement, U.S. Central Command said the search has now been changed to a recovery effort. “We mourn the loss of our two Naval Special Warfare warriors, and we will forever honor their sacrifice and example," said Gen. Erik Kurilla, head of U.S. Central Command. They loaded onto small special operations combat craft driven by naval special warfare crew to get to the boat. The U.S. Navy ultimately sunk the ship carrying the weapons after deeming it unsafe, Central Command said.

Donald J. Trump doesn’t change. The judges’ different approaches to the tempestuous storm that entered their courtrooms — and the different results — could offer lessons beyond the two New York cases. They may provide guidance for the judges set to oversee Mr. Trump’s four potential criminal trials, who will want to keep the 45th president from transforming his legal proceedings into political spectacles. “The thing you’ve got to do primarily is set rules and enforce them,” said John S. Martin Jr., a former U.S. District Court judge in Manhattan. “I think if the judge is tough and doesn’t back down, Trump will back down.”

A new one-page indictment delivered by the grand jury Friday alleges Baldwin caused Hutchins' death — either by negligence or “total disregard or indifference” for safety. Defense attorneys for Baldwin indicate they'll fight the charge, which carries a potential prison sentence of up to 18 months. The indictment provides prosecutors with two alternative standards for the felony involuntary manslaughter charge against Baldwin. Mangels said a grand jury indictment is by no means an assurance that prosecutors will prevail at trial. “Just getting an indictment from a grand jury in no way means the prosecution has a slam dunk case or even a strong case,” she said.

TAMPA, Fla. (AP) — The U.S. Air Force plans to expand its search for grave sites in a former Black cemetery at a base in Florida after discovering 121 potential sites already, a base official said. Lt. Laura Anderson told news stations this week that a nonintrusive archaeological survey performed over the past two years at MacDill Air Force Base in Tampa identified 58 probable graves and 63 possible graves. The base also deployed search teams to go over the area with ground penetrating radar and cadaver dogs. It plans to look at an area to the north of the main cemetery area this year for any additional evidence of graves, Anderson said. “We know obviously there was wrong done in the past, but we’re working together with our community members,” Anderson said.

PARK CITY, Utah (AP) — Filmmaker Yance Ford was in a “Sundance haze” when he took a meeting with Netflix following the premiere of “Strong Island” in 2017. “Strong Island” would go on to get an Oscar nomination, too, as would its Sundance and Netflix peer “Icarus,” which would win best documentary in 2018. “Netflix understood what ‘Strong Island’ was doing and what it could say to a big, broad audience.”Ten years after “The Square,” an acquisition that put Netflix documentaries on the map, the streamer is back at the 40th Sundance Film Festival with an eye towards acquisitions and two very different originals. “We really were the new kids on the block trying to persuade filmmakers that having the reach of the platform was something that was really important,” Del Deo said. “I think it's going to put a lot of smiles on people,” Del Deo said.

ATLANTA (AP) — Donald Trump used his social media platform Friday to mock Nikki Haley 's birth name, the latest example of the former president keying on race and ethnicity to attack people of color, especially his political rivals. She has always gone by her middle name, “Nikki.” She took the surname “Haley” upon her marriage in 1996. Haley has dismissed Trump's latest attacks as proof that she threatens his bid for a third consecutive nomination. Trump has a long history of using race, ethnicity and immigrant heritage as a cudgel. He was born in Hawaii, though Trump spent years asserting Obama had manufactured the story and a birth certificate to support it.

A grand jury in New Mexico indicted Alec Baldwin on Friday on a charge of involuntary manslaughter, reviving the criminal case against him in the fatal shooting of a cinematographer on the set of the film “Rust” more than two years ago when a gun he was rehearsing with went off. The indictment, which came exactly one year after the first involuntary manslaughter case against him was announced, was the latest reversal of fortune for Mr. Baldwin. The local district attorney’s initial case fell apart and the initial charge against Mr. Baldwin was dismissed in April. But a new prosecution team, Kari T. Morrissey and Jason J. Lewis, decided to present the case to a grand jury, which indicted Mr. Baldwin on Friday. In New Mexico, an involuntary manslaughter conviction on a charge like the one Mr. Baldwin faces can carry up to 18 months in prison.

Attorney Alina Habba told a judge in a letter that writer E. Jean Carroll’s trial was ruined when Habba elicited from Carroll through her questions that Carroll had deleted an unknown number of social media messages containing death threats. That jury awarded Carroll $5 million in damages. Robbie Kaplan, an attorney for Carroll who is not related to the judge, declined comment. Habba asked the judge to instruct the jury that Carroll had an obligation to minimize the effect of the defamation she endured. Disney and its investors are going to start hearing a lot from activist investor Nelson Peltz. Disney's annual meeting last year was April 3. Disney plans to launch a direct-to-consumer ESPN service either later this year or in 2025 as the sports network's traditional cable subscription model fades. After it reports earnings Feb. 7, Disney will release its definitive proxy materials, which include the date of the annual meeting. Neither side usually knows who is winning until days or hours before the annual meeting because those massive investors often vote late in the process.

But there's a catch with conventional assets: the wash sale rule . Now, tax professionals are flagging a potential wrinkle that may arise: Even though bitcoin itself isn't subject to the wash sale rule, a spot bitcoin ETF very well may be. Property versus security Under federal tax law, the IRS deems cryptocurrency to be property . Managing limitations At its core, that means investors should avoid swapping in and out of the same spot bitcoin ETF within the 61-day limit if they had sold the position. This also raises the question of whether dumping one spot bitcoin ETF for another would be deemed substantially identical.

The Houthi movement said its missiles had made a "direct hit" on the bulk carrier. U.S. officials said the move was aimed at cutting off funding and weapons the movement has used to attack or hijack ships. On Monday, Houthi forces had struck the U.S.-owned and operated dry bulk ship Gibraltar Eagle with an anti-ship ballistic missile. The alternative shipping route around South Africa's Cape of Good Hope can add 10-14 days to a journey compared to passage via the Red Sea and the Suez Canal. Freight rates have more than doubled since early December, according to maritime consultancy Drewry's world container index, while insurance sources say war risk premiums for shipments through the Red Sea are also rising.
