A bottle of Johnson and Johnson Baby Powder is seen in a photo illustration taken in New York, February 24, 2016. LTL's bankruptcy proceedings have largely paused the 38,000 lawsuits against J&J, although one case was allowed to proceed to a $18.8 million verdict in July. But David Molton, an attorney for the official committee representing cancer claimants in LTL's bankruptcy, said that a temporary prohibition on new bankruptcy filings was appropriate, given LTL's repeated bankruptcy filings. Kaplan, who dismissed LTL's second bankruptcy, said he was not inclined to block future bankruptcy filings because circumstances could change in the next six months. But the judge said he was open to further written arguments on that point before issuing a formal decision closing LTL's second bankruptcy case next week.

The company has also begun offering retired workers meals at the canteen so they can share knowledge of recently re-started lines producing Soviet-era ammunition for Ukraine, he added. Jiri Hynek, president and executive director of the Defence and Security Industry Association (DSIA) of the Czech Republic, told Reuters a lack of workers could push production out of central Europe. The association, which represents more than 160 companies, said exports accounted for around 90 percent of the industry's production of weapons and military-related supplies. Of that, Hynek estimated that supplies of military equipment to Ukraine accounted for 40% of exports. Klein's UK SPAC deal is more swan song than encore

The northern English county is the home of serial acquirer CorpAcq, led by the brother of “Take That” singer Jason Orange, which Klein’s Churchill Capital Corp VII (CVII.N) special-purpose acquisition company vehicle now hopes to buy. The deal, which values the investor in plumbing to fork-lift leasing groups at $1.6 billion including debt, may struggle to relight the fire of the depressed SPAC sector. Klein’s planned deal comes amid a growing lack of patience by SPAC investors. CorpAcq could yet be magic for SPAC investors. Churchill’s sponsors, including Klein, will waive most of their founder shares, which typically vest when a deal is done.

Ukraine’s decision to change tactics is a clear signal that NATO’s hopes for large advances made by Ukrainian formations armed with new weapons, new training and an injection of artillery ammunition have failed to materialize, at least for now. It raises questions about the quality of the training the Ukrainians received from the West and about whether tens of billions of dollars’ worth of weapons, including nearly $44 billion worth from the Biden administration, have been successful in transforming the Ukrainian military into a NATO-standard fighting force. “The counteroffensive itself hasn’t failed; it will drag on for several months into the fall,” said Michael Kofman, a senior fellow at the Carnegie Endowment for International Peace who recently visited the front lines. “Arguably, the problem was in the assumption that with a few months of training, Ukrainian units could be converted into fighting more the way American forces might fight, leading the assault against a well-prepared Russian defense, rather than helping Ukrainians fight more the best way they know how.”President Vladimir V. Putin of Russia has increasingly signaled that his strategy is to wait out Ukraine and its allies and win the war by exhausting them. American officials are worried that Ukraine’s return to its old tactics risks that it will race through precious ammunition supplies, which could play into Mr. Putin’s hands and disadvantage Ukraine in a war of attrition.

Is There a Right Way to Talk About Black Culture?
  + stars: | 2023-08-01 | by ( Ismail Muhammad | ) www.nytimes.com   time to read: +3 min
At its best “Dark Days” is the record of an intellectual life sustained by the Black vernacular. In the essay “Reading Fire, Reading the Stars,” Reeves recounts learning how to be a critic in the Pentecostal church. “Profligacy” is the key word here: With a nod to Hartman’s explorations of “wayward” lives and the presumed promiscuity of Black urban culture, Reeves reframes promiscuity as an aesthetic and intellectual virtue. In Reeves’s hands profligacy becomes an ethical necessity: Everything must be thought of in relation to what it shares space with. Recounting a trip to speak with students at a Native school, he feels his status as a stranger among strangers.

The Storm Shadow cruise missile is the latest highly touted weapon employed by Ukraine. Some observers believe Storm Shadow will be crucial to Ukraine's counteroffensive. The missile's 155-mile range allows Ukrainian jets to launch it while staying out of range of Russian air defenses. A British Royal Air Force Tornado GR4 loaded with four Storm Shadow missiles during a test over the Atlantic Ocean. Storm Shadow missiles, while effective, have a "very similar capability with a very similar payload used very much against the targets that ATACMS would have been used against," Kofman said on the podcast.

For the second time this year, a court has ruled against Johnson & Johnson’s effort to use a bankruptcy case to limit its exposure to tens of thousands of lawsuits that claim its talcum powder products caused cancer. The plaintiffs claim that the company knew for decades about the risks linked to its talc products, including its signature baby powder. The company created a subsidiary, LTL Management, in 2021 as a maneuver to shield itself from the talc litigation. It proposed that the subsidiary, which had filed for bankruptcy, pay $8.9 billion to resolve all the claims against it. But on Friday, Judge Michael Kaplan of the U.S. Bankruptcy Court for the District of New Jersey, said LTL’s bankruptcy case must be dismissed because the lawsuits did not put the company in “imminent or immediate financial distress.” Earlier this year, the U.S. Court of Appeals for the Third Circuit in Philadelphia dismissed the first bankruptcy effort for the same reason.

U.S. Bankruptcy Judge Michael Kaplan in Trenton, New Jersey, ruled that a J&J company's second bankruptcy, like its first, must be dismissed because the talc lawsuits did not put it in immediate "financial distress." J&J's first bankruptcy gambit began in 2021, when it offloaded its talc liabilities into a new company, LTL Management, and immediately placed that company into bankruptcy. Attorneys representing cancer victims, along with the U.S. Justice Department's bankruptcy watchdog, had called for LTL's second bankruptcy to be dismissed as an abuse of U.S. bankruptcy law. Andy Birchfield, an attorney who represents cancer victims, said the second bankruptcy was meant to keep the talc lawsuits from being heard by juries. J&J argued that the proposed bankruptcy settlement offers a fairer and faster resolution for cancer claimants than litigation in other courts.

Since the central bank embarked on its rate-hiking campaign in March 2022, yields on fixed income instruments, ranging from Treasurys to money market funds and bank deposit products, have become more attractive. Some strategists have suggested income-focused investors begin locking in higher rates so they can keep earning good yields once the central bank shifts gears. Capital One recently pushed up the annual percentage yield on its 2-year CD 5 basis points to 4.35%. As a result, a handful of institutions now offer yields of 5% or close to it for 2-year CDs. J&J in 2021 offloaded those talc liabilities into a new subsidiary, LTL Management, and immediately filed for Chapter 11 bankruptcy protections. "LTL commenced its bankruptcy case in good faith and in strict compliance with the Bankruptcy Code," J&J said in a statement. Andrew Adams, who has led the "KleptoCapture" task force since its inception in March 2022, will be replaced by his deputies Michael Khoo and David Lim, a DOJ spokesperson said. "It was a privilege to cap this time in service of the Department's response to the war in Ukraine," Adams, a 10-year Justice Department veteran, wrote in a LinkedIn post. In launching the task force, U.S. Attorney General Merrick Garland said it would enforce sanctions and export controls designed to freeze Russia out of global markets, and confiscate assets obtained through unlawful conduct. The U.S. housing stock is aging, which means lots of bathrooms and kitchens need remodeling. Moving to a newer home that’s in better shape is out of reach for many people, because a new mortgage will usually come at a much higher interest rate. Eighty percent of interest rates on existing mortgages are below 5 percent, while the average rate for new mortgages was about 7 percent on July 20, according to Freddie Mac. But staying put and paying for a renovation may not be any easier. And faced with recent inflation, it’s no surprise that people are saving less.

"For decades the defendant has been selling deadly narcotics: heroin and now heroin laced with fentanyl," they wrote in court papers. An autopsy and court records show that Williams, 54, died of a drug overdose and was found in his Brooklyn apartment on Sept. 6, 2021. Fentanyl was associated with 70,600 of the drug overdoses in the U.S. in 2021, according to the National Institutes of Health. Among the real-life struggles he tapped were his bouts with drug addiction, which he brought to his best known role for "The Wire." Carlos Macci spent decades struggling with addiction, selling heroin and fentanyl not to make money but to ease his own cravings, according to court records. He was part of a four-man crew selling drugs out of an apartment in Williamsburg, and on Sept. 5, 2021, he was with a man who sold a bag of fentanyl-laced heroin to the actor Michael K. Williams. Mr. Williams, who became famous for playing a charismatic stickup man named Omar Little on the HBO series “The Wire,” took the drugs back to his Brooklyn apartment and was found dead the following day, still wearing the same clothes he had on the day before. It's the latest incident of aggressive Russian aircraft maneuvers over the Middle East. More recently, the Air Force said in mid-July that a Russian aircraft engaged a US MC-12 surveillance plane "in an unsafe and unprofessional manner."
