The Trump Organization, Trump, and lieutenants face a $364 million judgment in a civil fraud case. But several factors, including the extent of Trump's fraud, could make him an outlier. "If allowed to stand, this ruling will only further expedite the continuing exodus of companies from New York," the Trump Organization spokesperson said. It's also worth noting the exceptional circumstances that led to the investigation into the Trump Organization. While running for attorney general in 2018, James promised to aggressively investigate Trump's business dealings.

New York CNN —SpaceX wants to move its business incorporation location from Delaware to Texas, according to a Wednesday filing to the Texas Secretary of State. The move by the Elon Musk-owned company comes after a Delaware state judge struck down Musk’s 2018 Tesla pay package, siding with a shareholder who had challenged it as excessive. “SpaceX has moved its state of incorporation from Delaware to Texas!” Musk posted on X Wednesday. “Never incorporate your company in the state of Delaware,” Musk posted on X in January. After the pay package ruling, Musk said he is seeking shareholder approval to incorporate Tesla, another company that he leads, in Texas.

CNN —Stung by a Delaware court ruling earlier this week that struck down his record Tesla pay package, Elon Musk says he is seeking shareholder approval to incorporate the company in Texas. Soon after Tuesday’s ruling about his 2018 salary package — worth about $51 billion at current stock prices — Musk put up a poll on X asking if Tesla (TSLA) should move its registration from Delaware to Texas, where it is already headquartered. Hours later, the Tesla CEO wrote that the “public vote is unequivocally in favor of Texas.” The poll results showed Texas had won the backing of more than 87% of about 1.1 million votes. Musk added he will now “immediately” seek shareholder approval to incorporate the electric carmaker in the southern state. Delaware is famously one of the world’s most welcoming places for companies of all kinds and sizes to incorporate for legal and tax purposes.

Read previewDonald Trump appears to be treating his planned appeal in the second E. Jean Carroll defamation case like his former reality TV show, "The Apprentice." Tacopina withdrew from Trump's legal team shortly before the second trial began. That left Habba in charge of defending Trump for his second trial, which resulted in a considerably higher jury verdict. Trump, Rahmani said, "probably realizes that he lost the second Carroll trial so badly in part due to Alina Habba's limited trial experience and that he needs experienced appellate counsel." The judge, conscious of Trump's intent to appeal the second trial results, told as much to Trump in the courtroom before he testified.

CNN —A former conservative federal appellate judge is urging the Supreme Court to keep Donald Trump off the ballot, arguing the ex-president’s effort to cling to power after his 2020 election loss was “broader” than South Carolina’s secession from the US that triggered the Civil War. Trump tried to prevent the newly-elected President Biden from governing anywhere in the United States. “Trump incited, and therefore engaged in, an armed insurrection against the Constitution’s express and foundational mandates that require the peaceful transfer of executive power to a newly-elected President,” the brief said. The US Supreme Court agreed earlier this month to review the unprecedented decision from the Colorado Supreme Court that removed him from that state’s ballot. In a 4-3 ruling issued last month, the state court said Trump is constitutionally ineligible to run in 2024 because the 14th Amendment’s ban on insurrectionists holding office covers his conduct on January 6, 2021.

HONG KONG (Reuters) - China's Supreme Court and Hong Kong's Department of Justice said on Monday that they signed an arrangement on the reciprocal recognition and enforcement of judgements in civil and commercial cases effective immediately in both places. It is unclear how the reciprocal recognition and enforcement arrangement would work in practise as there has been no previous precedent with the mainland. Hong Kong is the only jurisdiction to have an arrangement with the mainland on reciprocal recognition and enforcement of judgements with such a wide coverage, it said. Justice Secretary Paul Lam said that the new civil and commercial arrangement showcased the unique advantages enjoyed by Hong Kong under the "one country, two systems" formula that the city is governed under. "This will be conducive to enhancing Hong Kong's status as an international legal and dispute resolution services centre.

The defense’s questions were effectively pre-cleared by the judge, as Trump was not allowed to re-litigate the verdict from last year. Trump attorney Alina Habba first asked her client whether he stood by his testimony in a previous deposition denying Carroll’s allegations. Habba then asked, “Did you deny the allegation because Ms. Carroll made an accusation.”“That’s exactly right, yes I did.” Trump replied. Habba asked Martin whether she felt that Carroll enjoyed the attention that came with her lawsuits against Trump. HARRISBURG, Pa. (AP) — A group of conservative state lawmakers in Pennsylvania filed a federal lawsuit Thursday challenging three voting-related executive branch actions designed to boost voter registration, including a 2021 executive order by President Joe Biden. One is last fall's introduction of automatic voter registration in Pennsylvania by Democratic Gov. Shapiro's administration said in a statement that it is “frivolous” to suggest that it lacks the authority to implement automatic voter registration. Twenty-three other states and Washington, D.C., already have varying models of what is called “ automatic voter registration,” according to the National Conference of State Legislatures. Still, former President Donald Trump has already accused Democrats of " trying to steal " Pennsylvania in 2024's election through automatic voter registration.

Atlanta CNN —Former President Donald Trump’s attorneys in the Georgia election subversion case are set to defend their client in a Fulton County courtroom for the first time on Friday as they try to have the charges thrown out on First Amendment grounds. This is the first time Trump’s attorneys will appear in court in the Fulton County case, though their client won’t be with them. Trump hasn’t yet been in the Atlanta courthouse – he previously waived his right to an arraignment hearing – though he was processed at the Fulton County jail in late August. She used a similar legal strategy in a 2014 RICO case in Fulton County, according to a source familiar with the matter. Despite his mounting legal debt and the fact that he is almost 80, sources close to Giuliani said he intends to fight the Georgia case.

The group usually has one active case against financial regulators, but currently has two against the Securities and Exchange Commission (SEC) and one against the Consumer Financial Protection Bureau (CFPB), he said. To be sure, the financial regulators have been sued many times during previous administrations, including by pro-reform advocacy groups. "There are some financial regulators that are walking right into it," he added. In September, for example, bank groups accused regulators including the Federal Reserve of violating the APA with a new capital rule. According to research by Wharton School professor David Zaring, neither industry groups nor individual lenders have filed more than one suit over the past decade challenging Fed policymaking.

“It’s a fundamental strategic goal to present cases in the most favorable light possible, and that would include having a sympathetic and relatable person,” said Clark Neily, the senior vice president for legal studies at the Cato Institute, which has advocated gun rights. A panel of judges on the U.S. Court of Appeals for the Fifth Circuit wrote that he was “hardly a model citizen,” even as they sided with him. Mr. Rahimi’s case could expand gun rights protections by undoing a federal law that makes it a felony to possess a gun while under a domestic violence protective order. Although the case has garnered a flood of amicus briefs from groups like the National Rifle Association, the Second Amendment Foundation, and the Phyllis Schlafly Eagles, the organizations have largely shifted focus away from Mr. Rahimi. “You could imagine a different case challenging this same law with a much more sympathetic plaintiff.”

REUTERS/Dado Ruvic/Illustration/File Photo Acquire Licensing RightsNEW YORK, Oct 24 (Reuters) - Crypto lender Genesis Global said on Tuesday a New York civil fraud lawsuit could lead to a bankruptcy liquidation that does not resolve its claims against parent company Digital Currency Group (DCG). Rather than await the outcome of the lawsuit, Genesis intends to propose a "no deal" bankruptcy plan to distribute available crypto assets to customers and set up a process to preserve litigation claims against DCG and others, Genesis attorney Sean O'Neal said at a court hearing in New York. "It's not an easy decision, but it is an obvious decision," he told U.S. Bankruptcy Judge Sean Lane. Genesis believes creditors would be better off under a bankruptcy plan that includes a DCG settlement, but the company is running out of time to finalize a plan and send it to creditors for a vote, O'Neal said. Trump has slammed the president for the visit, claiming Biden “had no intention” of walking the picket line until Trump said he would make a speech in Michigan. In the absence of an announced plan from the White House, speculation spread through the UAW ranks that Biden would go to whatever picket line was closest to the airport. Amid mounting political pressure to ramp up his public support, Biden is expressing solidarity with the union members, who are striking against the Big Three automakers – General Motors, Ford and Stellantis – for a second week. Union members, once a reliable Democratic voting bloc, have gradually gravitated to Republican candidates, according to CNN polls and the AFL-CIO, the nation’s largest labor federation. The historic presidential picket line appearance will reaffirm his commitment to the critical voting and organizing group ahead of the 2024 election.
