Former FTX CEO Sam Bankman-Fried arrives for a bail hearing at Manhattan Federal Court on August 11, 2023 in New York City. Michael M. Santiago | Getty ImagesHeather Ferguson's son lost approximately $130,000 in cash when crypto exchange FTX went bankrupt in November 2022. Ferguson's letter is part of an eleventh hour push by the defense to appeal to Kaplan's sense of leniency as the judge gears up for Bankman-Fried's sentencing hearing on Thursday. Bankman-Fried's psychiatrist, George Lerner, told Judge Lewis Kaplan in a letter in August that the former FTX CEO has a history of depression and attention-deficit/hyperactivity disorder. Without his medication, Lerner warned the judge, "Bankman-Fried will experience a return of his depression and ADHD symptoms and will be severely negatively impacted in his ability to assist in his own defense."

Bankman-Fried, the founder and former CEO of failed crypto exchange FTX, will head on Thursday to a federal court in downtown Manhattan, where U.S. District Judge Lewis Kaplan will deliver his sentencing. After a month of personally dabbling in the market, Bankman-Fried launched Alameda Research, named after the California county that housed his first office. The so-called crypto winter of 2022 wiped out hedge funds and lenders across the crypto universe. May of 2022 brought the crash of stablecoin Luna, creating a domino effect that sent crypto prices plunging, devastating other lenders. On Nov. 2, 2022, crypto trade site CoinDesk publicized details of Alameda's balance sheet, which showed $14.6 billion in assets.

Bankrupt crypto exchange FTX has struck a deal with a consortium of buyers to sell the majority of its stake in artificial intelligence startup Anthropic for $884 million, according to a filing submitted late Friday to a Delaware court. That group is purchasing nearly $500 million worth of Anthropic shares. Multiple sovereign wealth funds were reportedly clamoring for a piece of FTX's Anthropic stake. Jane Street's head of quantitative research, Craig Falls, has also proposed to personally buy around $20 million worth of shares. Should it be approved, the sale would collectively account for nearly two-thirds of FTX's shares in Anthropic.

Sam Bankman-Fried bilked FTX customers out of over $8 billion, according to prosecutors. AdvertisementAccording to federal prosecutors, Sam Bankman-Fried orchestrated one of the biggest criminal frauds in the history of the world. According to his lawyers, FTX's customers might get all their money back. According to prosecutors, Bankman-Fried was responsible for more than $11 billion in fraud overall between FTX customers and investors in FTX and Alameda Research. The recovered calculations, too, distort how much money customers are actually getting back.

The most striking item on the list was going on then-Fox News host Tucker Carlson's show to "come out as a republican." "Talk about how the cartel of lawyers is destroying value and throwing entrepreneurs under the bus in order to cover up the incompetence of lawyers," Bankman-Fried memorialized. Numerous former executives and associates testified that Bankman-Fried commingled funds of FTX customers with Alameda Research, a cryptocurrency trading firm he also controlled. Bankman-Fried wrote that he could highlight that aspect of his political spending on Carlson's show. In another list, Bankman-Fried came up with a list of "Allies."

By then, he had sold his short-term rental property for a profit, but he still owned other long-term rentals. Therefore, they used the real-estate professional status and bonus depreciation to reduce their taxable income. The main one is through the short-term rental tax loophole (STR loophole). For example, Eileen pointed to Henderson, Nevada, which won't allow a short-term rental permit for a house if there is a permit for an existing short-term rental within 1,000 feet. Deductions would cancel out the taxes owed from the property's revenue, and what is left will reduce your W2 taxable income.

Bankman-Fried's lawyers filed a sentencing submission, asking for a prison sentence of no longer than 78 months — or six-and-a-half-years. The US Probation Office, which issues sentencing reports that judges typically rely on, recommended 100 years behind bars — which Bankman-Fried's lawyers called "barbaric." Advertisement"That recommendation is grotesque," Bankman-Fried's lawyers wrote. Sam Bankman-Fried's approach to veganism illustrated both his selflessness and awkwardness, his younger brother, Gabriel Bankman-Fried, wrote in a letter to the judge. In the sentencing submission, Bankman-Fried's lawyers argue that "the most reasonable estimate" for how much his victims lost was "zero."

The lawyers wrote that Bankman-Fried has a "neurodiversity" that "greatly affects how he perceives and is perceived." It is not a disease or a condition that needs to be cured," the lawyers wrote. "Individuals with ASD are often at considerably greater risk of physical harm and extortion in prison than other inmates," the lawyers wrote.

Read previewUS District Judge Lewis Kaplan ruled that Sam Bankman-Fried could retain his new lawyers despite a noted conflict of interest. Questioned thoroughly by Kaplan, Bankman-Fried affirmed that he wanted to keep his new attorneys, waiving his right to "conflict-free representation," as Kaplan put it. They're expected to help Bankman-Fried with his sentencing hearing, scheduled for late March. In their February letter, prosecutors said Kaplan should hold a Curcio hearing, where the judge could ask Bankman-Fried and his lawyers questions to determine whether a legitimate conflict of interest exists and whether they would waive it for the sentencing hearing. This has the potential to create a conflict in the representation of Bankman-Fried and Mashinsky," prosecutors wrote in the letter.

Not everyone qualifies for bonus depreciation deductions by default. “Any property could qualify for accelerated and bonus depreciation,” said Brandon Ford, a CPA and finance director at C3, a real-estate investment firm. Determining the deductibleOnce you qualify for the deduction, you must determine how much you can claim from bonus depreciation. To determine what Michael could deduct, he reviewed his property tax statement, a publicly available record on the county website. In order to qualify for bonus depreciation, he ordered a cost segregation study, which is a third-party service similar to an appraisal.

Government exhibit in the case against former FTX CEO Sam Bankman-Fried. Lawyers representing the bankruptcy estate of FTX told a judge in Delaware last week that they expect to fully repay customers and creditors with legitimate claims. After the dust settled from FTX's bankruptcy, Solana saw a huge run-up in its price, and it continued to rally after the September report. The bankruptcy estate of FTX has been looking to sell its Anthropic stake, according to a court filing this month. For FTX customers, being made whole, according to a judge's ruling, means getting the cash equivalent of what their crypto was worth in November 2022.

(AP) — A federal appeals court has ordered the appointment of an independent examiner in the bankruptcy case of FTX amid concerns about widespread fraud preceding the collapse of the multibillion-dollar cryptocurrency exchange. A three-judge panel in Philadelphia issued the ruling Friday in an appeal filed by the U.S. bankruptcy trustee, who serves as a government watchdog in Chapter 11 reorganizations. U.S. Bankruptcy Judge John Dorsey denied the trustee’s request last February. The appeals court reversed Dorsey’s ruling, agreeing with the trustee that the bankruptcy code mandates the appointment of an examiner. “Such is the case here.”Restrepo also noted that an examiner is required to make his or her findings public, whereas a debtor or creditors committee conducting an internal investigation has no such obligation.

Here's the state of play globally for crypto regulation and enforcement in 2023 — and a look at what to expect in 2024. "However, much of their work has involved providing guidance to the industry through enforcement actions," continued Levin. Crypto market participants nevertheless hope that the spate of legal challenges brought to crypto companies in 2023 will bring clarity in the form of new regulations. The U.S.'s dominant role in global finance and its focus on consumer protection plays a crucial role in its leading position in crypto regulation enforcement. The region has been increasingly warming to crypto assets, despite a broader anti-crypto push from China, which banned bitcoin trading and mining in 2021.
