Supply-Chain Headaches Ease for Many Companies

Supply-chain snarls are fading from among the top challenges facing some U.S. companies as freight congestion eases, shipping costs fall and factories in Asia are freed from Covid-19 lockdowns. The rising costs and lengthy transit times pushed some companies to cut back on slower-selling products and raise prices. Today, freight congestion has cleared and ocean shipping costs have fallen close to prepandemic levels. Mr. Bergman said the decline was “partially offset by 40 basis points of favorable supply-chain impact driven by lower freight costs, which more than offset product cost headwinds during the quarter.”Some companies said they still have a way to go before supply-chain challenges are resolved. And Ford Motor Co. Chief Executive Jim Farley told a virtual town hall on Feb. 9 that supply-chain problems were continuing to hamper the company’s progress.
A lawyer for Johnson & Johnson’s subsidiary said in a statement that the company would seek a rehearing of the panel’s decision by the full 3rd Circuit court. Gordon’s strategy worked in bankruptcy court but set up J&J for failure when it faced the 3rd Circuit appeals panel. Gordon, at the bankruptcy conference, described the lawsuits as “completely unmanageable” and a dire threat to J&J that could go on for decades. The 7th Circuit Court of Appeals is expected to hear arguments in coming months on a challenge to the 3M subsidiary’s bankruptcy. The litigation, they asserted, should be allowed to proceed against Georgia-Pacific because the parent company did not file for bankruptcy.
Jan 30 (Reuters) - A U.S. appeals court on Monday shot down Johnson & Johnson's (JNJ.N) attempt to offload tens of thousands of lawsuits over its talc products into bankruptcy court. The appeals court ruling revives those lawsuits. Monday's decision by the U.S. 3rd Circuit Court of Appeals in Philadelphia dismissed the bankruptcy filed by the J&J subsidiary in 2021. The appeals court decision could force companies considering the strategy to more carefully consider its risks, two legal experts said. The Texas two-step has garnered criticism from Democratic lawmakers in Washington, and inspired proposed legislation that would severely restrict the practice.

Citi's Scott Chronert expects a mild recession in the first half of this year and revealed three strategy calls that could help investors trade the downturn. Earnings Earnings will likely come in better than expected, according to Chronert in his outlook for this year, published in December. Strength in some sectors Chronert likes both industrials and energy looking ahead. In the December note, Citi listed a number of "preferred" U.S. energy stocks including APA and EOG Resources . As such, he told CNBC Thursday that he's "steering somewhat clear of" mega-cap companies.
Abercrombie & Fitch Co. is moving more merchandise through New York and New Jersey to avoid West Coast bottlenecks. It trailed its East Coast rival again in that measure during September and October, according to the Pacific Merchant Shipping Association and ports data. ”There are so many customers that got so screwed because they were entirely reliant on L.A. and Long Beach.”The logistical challenges of spreading imports along the East Coast and the Gulf Coast are massive. The shift in trade to the East Coast marks a return to where container ships originated. Then the U.S. began importing more goods from Europe, making an Atlantic Ocean crossing to various East Coast ports more critical.
A major rally could be ahead of some stocks that are forming "golden cross" patterns heading into the year-end. A golden cross chart pattern forms when the 50-day moving average climbs above the 200-day moving average. These names underperformed this year through the end of the third quarter, but they're outperforming the S & P 500 in the fourth quarter. However, it has since rebounded 28% in the fourth quarter, while the S & P 500 is up more than 10% in that time. The peak shipping season is fizzling as overstocked retailers cancel overseas orders and freight companies scale back expectations for heavy freight volumes heading into the holidays. Many retailers pulled peak season orders in early this year to avoid a repeat of 2021 when supply-chain congestion caused delays and product shortages during the holidays. Container shipping rates that hit record highs last year have also pulled back sharply, although they still remain above 2019 levels. The peak shipping season cascades down into package transport, as United Parcel Service Inc., FedEx Corp. and others typically handle growing volumes as the calendar counts down to Christmas.
